HomeMy WebLinkAboutRES 090914-H - ETJ Release Fieberg TractRESOLUTION NO. ©q O_ t 1 � - I� A Resolution of the City Council of the City of Georgetown, Texas, releasing approximately 20 acres of Extraterritorial Jurisdiction territory located west of Cross Creek Road near Cimarron Hills known as the Fieberg Tract. WHEREAS, the City of Georgetown, Texas, wishes to release certain real property from its Extraterritorial Jurisdiction (ETJ), and relinquish all ETJ rights in said property; and WHEREAS, Section 42.021 of the Texas Local Government Code establishes the extent of Extraterritorial Jurisdiction of municipalities; and WHEREAS, Section 42.023 of the Texas Local Government Code allows municipalities to reduce the size of their Extraterritorial Jurisdiction (ETJ) and relinquish all ETJ rights in said property by ordinance or resolution; and WHEREAS, the City Council of the City of Georgetown, Texas, in Resolution #021208-T, relinquished territory and defined a joint ETJ boundary in an interlocal agreement with the City of Liberty Hill; and WHEREAS, the City of Georgetown has a long-term interest in the future transportation needs in areas within its planning jurisdiction; and WHEREAS, the City of Georgetown desires to find solutions for the planned Cross Creek Road (sometimes referred to as SW1 Arterial) from SH 29 to the north in order to provide access and good connectivity to existing and anticipated development; and WHEREAS, staff members from the City and Williamson County have been working cooperatively to plan for the future vehicular needs in this area and the needs of this particular roadway; and WHEREAS, the City of Georgetown recognizes practical considerations involving the large floodplain and development difficulties in the planned alignment of SW1 across the property desired for release; and WHEREAS, the release of property from the City of Georgetown, Texas, ETJ will facilitate the development of the said property under a single set of development regulations; and Resolution # O� 0 crl `i — I A Page 1 of 2 ETJ Release: Fieberg Tract Exhibit A attached WHEREAS, the release of property from the City of Georgetown, Texas, ETJ will empower Williamson County to obtain right-of-way, easements, or other similar instrument needed for the future expansion and improvement of the SW1 arterial; and WHEREAS, City staff is authorized to make the necessary adjustments to the planned SW1 arterial on the Overall Transportation Plans. Now Therefore, be it resolved by the City Council of the City of Georgetown, Texas: SECTION 1: The foregoing recitals are hereby found to be true and correct and are incorporated herein by reference for all purposes. SECTION 2: That the City of Georgetown hereby agrees to release certain real property from its extraterritorial jurisdiction (ETJ), said property being as described and shown on Exhibit "A" attached hereto and made part hereof and incorporated herein. By so doing, the City of Georgetown hereby relinquishes all ETJ rights. SECTION 3: If any provisions of this Resolution or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this Resolution which can be given effect without the invalid provision or application and to this end the provisions of this Resolution are hereby declared to be severable. SECTION 4: That the said ETJ Release being proper and according to law, the Mayor of Georgetown is hereby authorized to sign this Resolution and the City Secretary to attest. This Resolution shall become effective on the date of its approval by the Georgetown City Council. PASSED AND RESOLVED this the 91" day of September, 2014.
