L- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, APPROVING THE UPDATED LAND USE ASSUMPTIONS AND CAPITAL EMPROVEMENTS PLAN TO BE USED TO UPDATE THE CITY'S WATER AND WASTEWATER IlVIPACT FEES WHEREAS, the City Council of the City of Georgetown Texas has appointed an Impact Fee Advisory Committee, as per the provisions of Chapter 395 of the Texas Local Government Code, to guide the development of planning, land use, capital improvements plan and impact fee information for the existing and future water and wastewater utilities; and WHEREAS, the Impact Fee Advisory Committee reviewed and approved the Updated Capital Improvements Plan at its meeting of October 29, 1998; and WHEREAS, the Updated Capital Improvements Plan will be used by the City of Georgetown in its evaluation and consideration of updating its impact fee ordinances; and WHEREAS, the City Council of the City of Georgetown called for a Public Hearing at its regularly scheduled session of September 22, 1998, to seek public comment on the proposed Updated Capital Improvements Plan and the general nature of the proposed capital improvements; and WHEREAS, the City of Georgetown made requisite public notice of such Public Hearing for three consecutive weeks in a general circulation local newspaper, the first such notice appearing October 7, 1998; and WHEREAS, the City of Georgetown made publicly available on or before the date of the first publication of the notice various information concerning the Public Hearing issues; and WHEREAS, the City of Georgetown has received public testimony on November 10, 1998, from the general public, and appointed representatives of the Advisory Committee; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Environmental and Resource Conservation Policy 3. 1, Finance Policy 5. 1, and Utilities/Energy Policy 14.0 of the Century Plan - Policy Plan Elements, which state: Capital Improvements Plan Resolution No. 70 1la7 Page 1 of 2 Georgetown's water resources system provides a sufficient water supply of high quality to meet future City needs, to meet economic development and recreational requirements, and to conserve wildlife; Each utility system is a self -supported operation that provides a desirable and affordable level of service; Georgetown's utility systems provide safe and reliable service which meets the needs of all citizens and promotes the economic health of the community; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The Georgetown City Council hereby adopts the attached Updated Land Use Assumptions and Capital Improvements Plan which will be used to develop updated water and wastewater impact fees as required under the provisions of Chapter 395 of the Texas Local Government Code. SECTION 3. This resolution shall be effective immediately upon adoption. RESOLVED this 'W day of �u"Y-116'r 1998.
