Council Present: =Council Absent: Charles "Hors" Burson, Charlie Barton, None Ferd Tonn, Lee Bain, Shelley Davis, Shorty Valdez, Susan Hoyt Staff Present: George Russell, Acting City Manager, Marianne Banks, City Attorney; Sandra Lee, City Secretary-, Art Rodriguez, Assistant City Attorney; Clyde von Rosenberg, Chief Planner - Long -Range Planning-, Hildy Kingma, Chief Planner - Current Planning; Kim Shaw, Development Planner; Gary Warnock, Electric System Planner; Tom Bolt, Building Plan Reviewer; Travis McLain, Airport Manager; Allison Copple, Administrative Assistant to the Assistant City Manager Called to order at 5:50 p.m. A Workshop on the City's plan for achieving year 2000 compliance by December 31, 1999 -- George Russell Russell introduced Tony Nuccio, Bill Peak and Dan Stathos of RMI and Parkash Daryani of Arriga who gave the Council an overview of the three-phase process to ensure compliance. Mayor, Council, City Manager and staff comments and reports Jim Briggs presented the Regional Administrators Environmental Excellence Award to Mayor Wood that had been presented to staff at the Capitol last week. Wood recognized eight Boy Scouts in the audience. G Citizens wishing to address the Council Keith Peshak, 800 Oak Crest Lane, read his opinion to the Council regarding the Georgetown Police Department. Birdie Shanklin, 803 W. 9th Street, asked Council not to move the Shotgun House from its present location. i / M' H Public hearing on the annexation of approximately 1,386 acres in the Antonio Flores and John Berry Surveys, including the Crystal Knoll Terrace Unit One subdivision, the Pecan Branch Concept Plan area, the Chisholm Park Concept Plan area, and the Sunflower Concept Plan area -- Ed Barry and Clyde von Rosenberg von Rosenberg explained that this was the second of the two required public hearings. Dr. Wade Burton, 402 Caladium Drive, Crystal Knoll, said he was in favor of annexing the area surrounding the right of way for the proposed State Highway 130; however, he is opposed to separating the two sections of the Crystal Knoll Subdivision by the annexation, making the property values different in the two sections. He also said he thought it would be very confusing to the police officers as far as where their jurisdiction stops and starts. Bain asked if Council had received any more information regarding how the financing works for that subdivision. Hoyt voiced concern about the number of lots yet to be financed in Section 1. Tony Gaunt, 170 Haverland Drive, noted that he had also spoken at the previous public hearing. He presented a petition to the Council containing signatures from the landowner; around the Haverland Drive area, stating that they are opposed to the annexation. At this time, Wood recognized Rick Jones. Jones noted that there was a problem at the apartment where he used to live. He said there were fire ants in the transformer and it burned out many of his appliances. He said he is one of four apartment dwellers with claims against the City for the damages. He said he went to Small Claims Court and the case was denied. Wood confirmed that Jones lives now in the Council District of Councilmember Valdez, and suggested that he share his information with Councilmember Valdez and Valdez could bring that information to the Council. Dr. David Ramsey, 661 FM 971, just east of San Gabriel Estates, told Council he has concerns about the proposed annexation. He cited a problem with the Planning Commission three years ago when he wished to sell three acres of his land. He said he wants reassurance that the Planning and Zoning Commission will deal economically and correctly with future requests for development. Bill Miller from the audience noted that one property was not represented by signature, but the owner of that property reportedly feels the same as the other neighbors and is against the annexation. The Public Hearing was closed at 7:31 p.m. Consideration of approval of the minutes for the Regular Meeting of Tuesday, October 13, 1998 -- Sandra City Council Meeting Minutes/October 27, 1998 Page 2 of 5 Pages Lee Consideration of a resolution amending Resolution No. 980922 -SS to reschedule the public hearing date set out in said resolution relating to the establishment of Georgetown Village Public Improvement District -- Marianne Banks K Consideration of the approval of reimbursement to Texas Electric Cooperatives, Inc. for the cost of excavating the stormwater detention pond at the facility site -- Jim Briggs and Don Rundell Bain asked for explanation. Briggs explained that when the City was building Cooperative Way, it was discovered that it would be more economical to allow the drainage to go to a different side of the roadway where Texas Electric Cooperatives had already constructed a stormwater detention pond, so the City is reimbursing Texas Electric Cooperatives for their expense to construct that detention pond. Consideration of an Agreement to transfer service area from Pedernales Electric Cooperative, Inc. (PEC) to the City of Georgetown -- Marianne Banks M Consideration of a resolution authorizing the Mayor to execute documents with the Texas Department of Transportation for the City's participation in a "Small Market Air Service Needs Assessment" -- Travis McLain and Verna Browning Frank Parmenter, 4106 Sequoia Trail East, said the consent agenda is supposed to be for routine, non -controversial items. He claims this item is not non -controversial. He asked for more information