HomeMy WebLinkAboutORD 75-17 - Mechanical Systems-�5,17 AN ORDINANCE TO BE .ENTITLED: AN ORDINANCE REGULATING THE INSTALLATION OF MECHANICAL SYSTEMS, INCLUDING ALTERATIONS, REPAIRS, REPLACEMENT, EQUIPMENT,' APPLIANCES, FIXTURES,, FITTINGS AND/ OR APPURTENANCES THERETO, INCLUDING VENTILATING;, HEATING, COOL- ING, AIR CONDITIONING AND REFRIGERATION SYSTEMS, INCINERATORS, AND OTHER ENERGY-RELATED SYSTEMS IN THE CITY OF GEORGETOWN, TEXAS: TO PROVIDE FOR THE ISSUANCE OF' PERMITS' AND COLLECTION OF FEES THEREOF: PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AS FOLLOWS: Section 1. The Stand Mechanical Code, 1973 Edition, together with the 1975 Amendments thereto, three (3) copies of which are on file in the Office of the Clerk, is hereby adopted by reference, and incorporated as if set fully herein. Section 2. If any section, subsection, sentence, clause, 'provision, or part of this ordinance, shall be held invalid for any reason, the remainder of this ordinance shall not be affected thereby but shall remain in full force and effect. Section 3. Any ordinances'or parts of ordinances in conflict with the provisions contained herein are hereby repealed. Section 4. This ordinance shall become effective from and after its passage. Introduced and Passed by the City Council of the City of Georgetown, Texas on first reading the 11th day of August, '1975 and passed on Second and Final reading this 8th day of September, 1975. GEORGETOWN: PROVIDING FOR THE INSPECTION OF SAID PIPING AND CERTAIN APPLI- ANCES: PROVIDING FOR THE ISSUANCE OF PERMITS FOR THE INSTALLATION OF SAID PIPING AND CERTAIN APPLIANCES AND THE COLLECTION OF INSPECTION FEES THEREFOR: PROVIDING FOR THE LICENSING OF PERSONS ENGAGING IN THE. BUSINESS OF INSTALLING, REPAIRINC3 OR MAINTAIN- ING SAIDPIP[NG OR CERTAIN APPLIANCES: PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE, AND REPEALING ALL CONFLICTING ORDINANCES. AN ORDINANCE TO PROVIDE FOR THE ADOPTION BY REFERENCE OF THE NATIONAL ELECTRIC CODE STANDARD OF THE NATIONAL BOARD OF FIRE C� UNDERWRITERS FOR ELECTRIC WIRING AND APPARATUS FOR THE CITY OF L GEORGETOWN, TEXAS, FOR CREATING THE OFFICE OF ELECTRICAL INSPECTORS, FOR LICENSING OF ELECTRICIANS AND FOR OTHER PURPOSES, AND REGULATING THE INSTALLATION OF ELECTRIC WIRING AND OTHER PURPOSES, AND DECLAR- ING AN EMERGENCY. Be it ordained by the City Council of the City of Georgetown, Texas. Section 1. Adq flons of Electric Code. That there is hereby adopted by the City of Georgetown, Texas for the purpose of establishing rules and regulations of the construction, alteration, removal and maintenance of electric wiring and apparatus, including permits and penalties, that certain electric code known as the National Electrical Code of the National Fire Protection Assocation, being particularly the 1975 edition thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified, or amended, of which not less than three (3) copies have been and now are filediin the office of the City Clerk of the City of Georgetown, Texas, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinace shall take effect, the provisions thereof shall be controlling in the construction, alteration, maintenance or removal of all electric wiring and apparatus within the corporate limits of the City of Georgetown, Texas.. Section 2.. INSPECTOR. ,_There is hereby created the office of Electrical Inspector who shall be appointed y tF- Mayor; .subject to the confirmation of the City Council. The Electrical Inspector shall have had at least two (2) years experience as an electrician, shall be of good moral character, shall be versed in the approved methods of electrical construction for safety of life and property and the National Electrical Code. He shall receive such compensation as the Council may decide. Section 3.. DUTIES. The Electrical Inspector shall have the duty and is hereby authorized, empowered, and directed to regulate and determine the placing of electric wires or other appliances for electric lights, heat or power in the City of Georgetown, 'Texas, and to cause all such wires, appliances or apparatus to be placed, constructed, and guarded as not to cause fires or accidents, endangering life or property, and to be constructed as to keep to a minimum the loss or waste of electric current.