HomeMy WebLinkAboutORD 79-32 - Abandoning Easementz 4 ORDINANCE NO. 79-32 AN ORDINANCE VACATING AND ABANDONING PUBLIC UTILITY EASEMENTS LYING AND BEING SITUATED ON A 20.77 TRACT DESCRIBED IN A DEED FROM JONAS SHELL,ET AL, TO RONALD E. TYNES, TRUSTEE, DEED DATED JANUARY 27, 1972, AND RE- CORDED IN VOL. 545, PAGE 247, OF THE DEED RECORDS OF WILLIAMSON COUNTY, TEXAS: AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: WHEREAS, a petition has been received from Bob Norris, et al, the owners of a certain 20.77 acre tract described in a deed from Jonas Shell, et al, to Ronald E. Tynes, Trustee, deed dated January 27, 1972 and recorded in Vol. 545, Page 247, of the Deed Records of Williamson County, Texas, and WHEREAS, there exists two Utility Easements, as herein described by Exhibit "A" and Exhibit "B", attached hereto, for the purpose of erecting and installing Electric Pole Lines and Water Mains; and WHEREAS, Bob Norris, et al, have consented and agreed to grant an easement at another location, which would provide and give equal access to existing and new water mains, NOW THEREFORE, BE IT ORDAINED by the City Council of ti;e City of Georgetown, Texas that the easements as described in Exhibit "A" and Exhibit "B", attached hereto, be and the same are hereby vacated, closed, and abandoned, e, that the City of Georgetown reserves for itself or for any public utillLy company, the right to maintain, repair and replace any water lines or other utility lines presently located in, upon or over said easements. The urgent need for the acquisition of a new easement to install additional water mains to better serve the citizens of Georgetown with an adequate water supply creates an emergency for the immediate preser- vation of order, health, safety and general welfare of the public that requires this Ordinance to become effective from and after the date of its passage as made and provided by the Charter of the City of Georgetown, and it is so ordained.
