HomeMy WebLinkAboutORD 2010-04 - Dev Processing FeesORDINANCE NO.d 0 OLi An Ordinance of the City Council of the City of Georgetown, Texas amending Section 15.04.045 "Development Processing Fees" of the Code of Ordinances (the Code) to revise Planning and Development fees; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. WHEREAS, as part of the 2008-2009 Annual Unified Development Code (UDC) review process the Planning and Development Department reviewed its application processing fees; and WHEREAS, the purpose of this review was to determine if the current fees reflect the applications provided for in the UDC and to simplify the fee structure; and WHEREAS, the City Council has determined that the Planning and Development fees are not required to reflect a full recovery of staff review time spent for each individual application, however; they should seek to recover the cost of application processing; and WHEREAS, there are certain fees that warrant an adjustment to ensure recovery of some staff time, material costs, and simplification; and WHEREAS, the caption of this ordinance was printed in the Williamson County Sun in compliance with the City Charter of the City of Georgetown. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the 2030 Land Use Plan and that the enactment of this ordinance is not inconsistent with nor in conflict with any other 2030 Plan Policies. SECTION 2. The City Council has determined that the Development Processing Fees should be reviewed on a three-year cycle to ensure that the fees are appropriate and reasonable and instructs City staff to develop a fee review process that will be followed every third year. SECTION 3. Section 15.04.045 of the Code of Ordinances entitled "Development Processing Fees" is hereby amended as shown on Exhibit "A" attached hereto and incorporated herein. orJ +ao 10 - oaf SECTION 4. All ordinances that are in conflict with the provisions of this ordinance are, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect on the date of final adoption by the City Council. PASSED AND APPROVED on First Reading on the 23rd day of February 2010. Garver Mayor EXHIBIT A City of Georgetown Planning and Development Application Fee Schedule The following is a summary of the City of Georgetown's land development processing fees. For questions or verification of the total fees for your project, please contact Planning and Development at 512-930-3575. All application fees include the initial notification fees. However, subsequent notifications will be charged to the applicant prior to making each additional notice at the rate of $75 per notice. For large scale projects with over 50 mailed notices, an additional fee of $1.00 per letter shall be charged for each mailing. All calculations will be based on fractions of an acre charged as a full acre. Some applications may require additional companion applications, such as a Comprehensive Plan Amendment that will likely require a GUS Utility Evaluation.
