HomeMy WebLinkAboutRES 880203RESOLUTION RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF GEORGETOWN TO EXECUTE A QUIT CLAIM FOR EASEMENT IN PROPERTY HELD BY THE NPC/GEORGETOWN JOINT VENTURE. WHEREAS, the City • Georgetown, Texas, has •_- requested to quit claim its interest in a water line easement that encumbers certain property hold by NPC/Coorgetown Joint Venture; and WHEREAS, the City finds that it has no known interest in said easement by deed, instrument, or otherwise,- and WHEREAS, the City further finds, it has no reasonable present or foreseeable future need for a water line easement in said property; and WHEREAS, the City finds, if such ownership exists in it, it is in the public interest to quit claim same so as to relieve itself of the responsibility to maintain same. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF GEORGETOWN, TEXAS, That the Council finds that the recitals set forth above are true and correct and are incorporated he -rein. Section II. U Leta Willoughby, City etre ry Moll DianCallander City Attorney Quit Claim Easement/Page 2 of 2 I A RNUIRIN THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF WILLIAMSON WHEREAS, Williams NPC/Georgetown Joint Venture, a Texas joint venture ("Joint Venture"), is the owner of the land described on Exhibit "A"I attached hereto and made a part hereof ("Property"); and WHEREAS, a portion of the Property is encumbered by a water line easement ("Easement") granted in an instrument dated September 25, 1944, recorded in Volume 322, Page 541, et seq. of the Deed Records of Williamson County, Texas, said instrument being attached hereto as Exhibit "B" and made a part hereof; and WHEREAS, the Joint Venture desires that the City of Georgetown, Texas, quit claim unto the Joint Venture, its successors and assigns, all of its right, title and interest, if any, in and to the Easement to the extent said Easement encumbers the Property; and NOW, THEREFORE, for and in consideration of the premises, the sum of Ten Dollars and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City of Georgetown, Texas ("Grantor"), does, by these presents, BARGAIN, SELL, RELEASE AND FOREVER QUIT CLAIM unto the Joint Venture, its successors and assigns, all of its right, title and interest in and to the Easement with respect to the 'above- described Property ("Easement Rights"); it being understood and agreed, however, that the conveyance herein relates only to the herein described Property and does not in anywise affect the otherwise released shall remain in full force and effect in accordance with the terms and provisions of the Easement. This instrument is executed by Grantor to the Joint Venture in order to remove or dispel any clouds created and cast upon the fee title to the above-described Property by virtue of the Easement. TO HAVE AND TO HOLD the said Easement Rights, together with all and singular the rights, privileges and appurtenances thereto in any manner belonging unto the said Joint Venture, its successors and assigns, forever, so that neither the said Grantor nor its successors, nor any person or persons claiming under it shall, at any time hereafter, have, claim, or demand any right or title to the aforesaid Easement Rights or appurtenances, or any part thereof.
