HomeMy WebLinkAboutORD 03.13.1979 - Electrical Standards31 ORDINANCE NO. 79-9 AN ORDINANCE ESTABLISHING ELECTRICAL INSTALL- ATION AND PERFORMANCE STANDARDS FOR ALL CLASS- ES OF ELECTRICAL WORK IN THE CITY OF GEORGETOWN AND AREAS ADJACENT TO THE CITY RECEIVING CITY ELECTRICAL SERVICES; ESTABLISHING DUTIES AND RE- SPONSIBILITIES OF THE CITY ELECTRICAL INPPECTOR; CREATING THE CITY BOARD OF ELECTRICAL EXAMINERS TO EXAMINE AND CERTIFY QUALIFICATIONS OF PERSONS APPLYING FOR ELECTRICAL CONTRACTOR, MASTER ELECTRICIAN, JOURNEYMAN ELECTRICIAN AND BUILD- ING MAINTENANCE ELECTRICIAN LICENSES AND TO HEAR APPEALS FROM DECISIONS OF THE CITY ELECTRICAL INSPECTOR; PROVIDING FOR RECIPROCAL RECOGNITION OF AN ELECTRICIANIS QUALIFICATIONS WHEN LICENSED BY OTHER TEXAS CITIES; ESTABLISHING REQUIREMENTS FOR PERMITS AND INSPECTIONS OF ELECTRICAL WORK,- ORK;SETTING SETTINGTECHNICAL STANDARDS BY ADOPTING BY RE- FERENCE THE NATIONAL ELECTRICAL CODE, 1978 EDITION, THE NATIONAL ELECTRICAL SAFETY CODE AND ESTABLISH- ING MORE STRINGENT STANDARDS FOR SOME CLASSES OF WORK; ESTABLISHING FEES FOR EXAMINATION, LICENSES l AND PERMITS; AND PROVIDING FOR PENALITIES FOR VIO- LATIONS OF THE ORDINANCE. C7 312 ELECTRICITY Article I. In General Sec. - 1. Enforcement of Ordinance provisions. The enforcement of the provisions of this ordinance shall primarily devolve upon the city electrical inspector and his inspectors and assistants. They shall have the right to inspect and enter upon all premises and buildings that are wired for electricity to make such inspections as are necessary for the protection of the property and surrounding property and the public as a whole. Such officers are given police powers to enforce this ordinance; but the department of police, the city electrical department and the fire department shall also be charged with the enforcement of this ordinance and shall, so far as possible, act in cooperation with the city Building department. Sec. - 2. Penalty for violation of ordinance provisions. Any person who shall violate any of the provisions of this ordinance or who shall fail to comply with the requirements of this ordinance, shall be deemed guilty of a misdemeanor. Each and every day's continuance of any violation of the provisions of this ordiraaoe shall constitute and be deemed a separate offense. In case of any such violation of any of the terms or provisions of this ordinance by any corporation, the officers and agents, and person or persons actually performing the work for such corporatidtn shall be subject to the penalties herein provided. Sec. - 3. Licenses, permits required. No person, except public telephone, telegraph messenger services, City electrical department and traction companies operating under a regular franchise granted by this city, shall enter upon the erection, bonstruction, alteration or change of any electrical installation, work, wiring or fitting of electrical machinery until such person shall have first secured a license and permit as required by this ordinance. Sec. - 4. Supervision of placement of wires, etc. The city electrical department is hereby authorized, empowered and directed to have general supervision over the placing, stringing or attaching of telegraph, telephone, electric light or other wires and cables, and the placing of all poles and appliances, so as to prevent fires, accident or injury to persons or property; to cause all such wires and electric lights to be so placed, constructed, and guarded as not to cause fire, accident, or endanger the life or property of any inhabitant of the city; and all such lights and wires or electrical apparatus now existing, as well as'those hereafter constructed and placed, shall be subject to such supervision. Sec. - 5. When wires to be disconnected. (a) In time of fire, severe weather conditions, or other emergency, wherein the safety of lives or property may be endangered by the continued operation of electrical service wires or apparatus providing electrical current, such may be ordered disconnected by the city electrical department,, the mayor, the chief of the fire department, or the chief of police. Any such order shall be binding on every person owning or controlling such wire or apparatus and such wires or apparatus as may be designated by any of the above authorized officials shall be promptly disconnected and left unconnected until proper authorization is given to reconnect same. (b) The city electrical department shall disconnect the electrical service to any building and/or premises except private residences and/or apartment buildingf used as residences each time such buildings or permises has been vacated and it shall not again supply electricity to such buildings or premises until authorized to do so by the electrical inspedtor. (c) The City electrical department shall disconnect any private residence and/or apartment building when the electrical inspector notifies the City electrical cepartment prior to such time that said residence and/or apartment building has been vacated and said light and power company shall not again supply electricity to such residence and/or apartment building until authorized to do E -o by the electrical inspector. (d) The owners and/or the new occupants of such buildings and/or premises shall make application to the city electrical inspector for inspection. .,The permit fee for such inspection shall be as set out in section 74, but shall be not less than a minimum of three dollars ($3. 