HomeMy WebLinkAboutRES 890058RESOLUTION2 A RESOLUTION APPROVING THE TERMINATION OF A LEASE AGREEMENT BETWEEN THE CITY OF GEORGETOWN, TEXAS AND GALE AND DIANA MANNING FOR 13,500 SQUARE FEET (0.31 ACRES) OF LAND LOCATED AT THE GEORGETOWN MUNICIPAL AIRPORT, GEORGETOWN, TEXAS, DATED AUGUST 9, 1988. WHEREAS, the City of Georgetown, Texas did lease 13,500 square feet (0.31 acres) of airport property to Gale and Diana Manning on August 9, 1988; and WHEREAS, Gale and Diana Manning did notify the City on January 25, 1989 of their desire to terminate said Lease Agreement; and WHEREAS, the City has fulfilled the requirements of Section (5)A of the Lease Agreement by serving notice of default on February 6, 1989; and WHEREAS, the City does not waive its rights to collect any and all past due rents; and WHEREAS, the City desires to terminate said Lease Agreement effective January 31, 1989; and WHEREAS, the City Council has found that this action is not inconsistent nor in conflict with any Century Plan Policy, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS. SECTION I. That the City Council finds the recitals set forth above are true and correct and are incorporated herein for all purposes. SECTION II. That the City Council approves the termination of the Lease Agreement between the City of Georgetown and Gale and Diana Manning for 13,500 square feet (0.31 acres) of land at the Georgetown Municipal Airport dated August 9, 1988, such termination to be effective January 31, 1989. SECTION III. The termination of this lease is not and shall not be construed to be a waiver for any and all rents, which are past due and owing. PASSED AND APPROVED THIS 6�8&h DAY OF FEBRUARY, 1989.