about the proposed grant agreement. He asked that the Council pull this item frorn the Consent Agenda so that it could be explained. City Secretary Lee noted that Parmenter had requested a copy of the grant agreement. She noted that the agreement was made available at her office for him, but he had not returned to view it. Barton asked that the item be pulled Wood asked Airport Manager Travis McLain to explain. McLain noted that this is a state-wide air service study to show the economic impact on the community for which the individual cities who decided to participate would pay up to $1,000. Parmenter argued that the City should not participate in any further economic expansion at the airport. Wood noted that the recent Airport Master Plan had stated that the runways would not be lengthened. Barton stated that the public needs to be told that this is not an attempt to expand the airport. Wood asked Russell, Browning and McLain to get the correct information into the newspaper. Approved 7-0, U Second Reading of an ordinance to Rezone with a Site Plan as required by the Zoning Ordinance, from RS, Residential Single Family, to RO, Residential Office, for Gabriel Heights Addition, Block 2, Lot 8, located at 1599 Williams Drive -- Hildy Kingma and Kim Shaw Shaw read the caption of the ordinance on second reading. Motion by Bain, second by Davis to approve Ordinance No. 98-66. Approved 7-0. V Second Reading of an ordinance amending the Century Plan for Gabriel Heights Addition, Block 2, Lot 8, from Intensity Level Three to Intensity Level Four, located at 1599 Williams Drive -- Hildy Kingma and Kim Shaw Shaw read the caption of the ordinance on second reading. Motion by Tonn, second by Valdez to approve Ordinance No. 98-67. Approved 7-0. W Second Reading of an ordinance providing for the annexation into the City of 123.564 acres out of the Burrell Eaves, Frederick Foy, and Daniel Monroe Surveys, to be known as Sun City Georgetown Phase 4-A -- Ed Barry and Clyde von Rosenberg von Rosenberg read the caption of the ordinance on second reading. Motion by Bain, second by Burson to approve Ordinance No. 98-68. Approved 7-0. X Second Reading of an ordinance to Rezone 123.564 acres in the Burrell Eaves, Frederick Foy and Daniel Monroe Surveys, to be known as The Planned Unit Development of Sun City Georgetown, Phase 4-A, from A, Agricultural to RP, Residential Planned, or any more restrictive district, located along Texas Drive and Sun City Boulevard -- Hildy Kingma and Gary Warnock Warnock read the caption of the ordinance on second reading. Motion by Bain, second by T onn to approve Ordinance No. 98-69. Approved 7-0. First Reading of an ordinance adding Chapter 6.40 to the Code of Ordinances of the City of Georgetown relating to the regulation of alcoholic beverages within the City limits -- Art Rodriguez Rodriguez read only the caption of the ordinance on first reading after having satisfied the requirements of the City Charter. Rodriguez noted that this ordinance incorporates the items that were suggested by the Council at the workshop of the previous council meeting. Hoyt clarified the percentage requirements for the special -use permits. She also clarified that the City could adopt restrictions for alcohol use in the City -owned Community Center. Wood asked if the State placed a cap on the amount for the special -use permit. Barton clarified that the Council would have the final authority on establishments that receive 75% or more of their gross receipts from sales of alcoholic beverages. Banks noted that the current ordinance establishes guidelines that can be amended at a later date City Council Meeting Minutes/October 27, 1998 Page 4 of 5 Pages Bain questioned whether this ordinance restricts the use of alcohol in the vicinity of youth activity areas. Banks told Council they would come back to a future workshop with a map for Council to be able to stipulate the distance. Bain asked how the City would establish policy. Rodriguez suggested that the policy could be discussed in a future workshop after having the opportunity to visit with other cities to find out about their policies. Bain confirmed that the ordinance could be approved on first reading and then amended to designate specific zoning districts at the second reading. Motion by Tonn, second by Bain to approve the ordinance on first reading. Approved 7-0. Z First Reading of an ordinance providing for the annexation into the City of 1.96 acres in the David Wright Survey, known as the Dicotec Subdivision, Lots Three and Four, located on FM 2338 -- Ed Barry and Clyde von Rosenberg von Rosenberg read the ordinance. Motion by Tonn; second by Burson to approve the ordinance on first reading. Approved 7-0. AA Consideration of a fee waiver for water impact fees, planning and permit fees, water, tap fees, engineering fees, and electric connect fees for Faith Lutheran Church located at 4010 Williams Drive -- Hildy Kingma and Kim Shaw Shaw read to Council their current policy on fee waivers. She noted the total amount of the fees to be waived and that the Church plans to connect with the City electric service. She said, therefore, the staff is in support of the waiver. Davis said he didn't understand why we make exceptions for churches on this policy and don't make exceptions for churches on the sanitation fees. Davis and Hoyt requested that the staff review offering reduced garbage rates to the churches. Motion by Barton, second by Davis to approve the fee waiver.