00). The electrical inspector shall make the inspection within forty-eight (48) hours, exclusive of Saturdays, Sundays and+ holidays, from the time such application is made, or as soon thereafter as is practicable. Sec. - 6--15. Reserved. Article H. Licenses Division 1. Generally Sec. - 16. Definition. For the purposes of this article, the word "board" shall mean the Board of Electrical Examiners of the city. Sec. - 17. Application of article provisions to military personnel. Any holder of any valid, unexpired electrical license issued by the city, under the terms of this ordinance who becomes, or has become a member of the Armed Forces of the United States of America, is hereby exempt from the payment of any renewal on their license so long as they remain in such armed forces, and for six (6) months after their discharge therefrom. Any person coming under this section, who shall make application to th& city electrical department for the same type of license held by him at the time he entered the armed forces within the (6) six months' period, shall be issued such license upon the payment of the renewal fee for the year such application is made. Sec. - 18. Class of electrician; examination required --Electrical contractor. An electrical contractor's license shall entitle the holder thereof to contract for and engage in the business of installing, erecting or repairing electrical wires, conductors, devices, systems or instrumentalities and construction according to the provisions of this ordinance. Sec. - 19. Same --Master electrician. The master electrician's license shall entitle the holder thereof to superintend all electrical installations under the holder of an electrical contractor's license according to the provisions of this ordinance. The holder of a master electrician's license shall be entitled to be in general charge and supervision of the business of installing, erecting or repairing electrical wire, conductors, moulding, ducts, raceways, or conduits, electrical machinery, apparatus, devices, systems or instrumentalities, as the manager or superintendent of a licensed electrical contractor. He shall be required to pass an examination required for a master electrician. Sec. - 20 a. Same --Journeyman electrician. A journeyman electrician's license shall entitle the holder to work as an electrician for and under the holder of an electrical contractor's license, according to the provisions of this ordinance. The holder of a journeyman electrician's license shall be entitled to engage himself in the employ of any holder of an electrical contractor's license, under the supervision of a master electrician. He shall be required to pass an examination required for a journeyman electrician. 20 b. Same --Journeyman electrician (restricted). A journeyman electrician's (restricted) license shall entitle the holder to do work as an electrician for and under the holder of an electrical contractor's license according to the provisions of this ordinance as it applies to dwelling units only and further restricted to 115-230 volt, single phas service installations of 2OU am erej or less. We holder of a journeyman electricians restrictedlicense shall e entitled to engage himself in the employ of any holder, of an electrical contractors license, under the supervision of a master electrician. He shall be required to - pass an examination required for a journeyman electrician as it applies to dwelling units and 115-230 volt, single phase service installations of 200 amperes or less. Seca - 21. Same --Apprentice electrician. The holder of an apprentice electrician's license shall be entitled to engage himself in the employ of any holder of an electrical contractor's license, while under the supervision of a master electrician or a journeyman electrician on the job site. 1314 Sec. - 22. Same --Building maintenance electrician. A building maintenance electrician's license shall entitle the holder thereof to maintain and repair electrical installations in a particular building or buildings for a designated employer according to the provisions of this ordinance, but shall not entitle him to otherwise engage himself as either a master or journeyman electrician. The holder of a building maintenance electrician's license shall be entitled to repair and maintain electrical wiring, apparatus, equipment and machinery upon the premises specifically covered by his license, when such work is done for and in behalf of his employer in connection with such employer's use or occupation of the premises or business conducted thereon. He shall be required to pass an examination required for a building maintenance electrician. Seca - 23. Bond, qualifications for electrical contractor. Each applicant for an electrical contractor's license shall, as a condition for the issuance of the same, furnish a surety bond payable to the city in the amount of two thousand dollars ($2, 000. 00), with such sureties as the city manager and the city attorney shall approve and in a form approved by the city attorney, with the condition that such holder will comply with the laws and ordinances relating to electrical wiring and construction and will pay all damages, costs and expenses caused by his employees' or agents' negligence or failure to comply with such laws and ordinances. Each holder of an electrical contractor's license shall furnish financial statements, references, recommendations and such other evidence as required to satisfy the board as to his qualifications and ability to contract for electrical work. Also, each holder of an electrical ltontractor's license shall either hold a valid master electrician's license from the city or have in its employment as a permanent full-time employee a master electrician licensed by the city who shall be in direct supervision of all electrical wiring or construction. Sec. - 24. Employment of apprentice electricians. Any person holding a valid electrical contractor 's"license under the provisions of this chapter may have licensed apprentice electricians to assist in any electrical work, provided that such