HomeMy WebLinkAboutRES 030601-KRESOLUTION i A RESOLUTION AMENDING AND RESTATING RESOLUTION NO. 021301-CC-2 A RESOLUTION OF THE CITY COUNCIL OF GEORGETOWN, TEXAS, ORDERING A SPECIAL ELECTION IN GEORGETOWN, TEXAS TO BE HELD IN CONJUNCTION WITH THE GENERAL ELECTION ON MAY 5, 2001, FOR THE PURPOSE OF SEEKING VOTER RESPONSE TO THE QUESTION OF INCREASING THE SALES TAX IN THE CITY OF GEORGETOWN BY ONE -HALF OF ONE PERCENT WHEREAS, the Georgetown City Council has called a General Election for Saturday, May 5, 2001; and WHEREAS, the Georgetown City Council has been provided with a recommendation from the Georgetown Citizens' Committee on Community Needs and Funding that the proposition should be put to the voters of Georgetown as to whether the sales tax should be increased by one -half of one percent to support the City's on -going transportation issues; and WHEREAS, the Georgetown City Council hereby finds that an election should be held for the purpose of submitting a proposition on the levy and collection ofan additional sales and use tax within the City under the provisions of Section 4B of Article 5190.6 V.T.C.S. ( "the Act "); and WHEREAS, the Georgetown City Council firther determines that the City is an eligible City under the provisions of the Act, in that the City would be eligible to adopt a Section 4A sales and use tax pursuant to the Act; and WHEREAS, on February 13, 2001, the Georgetown City Council approved Resolution No. 021301 -CC -2 "A Resolution of the City Council of Georgetown, Texas, Ordering a Special Election in Georgetown, Texas to Be Held in Conjunction With the General Election on May 5, 2001, For the Purpose of Seeking Voter Response to the Question of Increasing the Sales Tax in the City of Georgetown by One -Half of One Percent;" and WHEREAS, the Georgetown City Council is hereby amending and restating such resolution to incorporate the proposition language and other details of the election. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT Section 1 - Verification of Facts. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council has found that this action implements Governmental Affairs Focus End 15.01 of the Century Plan - Policy Plan Element, which states: "All citizens actively participate in governmental functions."; and has found that this action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. Section 3 - Election. A special election shall be held for the purpose of submitting a proposition on the levy and collection of an additional sales and use tax within the City under the provisions of the Act. The election shall be held on the 5th day of May, 2001, in the City of Georgetown, Texas, which date is not less than forty -five (45) days from the date of the adoption of this resolution, and is a uniform election date pursuant to the Election Code, Section 41.001. Section 4 - Polling Locations and Election Judges. The election shall be held at the following polling places which shall be open from 7:00 a.m. to 7:00 p.m. on election day. POLLING PLACE A Georgetown Public Library 808 Martin Luther King Boulevard for voters residing in City Single - Member Districts 1, 2, 3, 6 and 7 POLLING PLACE B Georgetown Independent School District Tax Office 603 Lakeway Drive for voters residing in City Single- Member Districts 4 and 5 Presiding Judge, Karen Yost Alternate Presiding Judge, Dennis Yost Presiding Judge, Elaine Roth Alternate Presiding Judge, Noel Pittman, Jr. Section 5 - Election Judges, Clerks and Early Voting Ballot Board. A. Each of the respective presiding judges is hereby authorized to appoint the necessary election clerks (not less than 2 and not more than 6) to assist in conducting the election. However, if the Presiding Judge appointed actually serves, the Alternate Presiding Judge shall serve as one of the clerks. The appointment of such clerks must include a person fluent in the Spanish language to serve as a clerk to render oral aid in the Spanish language to any voter desiring such aid at the polls on the day of the election. In the absence of the Presiding Judge named above, the Alternate Presiding Judge shall perform the duties of the Presiding Judge. B. An early voting ballot board is hereby created to process early voting results, and Dale Efflandt is hereby appointed the Presiding Judge of