HomeMy WebLinkAboutORD 05.10.1976 - General Telephone60 STATE OF TEXAS BY AUTHORITY OF THE CITY COUNCIL COUNTY OF WILLIAMSON OF THE CITY OF GEORGETOWN ORDINANCE AN ORDINANCE REGULATING AND PRESCRIBING THE RATES OF THE GENERAL TELEPHONE COMPANY OF THE SOUTHWEST:. AND PROVIDING FOR THE EFFECT- IVE DATE OF THESE RATES. WHEREAS, the General Telephone Company of the Southwest has filed an Application with the City Council of the City of Georgetown to increase its rates within the City of Georgetown to be charged to users of local exchange telephone service, and the City Council after duly considering said Application, making an investigation, study, and giving the Company a Hearing, is of the opinion that the rates prescribed in this Ordinance will yield a fair rate of return to the Company on the property actually used for rendering service to the public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN: Section 1. That the General Telephone Company of the Southwest is hereby authorized to place in effect as of the 10th day of May, 1976, the following schedule of rates: Class of Service Monthly Rates BUSINESS: 6.30 One Party $15.25 Two Party 12.85 Extensions 1.75 RESIDENCE: One Party 6.95 Two Party 6.30 Four Party 5.95 Extensions 1.25 OTHER: Semipublic 15.25 Key Lines 19.05 PBX/PABX Trunks 26.70 The rates increased by this Ordinance is for the purpose of raising current revenue from the Georgetown exchange in the amount of not more than $22,500.00 per annum and such increase shall not exceed $22,500.00 per annum, over earnings in test year ending March 1, 1975. Section 2. A service charge of $30.00 for residential and $40.00 for business shall be established as a charge for minimum service, installation, reconnects and moves or changes. Section 3. That the present levels of rates and charges for miscellaneous services and equipment not included in the rates specified in this ordinance were taken into account in establishing the here approved schedule rates and charges, and all such rates and charges for miscellaneous services and equipment shall remain subject to the power of the City Council. Therefore, in the event that the General Telephone Company of the Southwest desires to increase such rates and charges for miscellaneous services and equipment itshall, prior to instituting any increase in such rates and charges, file with the City a proposed tariff, together with a report showing the class of service or equipment involved, the present annual revenues being obtained from such service, the prospective number of customers to be affected, the amount of the proposed monthly increase in the rates and charges for such service, and the estimated annual increase in revenues to be generated by such increase in rates and charges. N CY7 W U Section 4. That these rates shall become effective at 12:01 A. M. on the 10th day of May, 1976. Section 5. That the rates prescribed in the Ordinance passed onfinal reading April 14, 1975, are hereby rescinded and set aside as of the effective date of the rate prescribed in this ordinance. Section 6. That the General Telephone Company of the Southwest shall file, within ten (10) days from the passage of this ordinance, an unqualified acceptance of the terms and pro- visions of this Rate Ordinance, and the failure to promptly accept the terms hereof within the specified time, or an attempted acceptance under protest, or with qualifications, shall render this Ordinance void, and the rates fixed by the ordinance of April 14, 1975, shall continue in effect. Should the General Telephone Company of the Southwest fail, within a reasonable time, to provide additional telephone facilities so that all who desire service of whatever grade or character, then in that event the City Council reserves the right to give reasonable notice to the General Telephone Company of the Southwest to show cause why the rates provided for in this Ordinance should not be revoked and the rates provided in the Ordinance of April 14, 1975, should not be reinstated. Section 7. That nothing in this ordinance shall be construed as in any manner limiting modifying, or abrogating the right and power of the City Council, under the Charter of the City of George- town, the consititution and laws of the State and the United States to regulate the rates charged by the General Telephone Company of the Southwest for local exchange telephone service within the City of Georgetown. Read, passed and adopted by majority vote on the first reading this 22nd day of April, 1976, and read, passed and adopted on second reading this the 10th day of May, 1976.
