HomeMy WebLinkAboutORD 82-37 - Industrial Waste./420 ORDINANCE # 82-37 AN ORDINANCE AMENDING INDUSTRIAL WASTE ORDINANCE ADOPTED MARCH 22, 1971, AS AMENDED BY ORDINANCE ADOPTED AUGUST 9, 1971, AND ESTABLISHING LIMITS FOR CONCENTRATIONS OF CERTAIN HEAVY METALS, PRO- HIBITING DISCHARGE OF STORM WATERS, UNPOLLUTED WATERS, AND RADIOACTIVE MATERIALS, PROVIDING AUTHORITY TO DISCONNECT SERVICE FOR VIOLATION OF THE ORDINANCE OR FAILURE TO MAKE PAYMENTS FOR SUCH SERVICE, PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. WHEREAS, the City Council of Georgetown, heretofore on the 22nd day of March, 1971, passed and adopted an ordinance estab- lishing regulations covering industrial wastes, reference to said ordinance being hereby made for all purposes as if copied herein at length; and WHEREAS, the City Council of Georgetown, heretofore on the 9th day of August, 1971, passed and adopted an ordinance amending the industrial waste ordinance, reference to said ordinance being hereby made for all purposes as if copied herein -at length; and WHEREAS, it is desirable to further amend said ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: SECTION 1. DEFINITIONS. The following words'or phrases shall have the meaning herein ascribed to them. A. Storm water means rainfall or any discharge resulting from any type of precipitation; B. Milligrams -per -liter (mg/1) means the same as parts per million —and is a weight to volume ratio; the milligram -per -liter value multiplied by 8.34 shall be equivalent to pounds per million gallons of water. C. Waste means rejected, unutilized or superfluous substances in liquid, gaseous, or solid form resulting from domestic, agri- cultural or industrial activities. D. Wastewater means sewage combined with unpolluted water, storm water, ground or surface water. SECTION 2. PROHIBITED DISCHARGES. That portion of SECTION 1 of the ordinance adopted July 9, 1971, reading as follows: No heavy metals or toxic materials of any character nor description shall be discharged into the sanitary sewer system of the City of Georgetown. Is hereby amended anti hereafter shall read as follows: A. No discharges may contain concentrations of hazardous metals other than amounts specified in sub- section B of this section. B. The allowable concentrations of hazardous metals, in terms of milligrams per liter (mg/1) and determined on the basis of individual sampling in accordance with "Standard Methods" are: J IJ E. No person, establishment, or owner may discharge to public sanitary sewers: 1. unpolluted storm water, surface water, groundwater, roof runoff or subsurface drainage. 2. unpolluted cooling water; 3. unpolluted industrial process waters; 4. other unpolluted drainage; or make any new connections from inflow sources. F. In compliance with the Texas Water Quality Act and other statutes, the City of Georgetown may designate storm sewers and other watercourses into which unpolluted drainage described in Subsection E of this section may be discharged. G. No person, establishment or owner may discharge radio- active wastes or isotopes into public sewers without the approval of the City of Georgetown. H. The City of Georgetown may establish, in compliance with applicable state and federal regulations, regulations for discharge of radioactive wastes into public sewers. -2- a�3 Not To Exceed Daily Grab Metal Average Composite Sample 1. No other hazardous metals or toxic materials may be discharged into public sewers without approval of the City of Georgetown specifying conditions of pretreatment, concentrations, CO volumes, and other applicable provisions. No person, establishment, or owner may discharge to public sanitary sewers: 1. unpolluted storm water, surface water, groundwater, roof runoff or subsurface drainage. 2. unpolluted cooling water; 3. unpolluted industrial process waters; 4. other unpolluted drainage; or make any new connections from inflow sources. AUTHORITY TO DISCONNECT SERVICE. The City shall retain the right to disconnect water or wastewater service under the following circumstances: A. When a person, establishment or owner discharges waste or wastewater that is in violation of the industrial waste ordinance or approvals obtained in accordance with the ordinance. B. When a person, establishment, or owner fails to make payments due in accordance with the user charges set forth in the Sewer User Charge Ordinance. C. At such other times as provided by law or when necessary to protect said City or its inhabitants. SECTION 4. EFFECTIVE DATE. For the preservation of order, health, and general welfare, an emergency is hereby declared and this ordinance shall take effect and be in force from and after its passage. READ, PASSED and APPROVED by the City Council of the City of Georgetown, Texas, on first reading as an emergency this 14th day of December, 1982, for the reason that the passage of this ordinance may prevent the discharge of toxins which might endanger the health of the citizens of Georgetown and because the passage of this ordinance is necessary to preserve the health, safety and welfare of the citizens of Georgetown. � J. - ,-.
