known as Berry Creek Highlands -- Sofia Nelson, CNU-A, Planning Director
Planning Director, Sofia Nelson, spoke on the Voluntary Annexation request for 106.21 acres. She
described the location and explained that the development would be known as Berry Creek Highlands.
Nelson provided a location map. She described the property as less than 1.5 mile wide and contiguous to
the City limits. A future land use map was shown.
Nelson provided the annexation process and proposed schedule.
Nelson read the agenda caption.
Mayor Ross opened the Public Hearing at 3.03 PM. No persons had signed up to speak on Item B. Mayor
Ross closed the Public Hearing at 3.03 PM.
No action was required of the City Council.
Councilmember Jonrowe asked why two public hearings would be heard on the same day. Nelson
explained that it was scheduled to be accommodating to the developer, because, if it could not be conducted
in this way the next schedule would have been April through July. Jonrowe asked why a public hearing
could not be heard 2 weeks from now. City Attorney, Charlie McNabb explained that the City Council
meeting schedule of the 2"d and 4th Tuesdays of the month would not mesh with the requirement to have the
hearings between 20 and 40 days. He noted that the developer would have had to wait until a time in the
annual calendar where there are 3 weeks between council meetings. McNabb said the developers
schedule did not allow waiting. Jonrowe said she is concerned about doing the back to back public hearings
and asked to see the slide with the proposed schedule again. Jonrowe noted that there was ample time for
citizens to weigh in. Mayor Ross said there are actually 5 opportunities for people to speak.
C. Public Hearing for the Voluntary Annexation of approximately 208.33 acres in the Burrell Eaves Survey,
