[A] 105.6.30 Open burning. An operational
permit is required for the kindling or maintaining of an open fire or a fire on any public street, alley, road, or other public or private ground. Instructions and stipulations of the
permit shall be adhered to. OPERATIONAL PERMITS FOR RECREATIONAL FIRES WILL BE ISSUED ON AN ANNUAL BASIS. PERSONS WHO ARE ISSUED AN OPERATIONAL PERMIT MAY HAVE THE PERMIT REVOKED IN
THE CASE OF NOT ADHERING TO THE GUIDELINES OF THE OPERATIONAL PERMIT FOR A PERIOD OF UP TO 24 MONTHS.
Exception: Recreational Fires. DELETE EXCEPTION.
Reason: This code change will
allow oversight of recreational fires through the use of operational permits. This will improve safety and reduce property loss.

[A] 108.1 Board of appeals established.
In order to hear and decide appeals of order, decisions or determinations made by the fire code official relative to the application and interpretation of this code , there shall be
and is hereby created a board of appeals. The board of appeals shall be appointed by the governing body and shall hold office at its pleasure. The fire code official shall be an ex officio
member of said board but shall have no vote on any matter before the board. The board shall adopt rules of procedure for conducting its business, and shall render all decisions and findings
in writing to the appellant with a duplicated copy to the fire code official. SHALL BE REFERENCED AS THE BUILDING STANDARDS COMMISSION.
Reason: This code change proposal establishes
the referenced name given to the board of appeals appointed by the governing body.

TO THIS MATTER.

108.4 ADMINISTRATIVE
APPEAL. WHENEVER A VIOLATION OF THIS CODE HAS BEEN FOUND AND THE APPLICANT WISHES TO APPEAL THE DECISION OF THE STAFF BECAUSE OF CODE INTERPRETATION, OR UNREASONABLE HARDSHIP, AN APPEAL
MAY BE FILED TO THE FIRE CODE OFFICIAL OR AN AUTHORIZED REPRESENTATIVE, AS FOLLOWS:
1. AN APPEAL SHALL BE FILED IN WRITING TO THE GEORGETOWN FIRE DEPARTMENT, FIRE AND LIFE SAFETY DIVISION.
2.
THE FIRE CODE OFFICIAL OR AN AUTHORIZED REPRESENTATIVE WILL HEAR THE APPEAL WITHIN 10 WORKING DAYS OF THE RECEIPT OF THE APPEAL.
3. ADEQUATE INFORMATION SHALL BE PROVIDED BY THE APPLICANT
ON THE PETITION OF APPEAL TO FULLY DESCRIBE THE CONDITION(S) IN QUESTION.
4. THE FIRE CODE OFFICIAL, OR AN AUTHORIZED REPRESENTATIVE, MAY USE A HEARING COMMITTEE CONSISTING OF SUCH STAFF
AS IS DEEMED APPROPRIATE TO PROVIDE ADVICE ON A PARTICULAR APPEAL.
5. THE APPLICANT MAY, BUT IS NOT REQUIRED TO, MEET WITH THE FIRE CODE OFFICIAL, OR A DESIGNATED REPRESENTATIVE, TO
DISCUSS THE APPEAL.
6. IF THE APPEAL IS DENIED, THE APPLICANT SHALL COMPLY WITH THE
REQUIREMENT(S) OF THE FIRE CODE OR FILE AN APPEAL TO THE BOARD OF
APPEALS AS PROVIDED IN SECTION 108.1

[A] 109.4 Violation Penalties. Persons
who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved
construction documents or directive of the fire code official, or of a permit or certificate used under provisions of this code, shall be guilty of a [MISDEMEANOR], punishable by a fine
of not more than [TWO THOUSAND] dollars or by imprisonment not exceeding [NUMBER OF DAYS], or both
such fine and imprisonment. Each day that a violation continues after due notice has
been served shall be deemed a separate offense.
Reason: This code change proposal is to insert the penalties for violations to the provisions of this code. The code does not establish
penalties for violations.

Smoke Alarm.
A single-or multiple-alarm responsive to smoke THAT HAS DUAL SENSOR CAPABILITIES (IONIZATION AND PHOTOELECTRIC). See also “Single-station Smoke Alarm” and “Multiple-Station Smoke Alarm.”
Reason: The reason for the code change proposal is single- and multiple-station smoke alarms have evolved as one of the most important fire safety features in the residential and
similar occupancies having sleeping occupants. The value of early fire warning in these occupancies has been repeatedly demonstrated in fires involving both successful and unsuccessful
smoke alarm performance. Studies have shown both ionization and photoelectric smoke alarms to activate proficiently during a flaming fire, whereas the photoelectric smoke alarm has
been proven to activate quicker to a smoldering fire. This code change proposal would increase safety and reduce property loss.
Cost Impact: The code change proposal may increase
the cost of construction by 0 to 10 dollars per smoke detector depending on the unit that is chosen.

