BB IT ORDAINED by the City Council of the City of Georgetown, Texas. That the Southwestern University, located within said City, are hereby granted the right to erect poles and wires in, along and across the streets and alleys of this city for the purpose of erecting, maintaining and operating a system of electric lights in this said cityp both arc and incandescent, if they so see fit, and for the supplying of power for their own private use, and for the generation and supply of electricity for all purposes for which the same is now, or may hereinafter be used, for a period of twenty-five years from the passage of this ordinance* and fur- ther, if the said University may see fit, they may place, or cause to be placed, in, on, along or across the streets of said city so used, at their own expense, city street lights, for the purpose of lighting the said streets, provided the same are kept and used in the manner and condition hereinafter provided. Section !. The said system so provided for, shall be used for the one purpose alone of lighting the buildings belonging to the said University'# and shall not be allowed to come in conflict or competition with other systems or plants, holding a franchise and doing business in said city, and o fering themselves for hire to the public, but instead this franchise so granted, shall apply only to the furnishing of light and power to the University buildings alone. Section 3. That the said Southwestern University shall so long as it use said streets for said purposes, maintain and op- erate such portion of said'electrie light plant, poles, wires and lights as may be located upon the property of said city or its said streets or alleys, under this franchise, in a safe and proper manner, under such rules and regulations, as may be from time to time promulgated by the City Council, and agreed upon by the �L c 9: said city council, and the said University. Said University shall locate their poles and wires at such points as may be designated by the city council, through said city's street commissioner, and where said wires shall some in contact with anything whatsoever, the said wire shall be kept safely in- sulated. Said poles shall be placed on University Avenue, in said city, at proper intervals, beginning at a point just South of the Ladies' Annex building, on said Avenue, and con- tinuing in a Westerly direction, with said Avenue, to a point just South of the old University building, on said Avenue, and the said poles shall be of a uniform heightp so far as practicable, shall not interfere with the poles already stand- ing on said Avenue, and shall not be lower than twenty feet from ground to the place where said wires shall be strung on said poles. Section 3. That the said Southwestern University, shall, in consideration of the above franchise# hold the said city harmless against all damages, either real, personal or punitory, caused from the erection or maintenance of said system or plant. Section 4. If the Southwestern University shall accept this franchise, and shall at any time fail to perform any of the duties required herein -of said Univeriity, said failure shall operate as a total forfeiture of said franchise.
