D S„� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ACKNOWLEDGING RECEIPT OF A PETITION TO ESTABLISH THE GEORGETOWN VILLAGE PUBLIC IMPROVEMENT DISTRICT #1; APPOINTING AN ADVISORY BOARD; SETTING A HEARING DATE; AUTHORIZING PUBLICATION OF NOTICE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on September 15, 1998, Shell Ranch Development, Inc. and Weekley Homes, L.P., filed with the City Secretary of the City of Georgetown a Petition for Establishment of Georgetown Village Public Improvement District (the "Petition"), a copy of which is attached hereto as Exhibit 1; and WHEREAS, the Petition requests the establishment of a public improvement district pursuant to the provisions of Chapter 372, Texas Local Government Code (the"PID") within the corporate boundaries of the City, the boundaries of the PID being described by metes and bounds on Exhibit "A" to the Petition (Exhibit 1 hereto); and WHEREAS, the Petition states the general nature and estimated costs of the proposed improvements, the boundaries of the proposed PID, the proposed method of assessment and a provision for management of the proposed PID. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements Growth & Physical Development Policy 7.0 of the Century Plan - Policy Plan Element, which states: "Georgetown's land uses support economic, cultural and social activities for all residents, businesses and organizations; and the City's development process encourages new and infill development"; and Finance Policy 5.0 of the Century Plan - Policy Plan Element, which states: "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both short-term and long-term needs are provided."; and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The City Council of the City of Georgetown hereby formally acknowledges receipt of the aforementioned Petition and directs the City staff to perform a feasibility study to determine the feasibility of the improvements proposed in the Petition. SECTION 3. There is hereby created the Georgetown Village Public Improvement District #1 Advisory Board (the "Board"), whose purpose shall be to develop and recommend an improvement plan to the City Council of the City of Georgetown. The Georgetown Village Public Improvement District Resolution No. �809-S-S Page 1 of 2 Board shall be composed of the following representatives of the petitioners named in the Petition; petitioners being the owners of all of the taxable real property within the PID and the record owners of all the real property liable for assessment within the PID: Jim Mills Laura Naiser Mike Cook Tom Roughton The following representatives of the City of Georgetown, Texas, shall also serve as members of the Board: Randy Morrow, Director of Parks & Recreation Susan Morgan, Director of Finance & Administration Bob Hart, City Manager SECTION 4. The City staff is directed to assist the Board in preparing an improvement plan and to determine the schedule for the proposed impriovements. SECTION 5. A public hearing on the advisability of the proposed improvements shall be held before the City Council of the City of Georgetown, Texas, on the 27th day of October, 1998, and the City Secretary is hereby directed to give proper notice of same as required by Section 372.009 of the Texas Local Government Code. Civil Statutes, respectfully petition the Mayor and the City Council for the establishment of the Georgetown Village Public Improvement Assessment District #1 (the "PID"), and WHEREAS, the undersigned property owners are the majority property owners within the area to be included within the proposed district, NOW THEREFORE In support of said petition, Petitioners would show unto the City Council the following: 1. General Nature of Prosed Improvements. The Proposed Improvements shall consist of: a) a Maintenance Assessment; A perpetual assessment for the administration and maintenance of park facilities, recreational facilities, landscaping, lighting, open spaces, pedestrian alleyways, signage and other related amenities, said Maintenance Assessment to supplement the normal city operations and maintenance of said park facilities, recreational facilities, landscaping, lighting, open spaces, pedestrian alleyways, signage, and other related amenities; and b) a Capital Improvement Assessment; A one-time assessment for the acquisition and construction of park facilities, recreational facilities, landscaping, lighting, open spaces, pedestrian alleyways, signage and other related amenities, said Capital Improvement Assessment to reimburse the Petitioners or its assigns for the acquisition and construction costs of said park facilities, recreational facilities, landscaping, lighting, open spaces, and other related amenities. h>e.5. 9g0922 -ss Exh/6%7'- 11 /0 107' �/ 2. Estimated Costs of Improvements. a) Maintenance Assessment; The estimated costs of the Maintenance Assessment shall be an annual, per lot assessment, including improvements, of $0.15 per $100 assessed valuation, as . determined by the Williamson County Appraisal District. b) Capital Improvement Assessment; The estimated cost of the Capital Improvement Assessment shall be $1,000 per lot, due and payable at time of recordation of final plat. 3. Boundaries of the Proposed Assessment District. The boundaries of the proposed assessment district are described in Exhibit "A", attached hereto and incorporated herein. 4. Proposed Method of Assessment. a) Maintenance Assessment The proposed method of assessment for the Maintenance Assessment shall be based upon the annual, assessed value of each lot. The assessment on each lot shall commence on January 1 of the first year after said lot is part of a final, recorded subdivision plat. b) Capital Improvement Assessment The proposed method of assessment for the Capital Improvement Assessment shall be a one-time assessment of $1,000 per lot, payable in full upon the recordation of the final subdivision plat. 5. Management of District. The Proposed District shall be managed by a board consisting of five (5) members chosen by the City Council of Georgetown, Texas, three (3) of which shall be owners of real property within the PID. 6. Concurrence of the Establishment of the District. All of the undersigned request and/or concur with the establishment of the Georgetown Village Public Improvement Assessment District #1. ;fes. 9g0 922 -SS Exhibit 1 �k Z off' 2 7. Establishment of an Advisory Body. An advisory body may be established, pursuant to Article 372.008, to develop and recommend an improvement plan to the City. The Advisory Body may contain the same members of the board in Section 5, above. 8. Apportionment of Costs a) Maintenance Assessment; The costs of the Maintenance Assessment shall be borne entirely by the platted lots within the boundaries of the PID. The Maintenance Assessments shall be placed in a special fund which shall be used to operate and maintain the parklands and other recreational amenities consistent with the quality and character of the subdivision, and as a supplement to city Parks and Recreation funds normally expended on the parklands and other amenities within the PID. b) Capital Improvement Assessment; The costs of the Capital Improvement Assessment shall be borne entirely by the platted lots within the boundaries of the PID. The Capital Improvement Assessment shall be a one-time assessment on each lot in the subdivision, due when the subdivision plat in which the lot is located is recorded. All Capital Improvement Assessments collected shall be placed into a special fund, which shall be used to pay Petitioner or its assigns for any costs incurred for the construction of recreational capital improvements within the PID, or to repay any debts incurred for the construction of recreational capital improvements within the PID, or as a supplement to any city funds normally expended for the construction of recreational capital improvements within the PID.