the board and Bette Efflandt is the Alternate Presiding Judge. ZD FOR [ ] THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX WITHIN THE CITY AT THE RATE OF ONE -HALF (' /z) OF ONE PERCENT AS AUTHORIZED BY SECTION 413, ARTICLE 5190.6, V.T.C.S., AS AMENDED, WITH THE PROCEEDS THEREOF TO BE USED AND APPLIED FOR PROJECT COSTS FOR STREETS, ROADS, DRAINAGE AND OTHER RELATED TRANSPORTATION SYSTEM IMPROVEMENTS, INCLUDING THE PAYMENT OF MAINTENANCE AND OPERATING EXPENSES ASSOCIATED WITH SUCH AUTHORIZED AGAINST [ ] PROJECTS. This election shall be held and conducted in accordance with the provisions of the Election Code and the Tax Code, Subchapter E of Chapter 321, and the Act and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. Section 9 -Notice of Election. A substantial copy of this resolution shall serve as proper notice of the election. The notice, including a Spanish translation thereof, shall be posted not later than the 21 st day before the election on the bulletin board used for posting notices of meetings of the City Council and shall also be published at least once not earlier than the 30th day nor later than the 10th day before the election in a newspaper published and of general circulation in the City. Section 10 - Conflicts and Severability. A. This resolution shall be effective immediately upon adoption. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this resolution shall not invalidate other sections or provisions thereof. Section 11 - Results. The Williamson County Voter Registrar shall conduct an unofficial tabulation of results after the closing of the polls of the General Election on May 5, 2001. The official canvass and tabulation of the results of the Special Election shall be conducted by the Georgetown City Council at a Special Council Meeting on Tuesday, May 8, 2001, at 6:OOp.m. in conjunction with the canvass and tabulation of the results of the General Election. 1 �;, The Presiding Judge shall appoint not less than two nor more than five resident qualified electors of the City to serve as members of the Early Voting Ballot Board. C. Election Officials shall be compensated at a rate of $6.00 per hour for hours spent in training as well as those hours spent while on duty on Election Day. Officials who deliver the ballots and election supplies to the County Courthouse after the closing of the polls on Election Day shall be compensated an additional flat fee of $25.00 over the hours ly rate for their service. Section 6 - Early Voting. A. The Williamson County Voter Registrar, John Willingham, is hereby appointed as Clerk for Early Voting. The deputy early voting clerks are Sammye Bryant, Diane Sansom and Merrill Person. Early voting by personal appearance shall take place at the Williamson County Courthouse, 710 Main Street, Georgetown, Texas, and Branch Early Voting by personal appearance will take place at the Georgetown Independent School District Administration Building, 603 Lakeway Drive, Georgetown, Texas. Each location will remain open during normal business hours (8:00 a.m. to 5:00 p.m.) each day specified for early voting, which is not a Saturday, a Sunday, or an official state holiday, beginning on the 17" day preceding the date of the election, which is Wednesday, April 18, 2001, and continuing through the 01 day preceding the date of the election, which is Tuesday, May 1, 2001. Early voting shall also be conducted on Saturday, April 21, 2001, from 9:00 a.m. to 1:00 p.m. and on Saturday, April 28, from 1:00 p.m. to 5:00 p.m. at the Main Early Voting Location at the Williamson County Courthouse, 710 Main Street, Georgetown, Texas. B. Applications for ballot by mail shall be mailed to: John Willingham Williamson County Elections Administrator P.O. Box 209 Georgetown, Texas 78627 -0209 Section 7 - Voting Devices. Electronic optical scan voting devices may be used in conducting the election. The City may also utilize a central counting station as provided by Section 127.000 et seq., as amended, Texas Election Code and the Williamson County Voter Registrar is designated the manager of such station. Section 8 - Proposition and Ballot. The official ballots for the election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the following PROPOSITION with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: 200 1.
