The City Council met in adjourned called session on the above date,
Mayor M. F. Smith presiding, the following aldermen and officers
being present, Aldermen: F. R. Buchholz, J. R. Chastain, J. C.
Godbey, C. C. Hamilton and S. R. Tileox. Officers, M. L. Cates,
Secretary.
Chairman of resolution committee J. C. Godbey read the following
resolution, and moved that it be passed:
"THE STATE OF TEXAS
County of Williamson
"Whereas, work order.-wastJLssued_dn June 23, 19'39 for -Contract
No, 3 Cody Memorial Library Building., PWA Docket*Tex 2606-F con-
ditioned upon the filing of Performance Bond; and
"Whereas the Performance Bond was subsequently filed and hp -
proved by the Public Works Administration on AugUs-t lot, 1.939;'and
"Whereas, the actual. beginning date on Contract No.3 was, there-
fore, August 19 1939; and,
"Whereas, the work was completed to a degree making it possibl"e
for the owner to have taken occupancy and used building for pbtposes,
intended long before final acceptance was made, and '
"W'herea.e the gwner has suffered no damage, monetaryn or 'otherwise,
"MOW THEREFORE, be it resolved by the City Council 'of the City of
Georgetown, Texas, that the liquidated damages on Contract No^. 3'Cody
Memorial Library Building PWA Docket Tex 2606-F be and same are hereby
waivdd. "
The motion was seconded by Alderman J. R. Chastain and was
passed unanimously by the council.
There Appearing no further business the Council adjourned
