ORDINANCE NO. 78-7
ORDINANCE AMENDING AN ORDINANCE PROVIDING FOR GROSS RECEIPT
CHARGE OF TWO PER CENT BY AMENDING SECTION 2 IMPOSING CHARGE
OF TWO PER CENT OF GROSS RECEIPTS ON PERSONS UTILIZING TELEGRAPH,
TELEPHONE, ELECTRIC TRANSMISSION POLES AND OTHER FISTURES AND PER-
SONS AND CORPORATIONS, UTILIZING STREET, HIGHWAYS, EASEMENTS,
ALLEYS, PARKS OR OTHER PLACES WITHIN AREAS SERVED BY CITY OF GEORGETOWN
UTILITIES: AND BY AMENDING SAID ORDINANCE BY AMENDING SECTION 4
THEREOF PROVIDING THAT SUCH PERSONS UTILIZING SUCH FIXTURES AND SUCH
STREETS, HIGHWAYS, EASEMENTS, ALLEYS, PARKS OR OTHER PUBLIC PLACES
WITHIN SUCH AREA SHALL FILE WITH THE CITY SECRETARY A SWORN REPORT
ON OR BEFORE THE TWELFTH DAY OF JULY OF EACH YEAR FOLLOWING THE
ENACTMENT OF THIS AMENDMENT
BE IT ORDAINED by the City Council of the City of Georgetown, Texas as follows:
Paragraph 2 of the Gross Receipts Charge Ordinance enacted by the City of Georgetown
on July 8, 1975 is hereby rescinded and in lieu thereof it is further ordained by the City Council
of the City of Georgetown that Section 2 shall hereafter read as follows:

Cr' On the first day of August of each and every year, every person using or maintaining any
�= telegraph, telephone, electric light or other pole, gas and water pipelines, pipes, or any
other fixtures in any of the streets, highways, easements, alleys, parks or other placed in areas
served by City of Georgetown utilities including areas within the corporate limits of the
City of Georgetown, hereinafter referred to as "City", or that utilize any streets, highways,
easements, alleys, parks or other public places within such areas served by City of Georgetown
utilities, including the area within the corporate limits of the City, for the purpose of con-
ducting a business engaged in garbage disposal, whether under a franchise or without a
franchise from the City, shall, as a condition to such further occupancy or use, pay to the
City of Georgetown annually for such privilege, a rental equal to 2% of the gross receipts received
by such person from its business conducted within such area for the preceding year."
. BE IT FURTHER ORDAINED that Section 4 of said Gross Receipts Ordinance is
hereby repealed and rescinded and in lieu thereof it is herby ordained by the City Council
of the City of Georgetown, Texas, as follows:

Every person using or maintaining any telegraph, telephone, electric light or other pole,
gas and water pipelines, pipes, or 'any other fixtures in any of the streets, highways, ease-
ments, alleys, parks, or other public places in the area served with City of Georgetown utilities
including the area within the corporate limits of the City or that utilize any streets, highways,
easements, alleys, parks or other public places within such area for the prupose of conducting
a business engaged in garbage disposal shall, on the 12th day of July of each year, Tile with
the City Secretary a sworn report showing the gross receipts from the buiness conducted by
such person within the corporate limits of the City for the preceding year, ending the 13th
day of June."
"Those portions of said Ordinance not mentioned nor affected by this Amendment shall
remain in full force and effect.
If any paragraph, clause, phrase or other part of this Amendment should for any reason
be held invalid, such invalidity shall not affect the remaining provisions of this amendment
and to this end the various provisions of this Amendment are hereby declared to be severable.
PASSED AND APPROVED on the first reading this 13th day of December, 1977.
PASSED AND APPROVED on second reading this 10th day of January, 1978.
