Whereas, an application has been made to the City for the purpose of amending the Official Zoning Map, adopted on the 12thday of June, 2012, for the specific Zoning District classification of the following described real property ("'fhe Prope 33.77 acres of the Joseph Fish and David Wright Survey(s), as recorded in Docum Number 2013093967 of the Official Public Records of Williamson County, Texa hereinafter referred to as "The Property"; and I Whereas, the City Council has submitted the proposed amendment to the Official Zoning Map to the Planning and Zoning Commission for its consideration at a public hearing and for its recommendation or report; and Whereas, public notice of such hearing was accomplished in accordance with State Law and the City's Unified Development Code through newspaper publication, signs posted on the Property, and mailed notice to nearby property owners; and Whereas, the Planning and Zoning Commission, at a meeting on May 19, 2015, held the required public hearing and submitted a recommendation of approval to the City Council for the requested rezoning of the Property; and Whereas, the City Council, at a meeting on June 9, 2015, held an additional public hearing prior to taking action on the requested rezoning of the Property. The Official Zoning Map, as well as the Zoning District classification(s) for th% Property is hereby amended from the Local Commercial District (C-1), High Density Multifamily District (MF -2), and Office District (OF), to a Planned Unit Development with base zoning district of Low Density Multi -Family (MF -1) district, in accordance with the attached Exhibit A (Location Map), Exhibit B (Legal Description), and Exhibit C (Development Plan) and incorporated herein by reference. Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective in accordance with the provisions of state law and the City Charter of the City of Georgetown. Survey and field notes attached as Exhibit A. The primary use of the Property shall be for multi -family, detached dwelling units and a community center that exclusively serves the residents of those dwelling units. This PUD serves to augment and/or modify the standards for development outlined in th City's Unified Development Code (UDC) in order to implement the vision for the property f and ensure a cohesive, quality development not otherwise anticipated by the underlying base zoning district. In the case that this Development Plan does not address a specific item, the City of Georgetown UDC and any other applicable Ordinances shall apply. In the event of a conflict between the regulations of this PUD and the regulations of the base zoning district, the PUD shall control. The Conceptual Lan Plan depicts a series of buildings, parking, outdoor areas, and landscaping that may be developed in phases, provided the minimum requirements of the PUD district are met. Approval of this PUD, Development Plan, and Conceptual Land Plan does not constitute approval of a Site Plan per Section 3.09 of the UDC. FMOMATIMURM 1. Primary Use. The required sidewalk to be installed per the UDC can be located within this reservation. Landscaping on the Property shall be in conformance with Chapter 8 of the UDC. Common Amenity Area. The Common Amenity Area on the property shall be in conformance with the UDC. Three Common Area Recreation amenities are required, and we will provide 5 (with details to be included at Site Plan submittal). One Common Area Recreation amenity will be a trail system with 6 foot pathways covered by decomposed granite (Example provided in Exhibit D).