-' It shall be the duty of the City Electrical Inspector to enforce all provisions of this ordinance and he is hereby granted the authority to enter all buildings in the City of George- town, Texas, in the performance of his duties between the hours of eight a.m. and five p.m. daily, except that in emergency and within the limits of reason, the Electrical Inspector may enter buildings for such purposes at other than the designated hours. to It shall be the duty of the City Electrical Inspector to inspect and/or test all electrical work and equipment or apparatus for compliance with the Code whenever electric wiring, appliances, or apparatus shall be defective or hazardous through irrproper manufacture of improper or insufficient insulation or for any other reason, he shall at once,- cause the removal of such defect or defects, at the expense of the owners of such wiring, appliance or apparatus. Section 4. PERMITS. No installation, alteration, or removal shall be made in/or of the wiring of any ui ding or structure for light, heat or power or to increase the load of energy carried by such wires or equipment, nor shall any building'or structure be wired for electric lights, appliances, motors, apparatus, or heating devices nor alterations made thereto without a written permit therefore being first obtained from the City license issuing clerk by the person, firm, or corporation having direct charge of such installation. Section 5. INSPECTION. Upon the completion of the wiring, installation or alter- ation of any building or structure for light, heat, power, applionce, armpparatus, it shall be the duty of the person, firm, or corporation having direct charge of such to notify -the City Electrical Inspector who shall, as early as possible, inspect such wiring, installation, appliance, and apparatus and is installed, altered and constructed in compliance with the permit and in accordance with the requirements of this ordinance, he shall execute a certificate of satisfactory inspection, which shall contain the date of such inspection and the result of his examination, but no such certificate shall be issued unless such electric wiring, motors, heating devices, appliances, and apparatus be in strict accord with the rules and requirements and the spirit of this ordinance, nor shall current be turned on such installation, equipment, appliance, motors, heating device, and apparatus until said cert ificate be issued. The amount of fee or charge to be made for such inspections and certif- icate to be fixed and determined by the City Council. . Section 6. STANDARDS. All electrical construction, all materials, appliances, motors, heating devices, and apparatus used in connection with electrical work and the operation of all electrical apparatus within the City of Georgetown shall conform to the rules and requirements of the National Electrical Code current when work is performed or equipment and apparatus installed, however, the necessity, good service and said results often require larger sizes of wire, more branch circuits, and better types of equipment than the minimum which is specified in the National Electrical Code. Therefore, the City Electrical Inspector supervising the enforcement of this code will have the responsibility and authority for making interpretations of the rules, for deciding upon the approval of equip- ment, materials, construction and for granting the special permission contemplated in a number of the rules and the City Electrical Inspector, where necessary, shall follow the code precedure for securing official interpretations of the code. Section 7. LICENSING OF ELECTRICIANS. Any persons, firm, or corporation desiring to engage in the business of electrical construction or of the installation of wiring and apparatus for electric lights, ,appliances, heating or power in the City of Georgetown, shall, before doing so, obtain a Master Electrician License, the fee for which will be $50.00per year which shall be paid into the City Treasury before such Master Electrican License shall become effective. Section 8. BOND REQUIRED. Every person, firm or corporation doing electrical business in the City of Georgetown shall execute and deliver to the City a bond with a surety bonding company in the sum of $1,000.00, to indemnify the city of any citizen for any damage caused by the failure of such person, firm, or corporation doing the electrical work to comply strictly with the provisions of this ordinance. Section 9. QUALIFICATION. No Master or .Journeyman Electrician License shall be issued until the party applying for same has given satisfactory, evidence to the City Elec- trical Inspector of his or their experience and ability to do said electrical work in a safe and satisfactory manner. No permit for installation -or alteration of any wiring, heating devices, motors, appliances and apparatus shall be issued until the license and bond herein required have been obtained. Section 10. FAILURE TO COMPLY. Any person, firm or corporation who shall fail to correct any defect or defects