HomeMy WebLinkAboutORD 82-35 - Parades(Z, ORDINANCE # 82•-33 411 V AN ORDINANCE REGULATING THE USE OF PUBLIC STREETS FOR PARADES, PROCESSIONS, STREET DANCES, AND SIMILAR NON TRAFFIC USES; DEFINING PARADE; REQUIRING A PARADE PERMIT; PROVIDING FOR CERTAIN EXCEPTIONS; ESTABLISHING REQUIREMENTS FOR THE APPLICATION; PROVIDING FOR A FILING FEE; FIXING CONDITIONS FOR THE GRANTING OF A PERMIT; REQUIRING LIABILITY INSURANCE; REQUIRING A CLEANUP DEPOSIT; PROVIDING FOR ADDITIONAL CONDITIONS TO BE IMPOSED BY THE CITY COUNCIL; PROVIDING A PENALTY FOR VIOLATIONS OF THIS ORDINANCE; PROVIDING A REPEALING CLAUSE; AND PROVIDING A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: 00 Section 1. Definitions. For the purposes of this ordinance (o the following words and phrases shall have the meanings Iq respectively ascribed to them by this section: 0 Q Parade: Any parade, march or procession of any kind or any Q similar display consisting of fifty (50) or more persons or twenty-five (25) or more vehicles or twenty-five (25) or more beasts of burden in or upon any public street, alley, or sidewalk in the City. The word parade shall specifically include any street dance, race, rally, concert, flea market, block party, or other similar activity occurring upon any public street, alley, or sidewalk in the City; and similar events held on property adjacent to such streets, alleys and sidewalks when such activity requires the closing of said public ways or creates an undue traffic hazard. Parade Permit: A permit as required by this ordinance. Section 2. Exceptions. This ordinance shall not apply to: (a) Funeral processions. (b) Students going to and from classes or participating in educational activities; providing such conduct is under the immediate direction and supervision of the proper school authorities. (c) A governmental agency acting within the scope of its functions. Section 3. No person shall engage in, participate in, form or start any parade, street dance, block party, race, rally, concert, flea market, or any other activity, requiring the closing or blocking off of any portion of any street, alley or sidewalk, or requiring the directing of traffic, unless aap rade permit shall have first been obtained from the City Council. 1 412 Section 4. A person seeking issuance of a parade permit shall file an application with the City Council on forms provided by the City Secretary. Section -5. An application for a parade permit shall be filed with the City Council not less than twenty ( 20 ) nor more than sixty ( 60 ) days before the date on which it is proposed to conduct the parade or event. Section 6. The application for a parade permit shall set forth the following information: (a) The name, address, and telephone number of the person seeking to conduct such parade or event and who will be responsible for its conduct. (b) If t h e parade or event is proposed to be conducted for, on behalf of, or by an organization., the name, address and telephone number of the headquarters of the organization and of the authorized and responsible heads of such organization. (c) The date and times when the parade is to be conducted, the route to be travelled, the starting point, and the termination point. (d) The name and location of any streets, alleys or sidewalks to be blocked or closed. (e) The approximate number of participants and whether or not there will be any animals used anywhere along the course of the parade. (f) Any additional information which the City Council shall find reasonably necessary for a fair determination as to whether a permit should issue. Section 7. A filing fee of twenty-five dollars ($25.00) shall be paid to the City Secretary upon submission of the application. Section S. The City Manager may issue a parade permit, when from a consideration of the application and such other information as may otherwise be obtained it finds that: (a) The conduct of the parade will not substantially interrupt the safe and orderly movement of other traffic, both vehicular and pedestrian. (b) The conducting of the parade will not require the diversion of so great a number of police officers as to prevent normal police protection to the City. (c) The conducting of such parade will not interfere with the movement of fire fighting equipment enroute to a fire. (d) The conducting of the parade is not reasonably likely to cause injury to persons or property, to provoke disorderly conduct, or create a disturbance. 2 413 (e) The parade is not to be held for the sole purpose of advertising any product or goods and is not designed to be held purely for private profit. (f) The parade i s of sufficient interest to the general public as to justify the temporary closing of the public roadways to vehicles and pedestrians. (g) The applicant has provided a general liability insurance policy for the event in the amount of $300,000 or in a greater amount of coverage should the Council deem it necessary. (h) The applicant has provided a cash deposit in the amount required by the Council not less than $250.00 to insure the cleanup of any litter, trash, garbage or other material from the streets and areas adjacent to the route or location of the event. (i) The applicant has complied with any other special conditions imposed by the City Council or other authorized official for the issuance of a parade permit. 00 Section 9. Each parade permit shall state the following CD information pursuant to the application as may have been mo difie d by the City Council. Q Q (a) Dates and times covered by the permit. (b) Routes to be traversed or location and streets to be blocked. (c) Any special conditions imposed by the City Council. (d) Approximate number of participants. Section 10. The Parade Chairman or other person heading o r leading such activity shall carry the parade permit upon his person during the duration of the parade and exhibit it upon demand of any city official. Section 11. It shall be unlawful for any person participating in any parade, for which a permit hereunder has been issued, to fail to comply with all directions and conditions of said permit and all applicable laws and ordinances. Section 12. Penalties. Any person, firm, association of persons, corporation, or every other organization violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction shall be subject to a fine not exceeding two hundred ($200.00) dollars. 'Section 13. Severability. If any section, sub -section, paragraph, sentence, clause, phrase or word in this ordinance or application thereof to any person or circumstance is held invalid, such holding shall not affect the validity of the remaining portions of the ordinance and the City Council hereby 3 A�A 414 declares it would have passed such remaining portion of the ordinance despite such invalidity. Section 14. Repealing Clause. All ordinances or parts of ordinances in conflict herewith are expressly repealed. Passed on the first reading on the 9 th day of November 1982, and passed on the second reading on the _14 day of December , 1982.
