HomeMy WebLinkAboutRES 9100035A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN RE GARDING THE INTENTIONS OF THE CITY WITH RESPECT TO USERS OF PRIVATE WATER WELLS LOCATED WITHIN THE WATER SERVICE AREA SOUGHT BY THE CITY OF GEORGETOWN IN TEXAS WATER COMMISSION DOCKET NO. 8539-C. WHEREAS, the City of Georgetown ("City") has filed an application with the Texas Water commission for a Certificate of Convenience and Necessity to provide potable water service in certain areas of Williamson County, Texas and this application has been assigned Docket No. 8539-C; and WHEREAS, in Docket No. 8539-C the City is seeking authority to provide potable water service in its corporate and extraterritorial jurisdiction except for areas currently certificated to other water service providers; and WHEREAS, several residents of the area sought to be certificated who use water wells for water supply have obtained party status as Protestants in Docket No. 8539-C; and WHEREAS, a group of these Protestants, who are represented by Ms. Doralyn Cheney, have agreed to withdraw their protest and request to be dismissed as parties upon receiving and assurance that, upon receiving a certificate of convenience and necessity, the City will not attempt to prevent them from continuing to use their water wells; and WHEREAS, the City wishes to avoid a contested case hearing on Docket No. 85' )9-C; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Georgetown, Texas that: SECTION 1. The City does not intend to use the certificate of convenience and necessity which may be granted in Docket No. 8539-C, as a means to force users of private water wells, which are located in the requested service area and used for individual residential or agricultural water supply, to connect to the City water supply system and discontinue use of such private wells. SECTION 2. The City recognizes that regulation of private well use in the requested service area may occur due to laws, rules, or regulations promulgated by Federal or State legislative bodies or administrative agencies. The City will cooperate with Federal or State agencies to carry out the provisions of applicable statutes and regulations. SECTION 3. Upon voluntary connection to the City water supply system, a private well user will be required to have a plumbing system that meets the City building codes. Plumbing cross - connections between City supply lines and private wells will not be allowed. SECTION 4. The Mayor is authorized to sign this Resolution upon the receip t of a writ'P commitment, signed by Ms. Doralyn Cheney on behalf of herself and those Protestants s represents 'to withdraw and request to be dismissed as parties to Texas Water Commissi FV,ocket No. 8539-C.