apprentice electricians shall work only on the job site with and under the supervision of a licensed journeyman or master electrician. Sec. - 25. Application for examination; examination fee. (1) All applicants for examination for any type of electrician's license shall file with the secretary of the board written application in such form and at such time as the board may prescribe. If the application is for an examination for master electrician, it shall be supported by evidence showing the applicant has a total of six (6) years experience, three (3) years of such experience as a journeyman electrician, or the equivalent of such experience gained by earning an engineering degree from an accredited college or university. If the application is for an examination for journeyman electrician, it shall be supported by evidence that the applicant has a total of four (4) years experience as an apprentice or the equivalent of such experience gained by earning an associate degree by the completion of an electrical course at a state technical training school. If the application is for an examination for journeyman electrician (restricted), it shall be supported by evidence that the applicant has a total of two (2) years experience as an apprentice electrician. If the application is for an examination for main- tenance electrician, it shall be supported by evidence that the applicant has the same experience required for an applicant for journeyman electrician. (2) The following examination fees must be submitted with each application: Master electrician $10.00 Journeyman electrician 5.00 Building maintenance electrician 5..00 Sec. - 26. Re-examinations; re-examination fee --First. No applicant who has failed to pass his first examination for an electrician's license shall be examined again prior to the expiration of two (2) months thereafter and for his second examination he shall be required to pay an additional examination fee in such sum as set forth in Section 25-2. 911 Sec. - 27. Same --Second. No applicant for an electrician's license who has failed to pass his second examination shall be examined again until the expiration of six (6) months thereafter and for his third examination he shall be required to pay an additional examination fee according to the following schedule: Master electrician $15.00 Journeyman electrician 15.00 Building mainteance electrician 7. 50 Sec. -28. Same --Third. No applicant for an electrician's license who has failed to pass three (3) or more examinations shall be examined again until the expiration of nine (9) months following the date of his last examination and, for each such examination, he shall be required to pay an additional examination fee according to the following schedule: Master electrician Journeyman electrician Building Maintenance electrician Sec. - 29. Permanent address. y Each holder of an electrical license of provisions of this article shall furnish the permanent post office address. Sec. - 30. Fees. $25.00 15.00 15. 00 any class issued by the city under the city electrical inspector with =his Licenses to be issued under the provisions of this article shall be issued only after the payment and collection of the following fees: Class Original Renewal Electrical contractor $100.00 $50.00 Master electrician 30.00 15.00 Journeyman electrician 10.00 5.00 Apprentice electrician 2.50 1.00 Building maintenance electrician 10.00 5.00 Sec. - 31. Issuance. When an applicant for a license required by the provisions of this article has fully complied with all provisions of this article, the board shall cause to be issued to such applicant the license applied for. Sec. - 32. Expiration. Every license issued under the provisions of this article shall expire on the thirty-first (31st) day of December following the date of issuance. Sec. - 33. Renewal. Each licensee under the provisions of this article shall be entitled to renew his license upon the payment of the renewal fee set forth in section 30, provided such payment is made on or before the expiration date. In the event such licensee fails to renew his license on or before the expiration date thereof, he may be required to pay the full fee and take such examination as required for the original issuance of the license. The Board may from time to time establish grace periods for activating expired licenses based on a hearing of the circumstances causing the late renewal, however, if such a grace period is granted the applicant will be required to pay the original license fee. 316 Sec. - 34. Transfer. (a) It shall be unlawful for any person to transfer his electrician's license or to allow the use of his license directly or indirectly by any other person for the purpose of obtaining a permit to do electrical work. It shall also be unlawful for any person not holding a license to use the license of another for the purpose of doing electrical work or for the purpose of securing a permit to do electrical work. (b) Where the holder of a license changes the firm name under which he operates, or where additional members are taken into the firm or where the firm is incorporated, a notice of such changes shall be forwarded to the city electrical inspector; otherwise. such license, shall be subject to revocation because of its questionable ownership. Sec. - 35. Revocation of license. Any electrical license of any class issued by the city under the provisions of this ordinance may be suspended or revoked by the city council upon the recommenda- tion of the board should the holder violate any provision of this Code, state law or city ordinance or regulation relating to or governing electrical wiring, repairing or construction. Any person whose license shall have been revoked, shall not again be licensed within a period of one (1) year from the date of such action, but no license shall be suspended or revoked.unless the licensee shall have been given an oppor- tunity to appear and be heard by the board and subsequently by the city council of which hearings he must have had at least ten (10) days' written notice specifying the reasons therefor. Sec. - 36-46. Reserved. DIVISION 2. BOARD CP ELECTRICAL EXAMINERS Sec. 47. Created. There is hereby created and established in and for the city a board which shall be known as the Board of Electrical Examiners. Sec. - 48. Members. The board shall consist of six (6) members who shall be appointed by the City Council. Of these six (6) members, two (2) shall be licensed and active master electricians with principal business offices established in Georgetown, Texas; one (1) member may be an Electrical Engineer or master electrician with at least ten (10) years experience as an electrician and with a principal business office established in Georgetown, Texas; one (1) member shall be a journeyman electrician except a master electrician may serve the first term; one (1) member shall be an owner of a business whose principal office is located in Georgetown, Texas, but is not actively engaged in the electrical trade or electrical business, but who shall be familiar with building and construction trades; and one (1) member shall be a homeowner citizen of Georgetown with knowledge of the electrical trade. Sec. - 49. Same -Ex officio members. The city electrical inspector and the city electrical superintendent shall serve on the board as ex officio members while holding their respective offices. No ex officio member of the board shall have the right to vote in the proceedings of the board. Sec. - 50. Same --Terms. The appointed members of the board shall hold office for a period of two (2) years or until their successors have been duly appointed and qualified; provided however, that the initial appointments made under this section shall be for terms of such duration that no more than two (2) of the terms shall expire in any one year; and provided further, that the terms of the two (2) master electricians shall not expire the same year. Sea - 51. Same Compensation. The members of the board shall serve with no compensation whatsoever. Sec. - 52. Same --Filling of vacancies. I f for any reason any member of the board shall be from his respective position, or shall be removed for shall appoint a successor to fill the unexpired term. Sec. - 53. Chairman. 311 unable to act, shall resign any cause, then the city council The appointed members of the board shall elect as chairman of the board one of thsir number. Sec. - 54. Secretary. The city electrical inspector shall be the secretary of the board and shall keep a full record of all proceedings of the board and such other records as the board may direct. Sec. - 55. Meetings. The board shall have the power to make and promulgate its own rules governing its meetings and proceedings, subject to 'the provisions of this ordinance,- but the board shall have at least one (1) regular meeting each calendar month. Special meetings of the board shall be called by the chairman of the board or upon the written request of two (2) members of the board. Sec. i-56. Examination of electricians. (a) It shall be the duty of the board to examine and pass upon the fitness and qualifications of all persons applying for license under the provisions of this article, and to certify to the city building official applicants as are found by the board to possess satisfactory knowledge, fitness and ability as electricians and familiarity with and understanding of the rules, ordinances and regulations governing electrical wiring, repairing and construction in the city. The examination shall relate to the fitness and qualifications of each applicant for the particular class of license for whieh.he has applied. (b) Electricians holding a currently valid license or certificate of registration issued by or from another city located within the State of Texas may apply for and receive a similar license or certificate of registration from and by the City of Georgetown, Texas, without taking any examination, provided the following conditions precedent are fully performed and complied with: (1) Such electrician shall submit evidence satisfactory to the building official of the City of Georgetown, Texas, that his electrician's license or certificate of registration was issued by and from another city within the State of Texas, and that such electrician presently and properly holds a currently valid electrician's license or certificate of registration from and by such city, and further, that the city which issued said electrician's license or certificate of registration does and is, as an act of mutual reciprocity, under said other cities' ordinances, honor and accept electricians' licenses or certificates of registration issued by the City of Georgetown, Texas, and does permit, and is permitting, such electricians licensed or certificated by the City of Georgetown, Texas, to apply for and obtain similar electricians' licenses or certificates of registration and in fact, does perform electricians' work within the city limits of said other city of the State of Texas. ( 2) Such electrician licensed or certificated by another city within the State of Texas shall pay the fee required for registration and licensing under the electrical code of the City of Georgetown, Texas, and such said electrician shall comply with all other requirements of said electrical code, save and except, that such electrician shall not be required to take any type d examination. X18 (3) The building official of the City of Georgetown, Texas, shall keep an accurate and current record of the names of all cities located