(3t01-1 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN BY RENAMING CHAPTER 10.04 ENTITLED "RIDING OF UNICYCLES, BICYCLES, VELOCIPEDES AND SIMILAR NON -MOTOR ASSISTED VEHICLES;" AMENDING SECTION 10.04.010 ENTITLED "DUTIES AND AUTHORITY OF THE TRAFFIC ENGINEER" RELATING TO DESIGNATION OF FIFTEEN (15) MINUTE PARKING ZONES; AMENDING SECTION 10.16.150 ENTITLED "DOWNTOWN PARKING ZONE;" ADDING SECTION 10.16.085 ENTITLED "FIFTEEN MINUTE PARKING ZONE;" AND; DIRECTING THE TRAFFIC ENGINEER TO ERECT APPROPRIATE SIGNS INDICATING SUCH ZONES; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY AS STATED IN SECTION 1.08.010 OF THE CODE OF ORDINANCES; PROVIDING FOR PUBLICATION AND SETTING AN EFFECTIVE DATE. WHEREAS, the City has determined that updating certain Chapter titles will facilitate greater transparency and clarity of the regulations within the Code of Ordinances; and WHEREAS, the City has identified additional parking needs in the Downtown Parking Zone to facilitate the flow of residents, visitors, and commerce in Downtown Georgetown; and WHEREAS, The City Council finds that the evaluation and management of the downtown parking zone encourages compliance with the Overall Transportation Plan and the Downtown Master Plan, WHEREAS, The City Council finds that allowing certain 15 -minute parking zones will further enhance the ability of residents, visitors, and businesses to enjoy the amenities in Downtown Georgetown. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: Section 1. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. Chapter 10.04 title of the Code of Ordinances of the City of Georgetown, is hereby amended and shall provide as follows: Chapter 10.04 General Traffic Regulations and Duties of the Traffic Engineer Section 4, Section 10.04.010 of the Code of Ordinances of the City of Georgetown, Texas is hereby amended and shall provide as shown in EXHIBIT A. Section 10. 16.150 of the Code of Ordinances of the City of Georgetown, Texas is hereby amended and shall provide as shown in EXHIBIT B. Section 6. Section 10. 16.085 of the Code of Ordinances of the City of Georgetown, Texas is hereby added and shall provide as shown in EXHIBIT C. Section 7. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 8. That all ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 9. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown. The City Manager is authorized to designate a Traffic Engineer for the performance of the traffic safety duties for the City. Whenever and wherever the Traffic Engineer finds it to be necessary for the free flow and expeditious handling of traffic and the safety of persons and property, the Traffic Engineer is authorized to: A. Designate and maintain crosswalks; B. Mark lanes for traffic and parking stalls on the streets of the City; C. Designate intersections of streets at which drivers operating vehicles approaching the intersection on one or more of the intersecting streets must bring such vehicle to a complete stop before proceeding into such intersection; D. Determine traffic light synchronization for intersections controlled by red, green and amber lights or traffic -control devices to be installed at each intersection; E. Designate intersections of streets at which drivers operating vehicles on one or more of the intersection streets shall yield the right-of-way to any pedestrian legally crossing the designated roadway and to any vehicle in the intersection or approaching the intersection on another street so closely as to constitute an immediate hazard; F. Designate and mark appropriately those traffic lanes on multi-laned streets to be used only by vehicles engaged in left -turn movements; G. Designate the location of loading zones and fifteen (15) minute parking zones; H. Determine the location of tow -away zones in areas where vehicle parking is prohibited; I. Designate temporary closures of streets for traffic safety reasons, such as repair, maintenance, parades or emergency conditions that may arise; J. Designate names for existing public streets which bear no name; and K. Designate and mark temporary truck routes to be followed by construction vehicles and equipment on City Streets; and L. Designate and erect appropriate signage for temporary speed zones for all vehicular traffic on City streets in and around construction areas. "Downtown parking zone" shall mean the area comprised of the following public streets: 1. Austin Avenue between 6th Street and 9th Street, 2. Main Street between 6th Street and 10th Street. 3. 7th Street between Church Street and Rock Street. 4. 8th Street between Myrtle Street and Martin Luther King Street. 5. Church Street, west side between 7th and 9th Streets. 6. 9th street, both sides, between Main Street and Austin Avenue. 7. 9th street, north side, between Austin Avenue and Rock Street. No person shall stop, stand or park a vehicle for more than fifteen minutes in those areas marked, "Fifteen Minute Zone" between the hours of 7:00 a.m. and 7:00 p.m. on any day except Sunday.
