HomeMy WebLinkAboutMIN 05.04.1999 CC-STUESDAY, May 4, 1999 The City Council of the City of Georgetown, Texas, met in Special Session on the above date with Mayor Leo Wood presiding. Council Present: Lee Bain Charlie Barton Charles "Hass" Burson Shelley Pierre Davis Susan Hoyt Ferdinand L. Tann Lorenzo "Shorty" Valdez Council Absent: None Regular Session - Called to order at 5:35 p.m. A Mayor, Council, City Manager, and staff comments and reports There were no comments. B Citizens wishing to address the Council Llorente Navarette, 2002 Pine Street, read a portion of a letter that his mother wrote to the Mayor and Council regarding Councilmember Davis and gave his personal comments. Ramona Navarette, 2002 Pine Street, also read her letter to the Mayor and Council, in which she requested that the Council issue sanction to Councilmember Davis for what she called misconduct, dereliction of duty, violation of electoral laws, and violation of the City of Georgetown Governance Policy. Anita Smith -Etheridge, 902 W. 19th Street, spoke in support of Davis, saying she has promised to help him work with Lyda to ensure representation for the entire community and that she is confused and concerned about the comments from Ms. Navarette. Della Green, 1901 Vine Street, told Council she would file a complaint with the Secretary of State, District Court and the State Attorney General's Office for what she called voting irregularities and ethics questions. Legislative Regular Agenda Council will individually consider and possibly take action on any or all of the following items: (Council may, at any time, recess the Regular Session to convene an Executive Session at the request of the Mayor, a Councilmember, or the City Manager.) Minutes of City Council Meeting /May 4, 1999 Page 1 of 3 Pages C Consideration of appointment of a canvassing team of councilmembers to canvass the results of the May 1, 1999 General Election -- Mayor Leo Wood Wood appointed Bain as Chair, Barton and Valdez to serve as the canvassing team. The three councilmembers left the Council dais to compare the tally sheets with the return sheets. 5:47 p.m. recess -- 6:05 p.m. resumed meeting Upon return to the dais, Bain noted a discrepancy in the voting totals. He noted that Tonn had received one more vote according to the tally marks, making the total votes he received as 145 instead of 144 which changed each of the corresponding totals on the official tabulation sheet to show an increase of one vote. It was determined that this increase of one vote for Tonn did not affect the outcome of the results of the election. D Consideration of approval of an ordinance canvassing the votes for the May 1, 1999 General Election and declaring the election results to be official --Emergency Reading -- Sandra Lee Lee read the ordinance. Motion by Bain, second by Davis to approve the ordinance on emergency reading declaring the election results to be official. Approved 7-0. E Consideration of a resolution declaring a Run Off Election, if necessary -- Sandra Lee Hart explained the State of Texas Election Code requirements for setting the date of the Runoff Election. He explained that there is language in the Code that provides if the date falls within three days of an official holiday, the runoff election could be held on another date. Hart demonstrated to Council the dates that would correspond to the possible alternative runoff dates, such as the periods for early voting. Mayoral runoff candidate, MaryEllen Kersch, stated that she is opposed to delaying the date of the Runoff Election, noting that the original resolution passed by the Council in February had called for the Runoff to be held on May 29, 1999. Lee read the resolution. Motion by Bain, second by Hoyt to approve the resolution calling for the Runoff Election to be held on May 29, 1999. Approved 4-3. (Valdez, Barton, and Tonn opposed) F Swearing in of new Councilmembers -- Sandra Lee Prior to the swearing in of the new councilmembers, outgoing Councilmember Shelley Davis was allowed to comment. He thanked his family for encouragement and thanked the citizens who had elected him. He told the Council it was an honor to work with them and the staff. He said his work is not done and that he will continue to serve the community. Councilmembers Lyda and Burson were sworn in by Lee. Wood presented them with Certificates of Election. Minutes of City Council Meeting /May 4, 1999 Page 2 of 3 Pages G Comments by incoming Councilmembers Lyda thanked the volunteers that had helped his campaign and promised to be a new constructive voice on the Council. Burson stated that because he was unopposed he felt that either his constituents were pleased or nobody else wanted the job. He said he would work hard for District 6 and all of Georgetown to keep Georgetown the great community that it is. H Election of Mayor Pro Tem, if possible Wood announced that a recount for District 2 had been requested by outgoing Councilmember Shelley Davis. He said the Recount would be held on Friday, May 7, at 1:00 p.m. at City Hall. Wood noted that because of the Recount and until the Council was complete, the election of a Mayor Pro Tem would be postponed. Swearing in of Mayor Pro Tem, if necessary -- Sandra Lee Election of Mayor Pro Tem was postponed. Executive Session In compliance with the Open Meetings Act, Chapter 551, Government Code, Vernon's Texas Codes, Annotated, the items listed below will be discussed in closed session and are subject to action in the regular session that follows. Sec. 551.071 consultation with attorney Executive Session was not held. Regular Session K Action from Executive Session Executive Session was not held.
