HomeMy WebLinkAboutORD 84-27.00B - Amend to Subdivision OrdORDINANCE 84-27. 0,j 6 AMENDMENT TO SUBDIVISION ORDINANCE AN ORDINANCE AMENDING AN ORDINANCE PRESCRIBING RULES AND REGULATIONS GOVERNING PLATS, PLANS AND SUBDIVISIONS OF LAND WITHIN THE INCORPORATED AREA OF GOERGETOWN, TEXAS WHEREAS, the City of Georgetown incacted a Subdivision Ordinance on May 10, 1977; and, IMEREAS, it is the intent of the City Councl of Georgetown, Texas, to amend said Subdivision Ordinance, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Georgetown, Texas, that: I. SECTION 4 captioned "PROCEDURE", 4.01 "CONCEPT PLAN_" is hereby amended by adding thereto Subsection 12 as follows: "Adjacent land owners shall be notified by mail, as directed by the Department of Planning, postmarked at least fifteen (15) days prior to the Planning and Zoning Commission meeting at which said Concept Plan is to be reviewed. Additionally, a public notice shall be published at least once in a newspaper of general circulation not less than fifteen (15) days nor more than 30 days prior to said public hearing." II. SECTION 4 captioned "PROCEDURE", 4.03 "PRELIMINARY PLAT", subsection 1 is hereby amended to read as follows: "A preliminary plat of any proposed subdivision, prepared by a registered engineer or registered public surveyor and bearing his seal, shall be submitted to the Planning Commission and City Council, for approval before the subdivider proceeds with the final plat for record together with a completed applica- tion form and a filing fee as determined by the current rate schedule. The plat shall be filed with the Office of the Director of Planning. Adjacent land owners shall be notified in the manner prescribed by Section 4.01.12, "CONCEPT PLAN" unless the persons to receive such notice have been previously notified of such concept pian and such plan has not been materially changed. Should any portion or section of this Ordinance be held invalid such holding shall not affect the validity of the remaining portions or sections and the City Council hereby declares that it would have passed such remaining portions or sec- tions despite such invalidity.
