HomeMy WebLinkAboutORD 79-30 - Abandoning EasementORDINANCE NO. 79-30 AN ORDINANCE VACATING AND ABANDONING A STREET AND UTILITY EASEMENT LYING AND BEING SITUATED IN ROYAL OAKS SUBDIVISION AN ADDITION IN THE CITY OF GEORGETOWN, WILLIAMSON COUNTY, TEXAS, ACCORDING TO THE MAP OR PLAT THEREOF OF RECORD, PLAT RECORDS, WILLIAMSON COUNTY, TEXAS AND AUTHORIZING THE ISSUANCE AND EXECUTION OF QUIT CLAIM DEED FROM THE CITY OF GEORGETOWN, TEXAS TO THE INDUSTRIAL CORPORATION OF GEORGETOWN, THE ADJOINING AND ADJACENT PROPERTY OWNER. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS WHEREAS, a petition has been received from the Industrial Corporation of Georgetown, the owner of land adjoining a street and utility easement located in Royal Oaks Subdivision in the City of Georgetown, Williamson County, Texas and described in Exhibit A attached hereto; WHEREAS, petitioner states that the said street has not been used by the public in many years and while dedicated has not been open to the public and that said utility easement has served only the property owners and does not extend beyond a dwelling located thereon. WHEREAS, petitioner states it has been the owner of said property and dwelling adjoining and adjacent to said street and easement which is requested to be vacated, closed and abandoned; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Georgetown, ? Texas that the said street and utility easement be and the same is hereby vacated, closed and abandoned, except that the City of Georgetown reserves the right to install, maintain, repair and replace any water, sewer or other utility line located or to be located in, upon or over said street; and BE IT FURTHER RESOLVED the Mayor of the City of Georgetown is hereby authorized and directed to execute quit claim deeds on behalf of the City of Georgetown in and to said street and easement to the Industrial Corporation of Georgetown, a Texas corporation with its offices in Georgetown, Texas or its nominee.
