G Mayor, Council, City Manager, and staff comments and reports There were no comments. H Citizens wishing to address the Council Della Green, 1901 Vine Street, referred to an article in the Austin American Statesman concerning a potential lawsuit with LCRA. She asked if the sale of excess power followed Sec. 8 of the City Charter. She said she didn't remember any public hearings as listed in the City Charter. Hart said the City entered a contract with ETG to sell kilowatts, not the system, during the periods when the power was not needed in Georgetown in order to improve the operating efficiency of the electric system. He said the dispute is whether the City has the authority to sell the power and the case will be heard in District Court here in Georgetown. J. David Hall, 201 Liz Lane, left a letter for the Council to read concerning Item O of the Consent Agenda. David Hall, 201 Liz Lane, Kingma explained that this item asks the Council to balance between two neighborhoods. She said keeping Lindsay Lane open to Westlake of the Woods is important to the safety of the residents to enable access by emergency vehicles. Kingma also noted that the streets are outside the City Limits and are patrolled by the County Sheriffs Department. Briggs explained that a budget was determined and the low bid came in below that amount. He said they are asking for approval of the budget amount to provide a contingency fund for any possible change orders that might occur. Motion by Valdez, second by Barton to approve the Consent Agenda with the exception of Item R. Approved 7-0. R Consideration of a resolution directing the publication of notice of intention to issue $6,760,000 City of Georgetown, Texas Combination Tax and Utility System Limited Revenue Certificates of Obligation, Series 1999; and other matters related thereto -- Susan Morgan -- pulled by Barton Morgan explained that this would not be the issuance of the bonds, just approval of the publication procedures that are required before the bonds are issued. Motion by Barton, second by Hoyt to approve the resolution. Approved 7-0. At this time, Item EE was moved to this portion of the agenda. EE First reading of an ordinance revising Chapters 14.12 and 14.14 of the Georgetown Municipal Code to transfer the cable and telecommunications franchises with Williamson County Cablevision Company to TCA Cable TV of Central Texas, L.L.C. d/b/a TCA Cable TV; and declaring an emergency and waiving the newspaper publication requirements of Section 14.12.130 of the Georgetown Municipal Code -- Art Rodriguez and Bob Hart Rodriguez read the ordinance. Tonn asked if Cablevision planned any channel changes. Dale Hoffman, from the audience, said they did not intend to make any channel changes. He noted that they will follow the requirements to get this ordinance finalized by June 1, 1999. He introduced three representatives of the new company that is purchasing Cablevision. Bain asked and Rodriguez explained the publication requirements and the need for this being an emergency reading, and confirmed that there would still be a City Council Meeting Minutes/April 27, 1999 Page 3 of 5 Pages second reading. Hart explained that the requirements come from both the franchise agreement and the City Charter. Motion by Tonn, second by Hoyt to approve on first reading. Approved 7-0. Y Second Reading of an ordinance closing public hearing; levying assessments for the cost and maintenance of certain improvements to be provided in the Georgetown Village Public Improvement District No. 1; fixing liens and charges against property in the District and against the owners thereof; and providing a date for, and a method of collection -- Art Rodriguez and Bob Hart Rodriguez read the caption of the ordinance on second reading. Motion by Tann, second by Barton to approve Ordinance 99-22. Approved 7-0. Z Second Reading of an Ordinance to Rezone Park Central One, Section 11 from A, Agricultural to 1, Industrial, or any more restrictive district, located on County Road 110, and Park Central and Commerce Boulevards -- Wendy Walsh and Hildy Kingma Walsh read the caption of the ordinance on second reading. Motion by Tonn, second by Davis to approve Ordinance 99-23. Approved 7-0. AA Second Reading of an Ordinance to Rezone 14.867 acres in the William Addison Survey, from A, Agricultural to RM -2, Dense Multifamily, or any more restrictive district; and Horizon Commercial Park, Block E, Lots 1 and 2 and Block C, Lots 1-8, to be known as Georgetown Place, from I, Industrial to RM -2, Dense Multifamily, or any more restrictive district, located on Quail Valley Drive, Tower