AO l — 5-7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING TITLE 13, CHAPTER 13.15 TITLED "WATER UTILITY SERVICES" SECTION 13.15.130 OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN TEXAS; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, The City of Georgetown provides water service outside the Georgetown city limits and extraterritorial jurisdiction; and WHEREAS, The City of Georgetown defined a requirement for water utility service connection outside the city limits and extraterritorial jurisdiction; and WHEREAS, The City Council of the City of Georgetown wishes to amend the water system inspection requirements in connection with water service outside the city limits and extraterritorial jurisdiction; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: Section 1. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance complies with the Vision Statement 2.5(A) of the City of Georgetown 2030 Comprehensive Plan relating to providing cost effective utility services. Section 3. Section 13.15.130 of the City of Georgetown Code of Ordinances is hereby amended and adopted as shown on Exhibit A. Section 4. All ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section . 5. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or Ordinance Number: oo -1-5 Description: Water Servicesrdinance Date Approved: "1 , 2017 application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force on and after October 1, 2017 in accordance with the provisions of the Charter of the City of Georgetown. A. The General Manager, or its designee, shall be authorized, under this Chapter, to inspect any premise, real property or building connected to the public potable water system. Inspections shall include, without limitation, a customer service inspection, plumbing inspection within the City of Georgetown extraterritorial jurisdiction, cross connection survey, and irrigation system controller settings review. a. Customer Service Inspection (CSI): All connections to a public water supply system shall include a Customer Service Inspection including a Cross Connection Survey as defined by the Texas Commission on Environmental Quality (TCEQ). i. Prior to connection to the water system the following documents must be on file with the water utility: 1. A Customer Service Inspection Certificate 2. A Backflow Prevention Assembly Test and Maintenance Report (BPATMR) for any required backflow prevention assembly identified by the Customer Service Inspection. ii. Within the City of Georgetown city limits and extraterritorial jurisdiction: 1. The provisions of the plumbing inspections in Chapter 15 of the Code of Ordinances shall govern the provision of water service in addition to the Customer Service Inspection and Cross Connection Survey defined in this section. iii. Outside the City of Georgetown city limits and extraterritorial jurisdiction the following additional requirements apply: 1. A Customer Service Processing Fee per water connection as defined in section 13.04.220 is required. 2. The completion and documentation of a plumbing inspection by the appropriate municipality or the installation and documented test of an approved Backflow Prevention Assembly is required. 3. Employees of the City of Georgetown are excluded from conducting Customer Service Inspections or Backflow Prevention Assembly testing outside the Georgetown city limits or extraterritorial jurisdiction whereby the water service is provided by Georgetown Utility Systems. b.