within the State of Texas that, by and as an act of mutual reciprocity, agrees to, and, in fact, perform the essential reciprocal conditions and provisions set out in this section. Sec. - 57. Power to hear appeals. The board shall have the power to hear appeals and render decisions upon rulings and refusals of rulings by the chief electrical inspector when requests of a modification of or a variation from the provisions of this chapter have been made. Sec. 58. Appeals --Notice to board Whenever any person has requested a special ruling or permission under the pro- visions of this ordinance, and such ruling has been refused, and such person is aggrieved by such ruling or refusal, he may appeal such,: or refusal to the board for review. Such appeal shall be perfected by giving a written notice containing the following information to the chairman of the board: (a) Name and address of person making appeal; (b) Facts surrounding the particular4ruling or refusal to make ruling; (c) The ruling, if any, of the chief electrical inspector; (d) Reasons why such ruling should be set aside, or, if a ruling were refused, why such ruling should be made. The person making the appeal shall send copies of such appeal to the chief electrical inspector and the city attorney. Sec. - 59. Same --Hearing. Upon receiving a notice of appeal, the chairman of the board shall make an order setting the appeal for hearing at a specified time and place, and shall give notice of such information in writing to the person making the appeal, the chief electrical inspector, and the city attorney. The hearing shall be held as soon as is practicable, and in all cases shall be within two (2) weeks after the notice of appeal is received by the chairman of the board, unless the person making this appeal requests in writing that he be granted additional time. If such person has failed to make his appearance at the proper time and place to present his appeal, then at the third (3rd) consecutive regular meeting of the board after such notice of appeal has been received by the chairman, such appeal shall be dismissed by the board. Sec. - 60. Same --Effect during proceedings. During the pendency of the appeal to the board, the ruling or refusal of the inspector shall be in full force and effect. Secs. - 61--70. Reserved. Article M. Permits and Inspections Sec. - 71. Inspection no relief from responsibility. This article shall not be construed to relieve from or lessen the responsibilities of any person owning, operating or installing electrical wires, appliances, apparatuk construction, or equipment for the damage to property or persons, injured by any defect therein, nor shall the city or any agent thereof be deemed to assume any such liability by reason of the inspection authorized herein or the certificate of inspection issued by the city electrical inspector. Sec. - 72. Permits required. (a) No person shall commence the erection, construction, alteration or change of any electrical installation, machinery, apparatus, work or wiring in the city until a permit has been issued by the city electrical inspector covering each install- atiop to be made. When a service of one hundred ten 010) amperes demand or more is required, a wiring diagram showing feeder details may be required by the city electrical inspector and approved by him, before a permit will be granted. (b) When any wiring or apparatus is installed in such a =Wanner that the same could be used for electric light or power purposes, it shall be deemed that the wiring or apparatus is used for such purposes and permit shall be required and inspection made as provided for such. (c) It shall be unlawful for the city electrical departmel# to do any wiring of any nature in or on any building, except power houses and substations of electric light, heat and power companies operating under a franchise granted by the city, for which a permit has not been issued, or to make any electrical connections to any building or electrical wiring or apparatus until a certificate of inspection or written statement authorizing connection has been issued by the city electrical inspector. All persons operating under a regular franchise granted by the city, shall upon written notice by the city electrical inspector, disconnect any circuit, main service wires, branch feeder wires, or distribution system, as designated by such notice; and shall not reconnect such installation except upon written per- rpission from the city electrical inspector. (d) No permit will be required for the installation of wires to operate telephone, telegraph or district messenger services. Sec. - 73. To whom permits shall be issued. The permit required by the provisions of this article shall be issued only to those persons who have secured a license under the provisions of this ordinance or to a person who is to perform the electrical work with his own hands in a home occupied by him. Sec. - 74. Permit fees. The following fees shall be paid to the city for the issuance of electrical Work permits: (a) Installation of services: (1) Up to 100 amps $ 2.00 (2) 101 to 200 amps 3.00 (3) 201 to 400 amps 5.00 (4) Over 400 amps 10.00 (b) Installation of outlets in dwelling units: Copper Aluminum (1) Receptacles $ .15 $ .30 (2) Switches .15 .30 (3) Light Fixtures ..15 .30 (4) Fixed Appliance .35 .70 (5) Resistant Duct Heater per 5 kw .50 .50 (c) Installation of outlets in commercial work: (1) Receptacles $ . 