Drive, High Tech Drive and Texstar Drive -- Wendy Walsh and Hildy Kingma Walsh read the caption of the ordinance on second reading. Motion by Burson, second by Valdez to approve Ordinance 99-24. Approved 7-0. BB Second Reading of an ordinance replacing Chapter 15.03 of the City Of Georgetown Code of Ordinances, establishing energy conservation standards for single and multi -family residential dwellings -- Dave Hall and Jim Briggs Briggs read the caption of the ordinance on second reading. Motion by Davis, second by Barton to approve Ordinance 99-25. Approved 7-0. CC Second Reading of an ordinance to rezone San Gabriel Village, Section One, Lots 1 and 2, to change Lot 1 from C -2A - Restricted, Commercial First Height to C -2A - Restricted, Commercial First Height to exclude all residential district uses, and to change Lot 2 from the C -2A - Restricted, Commercial First Height to C -2A - Restricted, Commercial First Height, to include multifamily residential uses only, or any more restrictive district, located on IH -35 North, between SH29 and FM2338 -- Wendy Walsh and Hildy Kingma Walsh read the caption of the ordinance on second reading. Motion by Burson, second by Valdez to approved Ordinance 99-26. Approved 7-0. DD First reading of an ordinance establishing the Main Street Advisory Board -- Lenny Welch and Verna Browning Welch read the entire ordinance. Motion by Valdez, second by Davis to approve the ordinance on first reading. Approved 7-0. EE (This item was moved to the beginning of the Regular Agenda.) FF Consideration of authorizing the expenditure of $6,000.00 from the Council Contingency fund to support the "Risk Watch" Safety Program -- Anthony Lincoln Lincoln explained that Georgetown was one of 18 cities in the U.S. and Canada (one of two in Texas) chosen for a pilot program that includes 12 areas of interest such as water and bicycle safety, burns, etc. He said there would be 20 classes (pre -K through 8th grade) in GISD that will teach it this year, with the hope of expanding to all schools in the district next year. Hart explained that the funds will provide supplies and training for the teachers. He said the Fire Department will be assisting the teachers in conducting the City Council Meeting Minutes/April 27, 1999 Page 4 of 5 Pages classes. The $6,000 is a local match for a grant provided by the National Fire Protection Association. Motion by Davis, second by Valdez to approve the expenditure. Approved 7-0. Policy Development/Review Worho GG Discussion of revising the minimum width at the front property line for lots on cul-de-sacs in rural subdivisions -- Wendy Walsh and Hildy Kingma Walsh noted that the design standards prescribe 120 feet of street frontage and no specifics for cul-de-sacs. Several rural subdivisions are coming before the Planning and Zoning Commission at this time. She noted that staff proposes to reduce the street frontage to 85 feet with 120 -foot width at the 50 -foot setback. Hart noted that this was brought to Council as a concept in this workshop item before preparing an ordinance. Hart asked for a five-minute break to set up a slide presentation. 7:58 p.m. recessed - 8:05 resumed HH Clarify policy prohibiting gated communities vis-a-vis establishment of ordinances prohibiting automatic gates from being used at residential occupancies -- Hildy Kingma and Anthony Lincoln Hart explained that Council had adopted a policy of not allowing gated communities. He said a project has recently appealed that decision to the Building Standards Commission, and because the policy had not been formally adopted as an ordinance, the gates were allowed. Bain asked why the Building Standards Commission would go against Council policy, and asked how that issue had gone to that Commission without coming to the Council. Rodriguez confirmed that he normally attends those meetings but was at a conference when that Building Standards Meeting was held. The issue involves the Georgetown Station Apartments on 17th Street. Lincoln showed slides demonstrating existing gates in the Georgetown/Round Rock area. He noted that the gates are a detriment to quick response for emergency vehicles. Lincoln explained the "Knox box" procedure. He noted that the "Knox box" key is kept in the fire vehicles to gain entry to the box where other keys are kept to gain entry inside the gates. He said it would take at least a minute to stop, unlock the "Knox box" and enter the compound. He said fire doubles in one minute. Lincoln noted several reasons why the gated communities were dangerous for the inhabitants. Council generally agreed that an ordinance needs to be adopted.
