including a severability clause; and establishing an effective date.
Whereas, an application has been made to the City for the purpose of amending the
Official Zoning Map, adopted on the 12thday of June, 2012, for the specific Zoning District
classification of the following described real property ("'fhe Prope
33.77 acres of the Joseph Fish and David Wright Survey(s), as recorded in Docum
Number 2013093967 of the Official Public Records of Williamson County, Texa
hereinafter referred to as "The Property"; and I
Whereas, the City Council has submitted the proposed amendment to the Official
Zoning Map to the Planning and Zoning Commission for its consideration at a public hearing
and for its recommendation or report; and
Whereas, public notice of such hearing was accomplished in accordance with State Law
and the City's Unified Development Code through newspaper publication, signs posted on the
Property, and mailed notice to nearby property owners; and
Whereas, the Planning and Zoning Commission, at a meeting on May 19, 2015, held the
required public hearing and submitted a recommendation of approval to the City Council for
the requested rezoning of the Property; and
Whereas, the City Council, at a meeting on June 9, 2015, held an additional public
hearing prior to taking action on the requested rezoning of the Property.

Section 1. The facts and recitations contained in the preamble of this Ordinance are
hereb found and declared to be true and correct, and are incorvorated bv reference herein and
any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified
Development Code.

Section 2. The Official Zoning Map, as well as the Zoning District classification(s) for th%
Property is hereby amended from the Local Commercial District (C-1), High Density
Multifamily District (MF -2), and Office District (OF), to a Planned Unit Development with base
zoning district of Low Density Multi -Family (MF -1) district, in accordance with the attached
Exhibit A (Location Map), Exhibit B (Legal Description), and Exhibit C (Development Plan) and
incorporated herein by reference.
Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
Section 4. If any provision of this Ordinance or application thereof to any person or
circumstance shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this Ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this Ordinance are hereby declared to be
severable.
Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary
to attest. This ordinance shall become effective in accordance with the provisions of state law
and the City Charter of the City of Georgetown.

The Gardens at Verde Vista Planned Unit Development District is located at 410 Shell
Road, Georgetown, TX 78633 and encompasses approximately 33.77 acres, described as
a 33.77 acre tract of land situated in the Joseph Fish Survey Abstract No. 232 and the
David Wright Survey Abstract No, 13 in Williamson County, TX recorded in Document No.
2013093967, Official Public Records of Williamson County, herein defined as the
"property". Survey and field notes attached as Exhibit A.
The primary use of the Property shall be for multi -family, detached dwelling units and a
community center that exclusively serves the residents of those dwelling units.
This PUD serves to augment and/or modify the standards for development outlined in th
City's Unified Development Code (UDC) in order to implement the vision for the property

and ensure a cohesive, quality development not otherwise anticipated by the underlying
base zoning district. In accordance with UDC Section 4.06,010.0 "Development Plan

In accordance with UDC Section 4.06.01 O.A "Compatibility with Base Zoning District", all
family (MF -I). Except for those requirements specifically deviated by this Development
Plan, all development standards established in the most current version of the UDC at
time of development shall be applicable, including amendments or ordinances adopted
after the date of this PUD. In the case that this Development Plan does not address a
specific item, the City of Georgetown UDC and any other applicable Ordinances shall
apply. In the event of a conflict between the regulations of this PUD and the regulations of
the base zoning district, the PUD shall control.

intended to serve as a final document. As such, the proposed building and parking
configurations are subject to refinement at time of Site Plan review. The Conceptual Lan
Plan depicts a series of buildings, parking, outdoor areas, and landscaping that may be
developed in phases, provided the minimum requirements of the PUD district are met.
Approval of this PUD, Development Plan, and Conceptual Land Plan does not constitute
approval of a Site Plan per Section 3.09 of the UDC.

1. Primary Use. The primary use of the Property shall be for multi -family, detached

6. Masonry. The building exteriors will be 90% masonry
7. Exterior Lighting. Exterior Lighting on the Property and its buildings will comply with
the requirements set forth in the UDC.
Drive aisles and access points shall be in conformance with the UDC. A 7.5 -foot R.O.W.
reservation along Shell Road shall be provided. The required sidewalk to be installed per
the UDC can be located within this reservation.
Landscaping on the Property shall be in conformance with Chapter 8 of the UDC.
Features above requirements include (Examples provided in Exhibits C & D):
A stone wall at the front of the Property along Shell Road with a well-defined, highly
landscaped community character entry and monument sign
An aesthetic, low maintenance Fencecrete wall along both side property lines of adjacent
residential neighborhoods
Signage on the Property shall be in conformance with Chapter 10 of the UDC unless
otherwise stated in a Master Sign Plan for the Property.

1. Parkland. The parkland dedication requirements of UDC Section 13.05 Will be met
with fee -in lieu of dedication, as provided for in Section 13.0 5.01 O.D, at time of Site
Plan approval.
2. Common Amenity Area. The Common Amenity Area on the property shall be in
conformance with the UDC. Three Common Area Recreation amenities are required,
and we will provide 5 (with details to be included at Site Plan submittal). One Common
Area Recreation amenity will be a trail system with 6 foot pathways covered by
decomposed granite (Example provided in Exhibit D).
In conformance with Section 4.06.010.D.3 of the UDC, modifications to this Development
Plan shall require City Council approval of an amendment to this PUD processed pursuanl
to Section 3.06 of the UDC, except, where the Director of Plannini•-

deodifications to be minor, the Director may authorize such modifications. Minor
modifications may include changes to building sizes, uses, or locations providing those
modifications conform to the general intent of this PUD, uses authorized by this PUD, or to
applicable provisions of the UDC and any other applicable regulations.
