HomeMy WebLinkAboutRES 950314-HKESOLUTION NO. w w i WHEREAS, as a Home -Rule Municipality, according to Chapter 43 of the Texas Local Government Code, the City of Georgetown has the authority to fix and extend its municipal boundaries and annex area adjacent to its boundaries; and WHEREAS, a municipality may annex only in its extraterritoni al jurisdiction, unless the municipality owns the area; and V-THEREAS, a municipality may not annex a publicly or privately owned area, including a strip of area following the course of a road, highway, river, stream, or creek, unless the width of the area at its narrowest point is at least 1,000 feet, unless the annexation is initiated on the written petition of the owners or of a majority of the qualified voters of the area or unless the property to • annexed meets specific configuration requirements; and WHEREAS, in a calendar year, a municipality may not annex a total area greater than 10 percent of the incorporated area of the municipality as of January I of that year, plus any amount carried over as unused from previous years up to a total of 30 percent, unless the area annexed is volunteered or is owned by the municipality, a county, the state, or the federal government and is used for a public purpose; and WHEREAS, the total area to be annexed is within the amount allowed by State law and lies within the extraterritorial jurisdiction of, and is adjacent and contiguous to the City of Georgetown; and WHEREAS, the City Council has determined that the annexation is in the best interests of the City • Georgetown-, Park Meadow West and First Baptist Church Intent to Initiate Annexation Resolution No. Page 1 of 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Policy Plan Element: 1. Environmental and Resource Conservation Policy 1, which states: "The Physical attributes that make Georgetown attractive are protected"; and 2. Growth and Physical Development Policy 1, which states: "Land use patterns within the City provide economic, cultural, and social activities to all residents, businesses and organizations"; and 3. Growth and Physical Development Policy 2, which states: "The City's regulations implement the policy statements and provide the opportunity to seek change with reasonable effort and expense"; and 4. Growth and Physical Development Policy 3, which states: "Annexations procedures and standards benefit the community"; 9nd further finds that the adoption of this resolution is not inconsistent or in conflict with any itither Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the F!Iolicy Plan. SECTION 2. The City Council of the City of Georgetown hereby indicates its intent to initiate the annexation process for a 4.7 acre portion of the proposed Park Meadow West subdivision, located in the vicinity of the southeast comer of Williams Drive and Lakeway Boulevard, and a 15.4 acre portion of the First Baptist Church property, located south of SH29 and east of the intersection with D.B. Wood Road, as described in Exhibit A. SECTION 3. The City has received a letter requesting annexation from the property owners of the Park Meadow West and the First Baptist Church pr••- ! i pe olutionare hereby adopted. SECTION 5. The required public hearings to describe the service plans and receive comments shall be held on March 28, 1995 and on April 11, 1995. The portion of said tract to be annexed described in more detail below. BEGINNING, for a POINT OF BEGINNING hereof, at the southeastern corner of the 9.16 acre part of said First Baptist (2171/354); said corner being at or near a southwestern corner of said Joseph Pulsifer Survey and at or near a southeastern corner of said Isaac Donagan Survey; said corner also lying at or near the northern line of the Joseph Thompson Survey (A-608); and said corner lying in common with a northern line of a tract conveyed to Jay L. Wolf (Volume 422, Page 84 of the Williamson County, Texas land records); thence proceeding as follows - 1. THENCE continuing in a southwesterly direction along the southern line of said 9.16 acre part of First Baptist (2171/354), which lies in common with a northern line of the Wolf tract and is a segment of the southernmost line' of the said 21.7 acre First Baptist Church tract, and also lies at or near a southern line of the Donagan Survey and at or near a northern line of the Thompson Survey; to the westernmost southern corner of said First Baptist, this corner being in common with the southeasternmost corner of a tract conveyed to Church of Christ of Georgetown (Volume 1971, Page 858 of the Williamson County, Texas land records); 2. THENCE leaving the northern line of Wolf and the Thompson Survey, and continuing in a northerly direction along the westernmost line of said First Baptist (2171/354), this line being in common with the eastern line of said Church of Christ and being the westernmost line of said 21.7 acre First Baptist Church tract; to a point on the First Baptist western line which lies in common with the southern line of the existing Georgetown City Limits (Ordinance 86-59); 3. THENCE leaving said Church of Christ and proceeding in an easterly direction along the southern line of the existing Georgetown City Limits through the interior of said 9.16 acre First Baptist (2171/354), this City Lts line being parallel to and a distance of at or near 250' south from the centerline of State Highway 29; to the eastern line of First Baptist, this line lying in common with the western line of the 12.54 acre part of the First Baptist Church tract (1261/128), and also being at or near the eastern line of the Donagan Survey and at or near the western line of the Pulsifer Survey;
