E.'Dozier, his and their ex(;cutors, adiziniztrators, heirs, succes$- ors, or assigns, party of the 8(:cend pert; and subject to the approval of the City Engineer. :R JUU Wherpas, the said City, known as the party of the first part, desires to enter into contract for the improve- ment of streets in the said City as far as the money availa- ble will construct in accordance with the provisions of the State Statutes and of the notice to contractors, specifica- tions, proposal, and plane, annexed hereto and made part here- of; and Whereas, the party of the second part has been engag- ed in and now does such work and represents that he is fully equipped, competent and capable of the performing the above desired and outlined work, and is ready and willing to per- form such pork in accordance with the provisions of the &ttached notice to contractors, specifications, proposals and plans, now: Witnesseth: That for and in of the prices and agreement mentioned in the proposal hereto at- tached and made Fart of this contract, as follows: Price in words. D. 1922; by and between flay Logan of Georgetown, Texas, and the-ZIty of George town, tate of Texas, witnesseth, as follows: The said Rav Logain for and in consideration of the sum of $25,00 per acre does by these presents rent and lease to the aforesaid City of Georgetown, all rights and privileges necessary to accomplish excavation and transport- ation in and from two acres , of lard,,,ie,,nd by the said Ray Logan and situated on or about the bluff near the Lion Head Spring on the North San Gabriel River; such excavation and transportation being made for the purpose of extracting rock from the aforesaid site and this instrument does expressly :convey to the City of GeorgF:town all rock located on the a- foresaid tro acres. It is expressly agreed and understood that the City of Georgetown, has the right and option of extending the' terms of this contract to an additional three acres in the neighborhood and vicinity of the aforesaid two acres. E. Dozierj to improve cer- tain streets in said City, by filling',:' grading and paving same in accordance with the plane and specifications prepared by the City Engineer, and *its the proposal and bid of the said FJ. E. Dozier and said cYpntract *nd the cost of such improve- ments to be paid partly°bytthe said City and partly by the owners of property abutt`°ig on the streets'to be improved and the assessment of such costs to be. made in accordance with the provisions of said Chapter 11, Title 22, of the Revised Civil Statutes of Texas, of 1911.
