WHEREAS, the City of Georgetown has, and continues to experience, considerable development within its extra territorial jurisdiction, and ; WHEREAS, the need to provide adequate public infrastructure and especially utility services is of great public importance, and; WHEREAS, the City has entered into agreements with the adjacent water utility providers in and around the City, specifically Chisolm Trail Special Utility District and Jonah Special Utility District, and; WHEREAS, the policy established by the Georgetown City Council will provide direction on the future growth and development of the community, and; WHEREAS, at their regular meeting of November 9, 1999 the City Council did consider this item, and; WHEREAS, the Georgetown City Council at said meeting provided direction on establishment of a policy for addressing development within the Extra Territorial Jurisdiction; i W, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF H CITY OF t ' i SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Policy Plan Element: Economic Development Policy 1.0 "Georgetown's economy is self - sustaining through diversified growth, a broad tax base with minimal impact from economic fluctuation, enhanced business opportunity and job creation" Facilities and Services Policy 4.0 "The City provides for the safety of its citizens and supports the responsive delivery of coordinated services by the City and other public agencies" Development Agreement Policy Resolution No. r Page 1 of 3 Growth and Physical Development Policy 7.0 " Georgetown's land uses support economic, cultural and social activities for all residents, businesses and organizations: and the City's development process encourages new and infill development "; and, further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The Council hereby establishes a policy to guide development within the Extra Territorial Jurisdiction of the City of Georgetown, Texas, that: I. Insures that the needs of the City and property owner/ developer of the project to which this policy applies are adequately addressed t is also the City's policy to enter into development agreements with the developer of projects within the City's Extra Territorial Jurisdictions, when and where there is a need to address development issues that fall outside the City's normal approach to approving de elment. Such development agreements will address the items set out in A through C ` as well as any other special circumstances that may arise for a given project. As a genera policy, the City is not receptive t=or supportive of the creation, formation, establishment, or operation of any Municipal Utility District (MUD) within the Extra Territorial Jurisdiction of the City. Nor will the City look to participate in providing services to any such Municipal Utility District. However, where the creation of a special district would serve the public interest and be of benefit to the community, the City would consider and assist with the creation of a Public Improvement District (PID). Any such PID shall be designed to address the public infrastructure and utility needs of the area and make provisions for the City of Georgetown to be a major participant in the design, creation and operation of the PID. B. In those areas that lie outside of Georgetown's developed wastewater service area ` e, the City will explore and support ways to make available an organized public wastewater system for the development. Even where the City of Georgetown does not provide any other utility service such as water or electric service , the City will nevertheless support the creation of organized wastewater collection systems. It is the City's policy to be an active participant in the permitting, design, construction, and operation of any such facilities. Furthermore, it is the City's preference that the City of Georgetown be the owner and operator of these facilities. Development Agreement Policy Resolution No. Page 2 of 3 C. The City recognizes that as the community continues to grow and expand that the need for significant investment in transportation infrastructure will be critical to the long term success and livability of our community. To this end it is the City's policy to insure that transportation needs precipitated by new development are addressed. The City's practice of collecting transportation fees where new development seeks City participation and support for providing or operating necessary public services such as water, wastewater, and fire protection will be continued. Because of the interconnectedness of the issues of utility service and transportation as integral components for supporting growth and development, W the collection of transportation fees to fund necessary t r a n s p o r t a t i o n improvements is of paramount public importance. SECTION 3. This resolution shall be effective immediately upon adoption. RESOLVED this day of be6el�4-e-r 1999.
