A A A I VA 'I WIMREAS, the City of Georgetown recognizes the importance for constructing the East Frontage Road on 1-35 from Highway 29 to FM 2338 (Williams Drive) ("Frontage Road"); and WHEREAS, construction of the Frontage Road will improve traffic safety for the citizens of the community by reducing the amount of traffic entering 1-35 at Highway 29 and exiting at FM 2338 by providing an alternate route to travel between Highway 29 and FM 2338; and WHEREAS, construction of the 'Frontage Road will greatly improve access to abutting properties; and WBEREAS, the City of Georgetown, with broad support of the Georgetown Community, requested the Texas Transportation Commission to construct said Frontage Road; and WHEREAS, the Texas Department of Transportation prepared a cost estimate for the construction of the Frontage Road in the amount of $3,682,000-00; and WHEREAS, the City of Georgetown proposed to contribute a portion of the fundin.,A! m*9vts AXIMM61411KO the adjacent property; and WHEREAS, on June 29, 1993, the Texas Transportation Commission issued Minute Order 102420 authorizing construction of the Frontage Road-, and WHEREAS, said Minute Order required the City to provide $1,000,000.00 towards construction of said Frontage Road; and WHEREAS, the City Council has determined that it is in the best interest of the City and of special benefit to the adjacent properties that the Frontage Road be constructed-, WHEREAS, the City Council has determined that it is in the best interest of the City thffl the City comply with Article 1105b of the Texas Revised Civil Statutes and assess the adjace properties to the maximum allowable benefit received by the property due to the construction the Frontage Road; and I WHEREAS, the City of Georgetown has 90 days from the issuance of the Commission's NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, that: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein ant expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Development Plan Element - 1. Transportation Policy 15, which states: "The City will encourage a transportation system that provides for the safe and efficient movement of traffic, promotes the economic interests of the community, and adequately serves the personal needs of individuals;" and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The City Council adopts the cost estimate prepared b the T=" ) fol Department of Transportation in the amount of $3,682,000.00 (attached as ExhiZrt A r tj construction of the northbound frontage road from State Highway 29 to F.M. 2338 (Willia Drive), and authorizes the City staff to initiate the process for assessments against adjace properties in compliance with Article 1105b of the Texas Revised Civil Statutes in order -C A �, I , 1- - --,- X -A.6, . t - 4V -61T.) ki% - - sr-�] in Section 3. It is the City' intent to recover the highest allowable amount from the adjacel property owners, not to exceed the special benefits received by the properties as may determined in accordance with State law. SECTION 3. The City of Georgetown accepts the Texas Transportation Commission's Minute Order 102420 of June 29, 1993 and agrees to provide a fixed sum in the amount of $1,000,000.00 towards the Frontage Road project with the following conditions - 1. The City's contribution shall be limited to the costs for construction of that portion of the Frontage Road as identitifed on the attached Exhibit B, generally being from the southern boundary of the property currently owned by the Georgetown 35 Joint Venture north to the intersection of the Frontage Road and FM 2338 (Williams Drive), since the City has determined that these properties will be most greatly benefited from the construction of the Frontage Road due to their limited access because of the location of the North San Gabriel River and tributaries flowing into the South San Gabriel River; and 2. The City's contribution shall first be applied to cover all of the costs associated with the construction of curbs and gutters for this segment of the Frontage Road, and the remainder of the City's contribution shall be applied to cover the costs associated with the pavinV of this segment of the Frontage Road.