25 $ .50 (2) Switches .25 .50 (3) Light Fixtures .25 .50 (4) Fixed Appliances .35 .70 (5) Resistant Duct Heater per 5 kw .50 .50 (d) Motors: (1) 1/2 H. P. but less than 2 H. P. $ 1.00 (2) 2 H. P. but less than 5 H. P. 1.50 (3) 5 H. P. but less than 10 H. P. 2.00 (4) 10 H. P. but less than 20 H. P. 3.00 (5) 20 H. P. but less than 50 H. P. 4.00 (6) 50 H. P. and over 5.00 (e) Equipment: (1) Motion picture machine, each $ 5.00 (2) X-ray machine, each 4.00 (3) Welding machine, each 2.00 (4) Elevators, each 5.00 320 (f ) Signs: (1) Minimum fee $ 2.00 (2) More than 2 transformers per transformer .50 per ballast .50 (g) Reinspection fee. This fee is charged when work is rejected on the first inspection and each subsequent inspection 5.00 (h) Construction Power Service 2.50 (i) Vaporproof light on each pole, each 1.00 (j) Temporary installations. Carnivals or similar temporary installations for amusement, show, display, or similar uses shall be charged for at the rate of $10. 00 for the installation of 10 KVA or less, and all additional KVA shall be charged for at the rate of $. 50 per KVA. For the purpose of fees for this classification one horsepower of motor load shall be considered as one KVA. ti (k) Transformers, light and/or power or welding: (1) Up to and including 7 1/2 KVA, each 1.00 (2) Over 7 1/2 and including 25 KVA, each 2.00 (3) Over 25 and including 50 KVA, each 3.00 (4) Over 50 KVA, each 7.50 (1) New locations. Inspection fee for houses or buildings moved on lot, each (m) Unprescribed installations. For the inspection of installations and other electrical work for which no fee is prescribed or otherwise provided, the city electrical inspector shall assess a fee for the permit to be determined by the amount of time necessary for a proper inspection at the rate of $3. 00 per hour or fraction thereof. (n) Commercial check (o) Penalty. In case any work, for which a permit is required by this chapter, is started prior to obtain- ing said permit, the fee above specified shall be' doubled. The payment of such doubled fee ' shall: not relieve tiny person -from fully complying .with the requirements of this ordinance in the execution of work nor from other penalties prescribed herein. (p) Permit issuing fee Sec. - 75. Issuance, permit card. 3.00 3.00 9M The city electrical inspector, upon the issuance of a permit, shall issue to the permittee a permit card showing the permit number, the building or house number, and the name of the contractor. 1 *12 21 Sec. - 76. Display of permit card. No erection, construction, alteration, or change of any electrical install- ation, machinery, signs, apparatus, work or wiring shall be commenced until the permit holder or his agent shall have posted the electrical permit card in a conspicuous place. This permit card shall be maintained in such position by the permit holder until the final inspection is made by the city electrical inspector of such work. Sec, - 77. Construction Power Service, General. Construction Power Service shall be authorized for a period of time necessary for completion, final inspection and testing of the building or structures electrical system. This service is not to exceed six months for dwelling unit or one year for commercial or institutional occupancies. An extension may be granted by the city electrical inspector for up to three months on Dwelling Unit Construction Sites and six months on Commercial or Industrial sites. Construction power service can be ordered disconnected at any time by the City electrical inspector when the installa- tion is declared unsafe or construction work ceases for a period of one month. Re- connection of construction service thus ordered shall not be reconnected until approved by the city electrical inspector and a ten dollar ($10. 00) renewal fee is paid to the city utility department. 77 a.. Temporary Construction Po*er Poles. :V A temporary construction power pole shall be authorized to service not more �-' than two construction sites with a common side property line and under the control of the same general contractor provided: (1) The responsible contractor applies for service at the city utility office; furnishes the assigned address for the site (s) involved; designates which site the construction power meter shall be assigned; certifies that a temporary metered construction power pole meeting city standards has been erected on the site within sixty (60) feet of a city utility pole which is capable of providing the service; and, the sites) have been marked with an address -sign clearly visible from the street. (2) The temporary power pole is constructed of at least 4" x 4" wood and long enough to be a minimum of 8 ft. above grade after installed. Pole is to be set in the earth sufficiently deep and/or guyed to withstand lateral pressures of the service under normal weather and wind conditions and will provide 121 clear- ance over driveways and 18' clearance over public streets. (3) The temporary power pole shall be grounded and have a metered service of sufficient size to meet the construction needs. Receptacle outlets shall be protected by overcurrent devices compatable with the outlets and all 120 V single phase outlets protected for human safety, as required by Par 210-8(b) of NFPA-70-78. 