HomeMy WebLinkAboutORD 05.13.1980 - Height Zoning RestrictionsCD (D � (.9 <( <C -., .... , ·-:�. •. � O _ n �N ORDINANCE AMENDING THE CITY OF GEORGE­TOWN SUBDIVISION ORDINANCE OF MAY 10, 1977TO CORRECT OMISSIONS AND AMBIGUITIES WHICHHINDER ENFORCEMENT OF THE PURPOSE AND IN­TENT OF THE ORDINANCE AND TO ESTABLISH A REQUIREMENT FOR DEVELOPERS TO INDICATE ON SUBDIVISION PLATS HEIGHT ZONING RESTRICT­IONS AND RUNWAY CENTER LINE EXTENSIONS WITH­IN 2 MILES OF THE GEORGETOWN MUNICIPAL AIR­PORT AND TO ESTABLISH SUBDIVISION DRAINAGE CRITERIA AND STREET RIGHT-OF-WAY DRIVEWAY CONSTRUCTION.PERMIT PROCEDURES. WHEREAS, the City of Georgetown did�ubdivision and resubdivision of land for within the City limits and the ETJ on May ' ' enact an l qrdJ�ance regulating"the purpose of development 10th, 1977; and I, WHEREAS,; experience under the subdivision orc;i i nance s i nee enactmenthas revealed iertain amiss.ions and ambiguities whi6h hinder enforcement pf the purpose and intent of the ordinance; and I .·WHEREAS; the City staff and planning and �onjng commission have formulated recommended amendments which if enacied!will clarify the pur­pose and intent of the ordinance, therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN: i' Part 1. The following Sections of the Subdivision Qrdin?nce are am�ndedas indicated by underlines: Section 3 -PURPOSE,· AUTHORITY AND JURISDICTION ' ' 3.02 As used herein, the term 1 1 subdivision 11 shall mean thedivision of a tract or parcel of land into two (2) ormrre lots or building areas for the purpose, whether immediate or future, of sale or building development, and shall include resubdivision. 1 1 Resubdivision1 1 shall mean any change in the division of any existing sub­division or any change in lot or building area size therein, or the relocation of any street lines. 3.03. Any owner of land located inside of or within one (1) mile of the corporate l_imits of the City of Geor9�towrwishing to subdivide such land shall submit to the. Planning and Zoning Commission a plan of subdivision which shall conform to the minimum requirements set forth in t�ese regulations. An owner subdividing his land into parcels of not less than 5 acres each for non commercial use and not involving new street orcityutilities shall be exempt from their requirements. Anyowner.subdividing his land into parcels of 1 acre or more for residential or commercial purposes shall b� subject to all regulations set forth in this ordinanceexcept as set forth in SECTION 5, PARAGRAPH 5.09. 3.04 No subdivision plat or plan shall be filed or recorded, and no lot or tarcel of land in a •subdivision inside or within onel) mile of the corporate limits of George­town shall be improved or sold, until the final plJL 3.05 or plan for commercial development shall have approved by the Planning and Zoning Commission. The City of G�orgetown will not furnish any City services,temporary or permanent,:or issue any plumbing, electrical or building permit� until all subdivisio� �tllity, street and drainage construction has been completed and accepted by the City of Georgetown. (No Exceptions) 33 I,; 34 Part 2. The following Sections of the Subdivision Ordinance are amended by /adding additional paragra'phs as indicated: .i Section 4 - PROCEDURE 4.01 7. e •. Letter of certification obtained;from the City Manager as to whether or not:the proposed development is in an area subject to height zoning restrictions imposed by the-Georgetown-Williamsori County�Joint Airport Ordinan�es. f.If proposed development falls irilthe area subject to Jheight zoning restri�tions, developer will give �ritten , . assurances that height zoning restrictions will be in-cluded in subdivision restrictiv� covenants and willgrant and indicate on the final plat avigation ease.mentsover all platted areas with a he�ght·zoning restrictionof ·Jess than 150 feet. No lot or building area will bepermitted within a runway approa�h clear zone. 4.02 4. c. For Agigation Easements. All Final Plats which have sites restriction imposed by the Georgetown-WillJamson County Joint Airport Ordinance of less than 150 feet wi 11 clearly indicate these rest_rictions as '!avigation easements 11 in a manner acceptable to the Planning.and Zoning. Commission. Fi"nal Plats �ill also indica;te the· extended ·centerline of the airp�rt·runway if the Plat is within two miles of the end of t•he runway. 1 , I • /_ Section 5 GENERAL REQUIREMENTS AND DESIGN STANDARDS 5.01 Part 3. 20. 21. STREETS • I I 1. Unpaved Street Right-Of-Ways. The portion of the ·_,street right-of-way between a private lot 1 int\ and the ,curb or pavement edge shall �e designed and constructed to meet Engineering and Construction Standards established by this ordinance or otherwise established by the City of �eorge­town. Access to Public Streets From Private Property. Developers or builders will not cut a curb or gutter section nor pave a street right-of-way without first obtaining� permit from the City Building Inspection Department, and comply with the City of Georgetown Street and Curb Cut 0-dinance. Where no curb and gutter street construction is permitted no developer or builder will construct or pave the bar· ditch street section without first obtaining a permit from th� City Building Inspection Department and comply·; with the City Street and Curb Cut Ordinance: No temporary utility service will be provided to the building lot or site until a curb cut-street right-of-way per�it has been issued and no permanent utility se�vice will be provided until the work authorized by permit is satisfactorily completed and approved by the Building Inspection Department. The Engineer and Construction Standards established i� the Sub­division Ordinance is amended by changing the ''DRAINAGE AND STORM SEWERS'' to read as fol lows: Drainage and Storm Sewers Adequate drainage shall be provided within the �imits of the subdivisions. The protection of adjoining property· ']"· J . • I·. • ··-- I] from any.increase in runoff is mandatory and sha 11 be considered in the review of the drainage and st,orm ·sewer plans. Drainage and storm sewer plans sh�ll b� certified by a Professional �ngineer and checked by the City.Engineer.