307.4.1 Bonfires. A bonfire shall not
be conducted within 50 feet (15,240mm) 100 FEET (30,480mm) of a structure or combustible material unless the fire is contained in a barbecue pit. Conditions which could cause a fire
to spread within 50 feet (15,240mm) 100 FEET (30,480mm) of a structure shall be eliminated prior to ignition.
Reason: The reason for this code change proposal is bonfires are usually
large and associated with some kind of planned event. This change will improve safety and reduce the potential for property loss.
Cost Impact: The code change proposal will not
increase the cost of construction.

Reason: The reason for this code change proposal is to manipulate traffic signals in the path of emergency vehicles, stopping conflicting
traffic and allowing the emergency vehicle right of way, to reduce response times and enhance traffic safety.
Cost Impact: This code change proposal could add an additional $2,500.00
up to $10,000.00 to the cost of construction dependent on the type of preemptive control equipment required.

water supply capable of supplying the required fire flow for fire protection shall be provided to premises upon which facilities, buildings or portions of buildings are hereafter constructed
or moved into or within the jurisdiction. WHERE PROPERTY IS SUBDIVIDED WITH OR WITHOUT THE CREATION OF PUBLIC OR PRIVATE STREETS FOR THE EXPRESSED
PURPOSE OF PROVIDING SAID SUBDIVIDED
PARCELS FOR SALE OR OTHERWISE
PERMITTING SEPARATE AND/OR INDIVIDUAL DEVELOPMENT TO OCCUR, AN APPROVED WATER SUPPLY CAPABLE OF SUPPLYING THE PROJECTED FIRE FLOW FOR FIRE PROTECTION SHALL
BE PROVIDED AND EXTENDED TO SERVE DIRECTLY ANY AND
ALL SUBDIVIDED PROPERTIES. THE PROJECTED FIRE FLOW WILL BE BASED ON THE
GREATEST POTENTIAL DEMAND POSED BY ANY TYPE OF OCCUPANCY ALLOWED
BY
ZONING LAWS ON THE PROJECTED PROPERTY.
EXCEPTION: ADDITIONS TO EXISTING AND NEWLY CONSTRUCTED ONE- AND TWO-FAMILY HOMES LOCATED IN AREAS HAVING SUBSTANDARD WATER SUPPLIES, WHERE
THE DEVELOPMENT OF FULL FIRE-FLOW IS IMPRACTICAL, SHALL COMPLY WITH THE PROVISIONS OF APPENDIX B SECTION B103 WITH THE APPROVAL OF THE FIRE CODE OFFICIAL.
Reason: The reason for
this code change proposal is to assure that adequate fire protection water be provided to premises upon which new buildings are constructed or onto which a building is moved, from either
outside of the jurisdiction or another location within the jurisdiction.
Cost Impact: The code change proposal could add an increase to the cost of construction based on the potential
demand posed by the type of occupancy allowed by the UDC.

507.3 Fire flow. Fire flow requirements
for buildings or portions of buildings and facilities shall be
determined by an approved method AND IN ACCORDANCE WITH APPENDIX B.
Reason: The reason for this code change proposal
is APPENDIX B provides a tool for jurisdictions to establish a policy for fire-flow requirements. The determination of required fire flow is not an exact science, but having some level
of information provides a consistent way of choosing the appropriate fire flow for buildings throughout a jurisdiction.

507.5 Fire hydrant systems. Fire hydrant
systems shall comply with Sections 507.5.1 through 507.5.6 8 AND APPENDIX C.
Reason: Fire hydrants are one of the primary ways to access water for fighting fires. The location and
spacing of hydrants is important to the success of fire-fighting operations. The difficulty with determining the spacing of fire hydrants is that every situation is unique and has unique
challenges. Finding one methodology for determining hydrant spacing is difficult. This particular appendix gives on methodology fire departments can work with to set a policy for new
building and facilities.

REFLECTIVE PAVEMENT MARKERS. ALL FIRE HYDRANTS SHALL BE IDENTIFIED
BY THE INSTALLATION OF APPROVED BLUE REFLECTIVE PAVEMENT MARKERS.
Reason: Fire hydrants are one of the primary
ways to access water for fighting fires. Plants and shrubs on public or private property are probably the most common object that can make fire hydrants virtually invisible to responding
fire apparatus engineers. Placement of reflective pavement markers would allow for quick recognition of fire hydrant locations during nighttime conditions.
Cost Impact: The code
change proposal would increase the cost of construction due to the cost associated with the reflective pavement markers. Reflective pavement markers vary in price from $2.00 - $3.00
per reflector.

$500.00 - $1,000.00 for an exterior door if required by the fire code official.

AMENDED.
A PERSON OR ENTITY THAT OWNS OR POSSESSES AN AUTOMATIC EXTERNAL DEFIBRILLATOR. VENDORS OR DEALERS THAT OWNS POSSESSES AEDs SOLELY FOR RESALE ARE NOT INCLUDED AS OWNERS FOR
THE PURPOSES OF THIS ORDINANCE.
Reason: The reason for this code change proposal is to define the automated external defibrillator (AED) and person or entity that owns or possesses
an automated external defibrillator (AED).
Cost Impact: This code change proposal will not increase the cost of construction.