77b. Permanent Construction Service. Permanent Construction service may be authorized for a building or structure under construction provided that: (a) The permanent service equipment has been installed and the Building is Dried -In. (b) The service disconnect and service grounding system has been completed. (c) All construction feeders and branch circuits to be activated are installed and properly safe -guarded from electrical shock. and overload. (d) A notice is posted on the main disconnect and all activated main and sub - panels indicating they are in-service and are not to be opened except by the respon- sible electrical contractor. (e) The system has been inspected and approved by the city electrical inspector. Permanent Construction service will be required on the building or structure prior to final inspection and certification by the city electrical inspector. Sec. - 78. Work not to be concealed until approved. It shall be unlawful for any person to seal or in any manner conceal any electrical wiring until such wiring has been approved. Sec. - 79. Final inspection required. A final inspection by the electrical inspector shall be called by the person performing electrical work for which a permit has been issued on completion of such work. The electrical contractor or the master electrician responsible may be required to be present at the construction site during the final inspection. Sec. - 80. Fuses, breaker to be installed for final inspection. The fuses in the main disconnect switch or the breaker shall be in place when the city electrical inspector makes the final inspection of the electrical work. Sec. - 81. Approval tag. After inspecting any electrical wiring►, the city electrical inspector shall leave notice in the form of a tag or label attached to the service entrance switch; which such notice shall clearly state whether the wiring is appr�• ' s to be kept open for correction. Sec. - 82. Defective workmanship. Any person engaged in the business of electrical construction or the installation of wiring or apparatus for electric light or power in the city•who shall fail to correct any defect or defects in any work done by him after having been notified of such defect or defects by the city electrical inspector and given a specified period of time within which to make such correction and fails or refuses within such time to correct such defect or defects in conformity with this ordinance or the orders of the city electrical inspector, shall not be issued any further permits until such defect or defects have been corrected. In any case in which any person shall continue to or persistently violate the provisions of this ordinance or the Qrders of :the city electrical inspector in relation to the same, the license of such person may be suspended or revoked upon recommendation by the board. Sec. , 83. Certificate of inspection. On the satisfactory completion of the work covered by a permit in accordance will all ordinances and laws, the city electrical inspector shall issue a certificate of inspection. In this certificate the city electrical inspector shall certify that the work is in accordance with the rules governing the respective class to which it belongs. Sec, - 84. Effect of nonconforming old work on issuance of certificate of inspection Where a permit is issued for an addition to old work, wherein the new work is satisfactorily completed but the old work to which it is connected does not conform to the rules laid down by this ordinance, the city electrical inspector shall issue a written statement to the effect that the new work complies with the rules, but that a certificate cannot be issued because the entire electrical system, of which the old work is a part, does not comply with the provisions of this ordinance. This statement shall constitute notice to the owner or other interested party that the entire installation does not comply with the provisions of this ordinance and shall itemize the violations of this chapter which prevents the issuance of a completion certificate. Sec. - 85. Refusal of certificate of inspection. The city electrical inspector is hereby given the authority to refuse to issue a certificate of inspection for any addition, or extension to any electric wiring in or on any building wherein the city electrical inspector determines that the wiring is in an unsafe condition. If for any reason, the work covered by a permit does not comply with the provisions of this ordinance, the city electrical inspector shall refuse to issue a certificate of inspection and no electric light and power company shall connect electrical current to the same. Sec. • 86. Routine inspection. It shall be the duty of the city electrical inspector to inspect all electrical wiring and apparatus in the city at any time in order to ascertain whether such electrical wiring or apparatus is in any respect dangerous to life or property; and, if any part of such electrical wiring or apparatus shall be found to be in defective or dangerous condition, the city electrical .inspector shall notify, in writing, the owner of such wiring or equipment to have the defect corrected within a reasonable time as specified by the city electrical inqpector. If the owner of such defective wiring or equipment shall refuse or failmply with the requirements of the city electrical inspector and correct the defect as directed within the specified time, he will be held to be in direct violation of this ordinance. Sec, - 87.: Disconnection of service upon vacation of building The .City electric department shall disconnect the electrical service to any building and/or premises, except private residences and/or apartment buildings used as residences, each time such building or premises has been vacated; and it shall not again supply electricity to such buildings or premises until authorized to do so by the electrical inspector. 