A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, WITHDRAWING THE CITY'S INTENT T*
DISTRIBUTE GAS TO SUN CITY -GEORGETOWN.
WHEREAS, Sun City -Georgetown was in need of natural gas distribution services; and
WHEREAS, Lone Star Gas initially elected not to provide gas distribution service to Sun
City -Georgetown; and
WHEREAS, the City of Georgetown offered to provide natural gas distribution services
through a joint financing partnership with the Lower Colorado River Authority (LCRA) to finance
and supply gas services to Sun City -Georgetown; and
WHEREAS, Lone Star Gas has threatened litigation as a result of such an arrangement
between Georgetown and LCRA; and
WHEREAS, Lone Star Gas has offered to provide gas services to Sun City -Georgetown by
approximately December 1, 1995; to extend the gas lines at the expense of Lone Star Gas; and to
reimburse the City of Georgetown for expenses incurred as a result of start-up efforts in the gas
distribution system.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this
resolution implements Utilities/Energy Policy I of the Century Plan - Policy Plan Element, which
states: "The City investigates the feasibility of using available and emerging alternative energy
sources"; and Utilities/Energy Policy 6 which states: "Franchised utilities provide adequate services
for all citizens" and further finds that the adoption of this resolution is not inconsistent or in conflict
with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of
the Policy Plan.
SECTION 2. The staff is hereby instructed to delete from the 1995/1996 Annual OperatinM
Plan Element the gas distribution system department and related operational and capi
expenditures. I
SECTION 3. This resolution shall be effective immediately upon adoption.