in is or their work or to meet the required standards after having been given notice of the unfit condition by the City Electrical Inspector, within a reasonable time, shall be refused any other permit until such defect or defects have been corrected and shall be subject to revocation of license for continual defective work or either upon conviction for violation of the provision of this ordinance. Section 11 Upon failure to comply with this ordinance the City Electrical Inspector shall have authority after due notice to cut out electric current in the locality concerned Section 12 PENALTIES Any person firm or corporation found guilty of violating any of the provisions of this ordinance shall be subject to a fine of not less than ten ($10 00) dollars nor more than one hundred ($100 00) dollars together with the costs of such prosecution or by imprisonment Each day during which violation con tinues shall be a separate offense Section 13 LICENSE TO INDIVIDUAL Any individual desiring to perform his own electrical work personally shall not be required to make the required bond or to obtain the requred license but shall be required to obtain the regular permit for that particular job Such work done by an individual must be done by him personally on his own particular job and not be a way of performing a service to the public generally Section 14 CONFLICTING ORDINANCE REPEALED All ordinances or parts of ordin ances conflicting with any of the provisions of this ordinance are hereby repealed Section 15 SAVING CLAUSE Nothing in this ordinance or the code hereby adopted shall be construed to affect any suit or proceeding now pending in any court or any rights acquired or liability incurred nor anycause or acuses of action accrued or existing under any act or ordinance repealed hereby Nor shall any right or remedy or any character to lost impaired or affected by this ordinance Section 16 VALIDITY The invalidity of any section or provision of this ordinance or of the code hereby adopted shall not invalidate other sections or provisionsthereof Section 17 EMERGENCY CLAUSE It is found as a matter of fact that an emergency exists and that it is necessary forte immedate preservation of public health safety and welfare of the inhabitants of the City of Georgetown that this electric code be in full force and effect from and after its passage and publication as required in the State Statutes DATE PASSED September 8 1975 ATTEST oe E Crawford Mayor Z�� ��� ` City Secretary A RESOLUTION RESCINDING CURRENT BUILDING PERMIT AND ELECTRICAL PERMIT FEES AND ESTABLISHING NEW FEE RATES WHEREAS the City of Georgetown Texas has adopted by ordinance the Standard Building Code and the National Electrical Code and WHEREAS the Standard Building Code and National Electrical Code do not establish Permit Fee rates and WHEREAS each code requires issuance of permits inspection of work at various stages of completion and maintenance of inspection records and WHEREAS the currently established Building and Electrical Permit Fee rates are insufficient to meet inspection and administration costs BE IT RESOLVED that the rates reflected on Exhibit A shall be in full force and effect following the passage of this Resolution Said Exhibit A is hereby incorporated into this resolution to the same and full extent as if copied herein at length word for word All resol utions in conflict herewith are hereby repealed and rescinded PASSED on this the 8th day of September 1975 ATTEST City Secretary 12 EXHIBIT A SCHEDULE OF BUILDING PERMIT FEES (a) TOTAL VALUATION SCHEDULE $100 00 or less No fee unless inspection required in which case a $2 50 fee for each inspection shall be charged $101 00 to $1 000 00 $3 00 per thousand or fraction thereof $1 001 00 to $15 000 00 $3 00 for the first $1 000 00 plus $1 75 for each additional thousand or fraction thereof to and including $15 000 00 $15 001 00 to $50 000 00 $27 50 for the first $15 000 00 plus $1 25 for each additional thousand or fraction thereof to and including $50 000 00 $50 001 00 to $100 000 00 $71 25 for the first $50 000 00 plus $0 75 for each additional thousand or fraction thereof to and including $100 000 00 $100 001 00 to $500 000 00 $108 75 for the first $100 000 00 plus $0 50 for each additional thousand or fraction thereof to and including $500 000 00 $500 001 00 to $1 000 000 00 $308 75 for the first $500 000 00 plus $0 40 for each additional thousand or fraction thereof $1 000 001 00 and up $508 75 for the first $1 000 000 00 plus $0 30 for each additional thousand or fraction thereof (b) Moving of Building or Structure Building under 15 feet in height -T25 00 Building over 15 feet in height -