324 The City electric department shall disconnect any private residence and/or apartment building when the electrical inspector notifies the City electric depart- ment prior to such time that such residence and/or apartment building has been vacated and said City electric department shall not again supply electricity to such residence and/or apartment building until authorized to do so by the electrical inspector. Secs. - 88-97. Reserved. ARTICLE IV. TECHNICAL PROVISIONS Sec. - 98. National Electrical Code adopted. In the installation, construction, erection, repair and maintenance of all electrical wiring and apparatus, the rules and the requirements of the National Electrical Code, 1978 edition, as published by the National Fire Protection Association and the National Electrical Safety Code as approved by the American Standards Association in force and effect at this time together with such require- ments and rules as are provided herein, shall be complied with and become a part of this Code. In the event of any conflict between the provisions of this ordinance and the National Electrical Code, the provisions of this ordinance shall prevail and govern. Sec. - 99. Services --Location. All service;: entrance wires into a building shall be located at -a point on the building specified by the city electrical department. Where practical, all service conduits small be extended through the outside building wall on a street or alley side at such point as will avoid open service wires being placed over roofs or through courts, light and ventilating shafts, and over adjoining property. Sec. - 100.. Same --Support. Where service wires enter a building through stucco, tiles, brick or other masonry walls, substantial support for the service wires must be provided, such support to consist of not less than one five-eighths (5/8) inch galvanized bolt and shall be installed by the contractor during the construction of the supporting wall and the location of same shall be designated by the city electrical inspector and/or the city electrical department. Where service wires enter a building through other type walls, substantial support for the service lateral must be provided, such support to consist of an approved one point terminal insulator of sufficient size to support the service lateral for the distance and size wire involved, bolted through a major structural member of the building or structure and installed prior to the electrical rough -in inspection by the contractor. Sec. - 101. Same --Entrance. All service entrance wires making overhead entrances into buildings shall be carried in metal conduit with weatherproof service head, and the conduit shall be brought fromthe entrance to the fuse switch or breaker. The service entrance to the service switch cabinet shall be as short as possible, but in no case greater than three (3) feet within the building without the special permission from the city electrical inspector. Length of outside service wire extension beyond service head shall not be less than two (2) feet. Secs. - 102-104. Reserved. Sec. - 105. Meters --Types. The city electrical department will determine the type of metering and its location. W 325 fir.itP;s VIt 4 gx;m Sec. - 106. Reserved. Sec. 107. Same -Installation. (a) The meter shall be installed outside the building unless special per- mission is granted by the city electrical inspector and the city electrical depart- ment. (b) Under no circumstances shall any meter be moved'br relocated, except by authorized employees of the city electrical department and special permission of the city electrical inspector. (c) The meter socket and meter potential socket shall be placed not less than five (5) feet nor more than six (6) feet above the finished ground level unless special permission is granted by the city electrical inspector, the measurement to be made adjacent to the building at the location of the meter sockets. The city electrical department willfurnish these sockets, but contractor shall set the same in place. Sec. - 108--112. Reserved. Sec. - 113. Circuit wire sizes, copper. (a) Wire of size not smaller than No. 12 B & S gauge shall be used for lighting distribution circuits from panels to outlets except as provided hereinafter. (b) In residential installations No. 14 gauge wire may be used for switch legs servipg not more than 600 watts. All utility outlets shall be minimum No. 12 gauge. (c) Control wiring may be No. 14 wire and must be fused but for not more than 15 amperes. Sec. - 114. Aluminum wiring. Aluminum wire and copper -clad aluminum of equivalent copper ampacities specified in this ordinance may be used with approved devices and terminals provided suitable oxidation inhibitors are used on all terminals in damp or unheated locations on wire sizes larger than No. 10 B & S gauge and all terminals and splices are made as specified in the UL listing for the device being used. Only aluminum wire bearing the new aluminum wire label will be used for wire sizes No. 10 and No. 12 B & S gauge. Sec. - 115. Installation of outlets, switches, receptacle boxes. All lighting outlets, switches and receptacles boxes shall be rigidly attached to the wood, steel or masonry framing of the building. Sec. - 116. Outlets -Residential. (a) For general wiring of dwellings restricted to residential use, including apartments, hotels and motels, not more than ten (10) outlets shall be permitted on any one (1) branch circuit. (b) Small appliance branch circuits are limited to the following receptacle.-- outlets eceptacle _outlets (no lights): Kitchen (refrigerator) circuit # 1 2 outlets Additional kitchen circuit(s) 4 outlets All other small appliance circuits - serving pantry, breakfast room, dining room and family room. 10 outlets Sec. - 117--122. Reserved. 3`6 Sec. - 123. Installation of cabinets. All main and branch cabinets shall be attached to wall or mountings panel with screws, studs or toggle bolts. Sec. - 124. Conflicting Ordinance repealed. All ordinances or parts of ordinances conflicting with any of the provisions of this ordinance are hereby repealed. Sec. - 125. Saving Clause. Nothing in this ordinance or the code hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby. Nor shall any right or remedy or any char- acter be lost, impaired, or affected by this ordinance. Sec. - 126. Validity. The invalidity of any section or provision of this ordinance or of the code hereby adopted shall not invalidate otherusections or provisions thereof. Sacs. - 127--129. orved.
