HomeMy WebLinkAboutRES 8902098q 012C q A RESOLUTION TO AUTHORIZE AND AGREEMENT BETWEEN THE CITY OF GEORGETOWN, TEXAS AND PEDERNALES ELECTRIC COOPERATIVE FOR RELOCATION OF ELECTRICAL UTILITLY LINES WITHIN COOPERATE LIMITS, AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME. WHEREAS, the City of Georgetown, Texas is the major supplier of electrical utilities within its corporate limits; and WHEREAS, the City Council finds that safe and efficient distribution of electricity is essential to the operation of the City's Public Utilities Department; and WHEREAS, Universal Electric were the lowest bidder to this project and the City of Georgetown desire to enter into an agreement for relocation of utility lines related to the relocation of existing overhead electrical lines owned and serviced by the Pedernales Electric Cooperative within a private utility easement, and authorizing the Mayor to execute the same; WHEREAS, the City Council has found that this action implements (Utilities/Energy Policy 3) of the Century Plan - Policy Plan Element, and is not found to be inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section I. That the City finds the recitals set forth above are true and correct and are incorporated herein. Section II. That the City Council approves the agreement between the City of Georgetown, Texas, and Pedernales Electric Cooperative, for relocation of existing overhead electrical lines within a private utility easement, and authorizing the Mayor to execute the same, which is attached hereto and incorporated herein as if fully set forth at length. Section III. That the Mayor is hereby authorized to execute the contract documents and City Secretary to attest. PASSED AND APPROVED this day of Mo -q 1989. Allen Engineering Manager JBA/dg allmmsff,. ='I 09 CITY OF GEORGETOWN MEMORANDUM DATE: May 16, 1989 TO: Mayor and City Council City Manager FROM: Jim Briggs Director of Public Utilities RE: Williams Drive Utility Relocations Project No. 00290 The City of Georgetown as a part of the Right -of -Way acquisition and utility relocations along Williams Drive , FM 2338, has certain commitments to the relocation of existing utilities within that right-of-way acquisition. A part of those utilities having to be relocated is a electrical line owned by Pedernales Electric Cooperative. This particular electrical line is operated by Pedernales Electric Cooperative within a private easement designation. According to the State Department of Highways and Public Transportation Right -Of -Way Division, all utilities operating within newly acquired right-of-ways that exist in private easements are to be compensated for relocation by the acquiring agency. City staff has met with representatives of Pedernales Electric Cooperative and the Texas Department of Highways and Public Transportation Right -of -Way Division on several occasions during the past two months to resolve this particular relocation issue. After clear definition that Pedernales Electric Cooperative was operating within a private utility easement -the recommendation of the Department of Highways and Public Transportation Right -of Way Division, and that this relocation be a compensable one. Pedernales Electric Cooperative at the request of City staff, bid the relocation of this existing overhead electrical line and the low bid as submitted to the City of Georgetown was Universal Electric with a bid amount of $9,171.94. The original request by Pedernales Electric Cooperative for compensation was approximately $10,000.00. Therefore, since Pedernales Electric has met the requirement of the City of Georgetown to competitively bid this project, and clarification has been made by the Department of Highways and Public Transportation Right -of -Way Division that this is a compensable relocation. City staff is recommending approval of the relocation and payment to Pedernales Electric Cooperative for such relocation in the total amount of $9,171.94.
