HomeMy WebLinkAboutOrdinance 01.01.1999ORDINANCE AN ORDINANCE AMENDING THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF -GEORGETOWN, TEXAS, ON THE 12TH DAY OF FEBRUARY, 1968, AMENDING A PART OF THE MAP OF THE ORIGINAL ORDINANCE: TO CHANGE THE PROPERTY OF NEWBERG-PESCHEL PARTNERSHIP ACCORDING_TO THE MAP THEREOF FROM RS RESIDENTIAL SINGLE TO C -2A COMMERCIAL, AS HEREINAFTER SET FORTH: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN,_ TEXAS: WHEREAS, an application has been made to the City Council for the purpose of changing the zoning ordinance on the folowing described real estate: Being all of that certain tract or parcel of land lying and being situated in the City of Georgetown in Williamson County, Texas, and being Lots 1, 2 and 3, Block 3, COUNTRY CLUB ESTATES, commonly known as 1208 Williams Drive, and being that certain property conveyed to Newberg-Peschel Partnership by deed dated February 4, 1982,.and�recorded in Cabinet A. Slide 119, Plat Records of Williamson County, Texas. AND WHEREAS, the City Planning Commission has approved the - changing of said Zoning Ordinance -on the above described property from RS Residential Single Family to C -2A Commercial, which said meeting was held on the 23rd day.of March, 1982; and WHEREAS, written notice was given to all of the owners of lots within 200 feet of the above described property as required by law; and WHEREAS, the City Planning Commission approved the change aforesaid in the Zoning Ordinance, said approval being given by said Commission on March 23, 1982; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Georgetown, that.the Zoning Ordinance, and the Zoning Map of the City of Georgetown, be amended so that the property described above shall be and the same is hereby removed from "RS Residential Single Family" to "C -2A Commercial." Read, passed and approved this 13th day of April , 1982, on the first reading. I 4 7 t PROTECTIVE PROVISIONS AND COVENANTS INCORPORATED IN DEEDS CONVEYING LAND IN COMMERCE INDUSTRIAL PARK WILLIAMSOM COUNTY, TEXAS 1. The property herein conveyed shall be used only for profes- sional, industrial, manufacturing, warehousing or distribu- tion purposes. No land shall be used and no building or structures shall be erected or constructed or used for any purpose other than those Eermitted under City of Georgetown Texas industrial zoning. 2. Grantee shall not use or allow the use of its property for any business or purpose which produces objectionable smoke, dust, noise, odor, vibration, or for other purpose constitut- ing a nuisance, or use or allow the use of its property at any time for manufacture, storage or distribution of any pro- ducts of items which shall increase the fire hazard to or insurance rates of adjoining property. Grantee shall not use its property for any purpose in violation of the laws of the United States, State of Texas or Williamson County, Texas. 3. Buildings or structures erected within Commerce Industrial Park shall not be closer than fifty (50) feet to the right of way line of any street, nor closer than fifteen (15) feet to any side property line, except that a one story office build- ing may be up to twenty-five (25) feet from the street line. The setback line of buildings where truck doors of docks front on a street shall be a minimum of sixty (60) feet. 4. Architectural plans and specifications covering buildings, structures, loading docks, parking facilities and landscaping way line of any street. 9. Grantee shall not use or allow to be used any portion of its property for erection of billboards or other advertising signs -2- 4 for initial work and for any exterior alterations, modifica- tions and additional construction must be submitted by Grantee to Georgetown Industrial Corporation and have written approval therefor prior to commencement of work. S. All construction shall conform to the building codes of the City of Georgetown in effect at the time of such construction. 6. Buildings erected within Commerce Industrial Park shall be of masonry construction, masonry faced, pre-engineered color coated metal construction, a combination of these or their equivalent. 7. Public streets in Commerce Industrial Park shall be not used for parking. Adequate parking space shall be provided by tYti ` Grantee for employees, visitors, customers and tenants. All 1 driveways and parking areas shall be paved with concrete, 1 asphalt or other equivalent material. Trucks, tractors, trailers, or any combination thereof, may not while either being loaded, unloaded or parked, occupy the right of way of any public street. Parking areas shall be a minimum of ten (10) feet from the right of way line of any street. 8. If goods, equipment, supplies or other materials stored in the open shall be deemed unattractive by Georgetown Industrial Corporation, such open storage must be fenced with an attrac- tive screening fence at least six (6) feet in height. Fences shall be erected no closer than ten (10) feet to the right of way line of any street. 9. Grantee shall not use or allow to be used any portion of its property for erection of billboards or other advertising signs -2- 4 other than those directly connected with its own operations thereon. Written approval of Georgetown Industrial Corpora- tion is required prior to the erection of any sign not attached to a building. 10. Grantee shall diligently prosecute any construction work to the end that the structure shall not remain in a partly fin- ished condition any longer than reasonably necessary for com- pletion thereof. Grantee shall keep its property, buildings and improvements in a safe, clean, presentable condition at all times and shall comply in all respects with all govern- mental overnmental requirements. 11. Street frontings of every site on which a building is built shall be landscaped to a reasonable extent of trees, shrubs, lawns or other sightly ground covering and maintained there- after in a sightly condition. The unused portion of the site shall be kept reasonably mowed and maintained in a sightly condition. 12. Georgetown Industrial Corporation reserves the right to make such exceptions to or modifications of these provisions and covenants as special conditions or unusual circumstances may warrant; provided, however, that such exceptions or modifica- tions shall not invalidate these provisions and covenants in principle or general objective. 13. These protective provisions and covenants run with the land and shall be binding upon the Grantee, its successors and assigns, and shall be in full force and effect until January 1, 1999. -3- ,5
