HomeMy WebLinkAboutORD 2017-59 - Sewer System MaintenanceORDINANCE NO. @L011-59 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING TITLE 13, CHAPTER 13.20, SECTION 13.20.060 TITLED "SEWER SYSTEM MAINTENANCE" OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN, TEXAS; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, The City of Georgetown regulates sewage disposal to protect the health and safety of its citizens; and WHEREAS, the City has reviewed the current regulations regarding sewer system maintenance and determined that an update clarifying the private property owner's responsibility for the sewer system on private property; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: Section 1. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance complies with the Vision Statement 2.5(A) of the City of Georgetown 2030 Comprehensive Plan relating to providing cost effective utility services. Section 3. Section 13.20.060 of the City of Georgetown Code of Ordinances is hereby amended and adopted as shown below: Sec. 13.20.060. - Sewer system maintenance. A. For properties with gravity wastewater service, the real property owner shall be responsible for the proper operation, maintenance, and repairs of the sewer system located on such real property from the structure(s) served by the sewer system to the commencement of the public street or public right of way that is contiguous to the real property. B. When, as a part of sewer system testing, the City identifies a flaw in the sewer system located on private property, where a repair is necessary to prevent infiltration or inflow, the real property owner shall be responsible to cause the repairs to be made within one year of the date of notification by the City. D. If repairs are not complete within one year of notification by the City, City may engage the services of a contractor to make the necessary repairs with the costs for such repairs to be paid by the City and subsequently charged to property owner and utility customer. Section 4. All ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force on and after October 1, 2017 in accordance with the provisions of the Charter of the City of Georgetown.
