O a 05 007 — G A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY OF GEORGETOWN SPECIAL ELECTION HELD ON FEBRUARY 2, 2002 WHEREAS, the City Council of the City of Georgetown, Texas ordered an election to be held on Saturday, February 2, 2002, for the purpose of the following: To determine whether to recall the Mayor of the City of Georgetown and the Councilmembers from City of Georgetown Single- Member Districts 1, 2, 5, and 6. WHEREAS, the City Council has investigated all matters pertaining to said election, including the ordering, giving notice, holding and making returns of said election; and WHEREAS, the election officers who held said election have prepared the returns of the results thereof, and the returns have been delivered to the City Council; and cast: WHEREAS, it appears from the returns, duly and legally made, that the following votes were SHALL MARYELLEN KERSCH, MAYOR OF THE CITY OF GEORGETOWN, BE RECALLED FROM THE OFFICE OF MAYOR? Yes 3033 No 2203 SHALL LLORENTE NAVARRETTE, COUNCILMEMBER FOR DISTRICT 1, OF THE CITY OF GEORGETOWN, BE RECALLED FROM THE OFFICE OF COUNCILMEMBER FOR DISTRICT 1? Yes 62 No 145 SHALL CLARK LYDA, COUNCILMEMBER FOR DISTRICT 2, OF THE CITY OF GEORGETOWN, BE RECALLED FROM THE OFFICE OF COUNCILMEMBER FOR DISTRICT 2? Yes 403 No 414 SHALL CHARLES "HOSS" BURSON, COUNCILMEMBER FOR DISTRICT 6, OF THE CITY OF GEORGETOWN, BE RECALLED FROM THE OFFICE OF COUNCILMEMBER FOR DISTRICT 6? Yes 111 No 208 WHEREAS, it appears from said returns, duly and legally made, that the voters have made the following decisions: MaryEllen Kersch shall be recalled from the Office of Mayor of the City of Georgetown, Texas. Llorente Navarrette shall not be recalled from the Office of Councilmember for District 1 of the City of Georgetown, Texas. Clark Lyda shall not be recalled from the Office of Councilmember for District 2 of the City of Georgetown, Texas. Sam Pfiester shall not be recalled from the Office of Councilmember for District 5 of the City of Georgetown, Texas. Charles "Hoss" Burson shall not be recalled from the Office of Councilmember for District 6 of the City of Georgetown, Texas. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS, that: SECTION I. The City Council officially fmds and determines that the election was duly called; that proper notice of the election was given in accordance with law; that the election was held in accordance with law; that returns of the results of the election have been made and delivered, and that the City Council has canvassed the returns, all in accordance with the law and the resolution calling the election. The City Council officially finds and determines that MaryEllen Kersch was recalled from the office of Mayor for the City of Georgetown. The City Council officially finds and determines that Llorente Navarrette was not recalled from the office of Councilmember for District 1 for the City of Georgetown. The City Council officially finds and determines that Clark Lyda was not recalled from the office of Councilmember for District 2 for the City of Georgetown. The City Council officially finds and determines that Sam Pfiester was not recalled from the office of Councilmember for District 5 for the City of Georgetown. The City Council officially finds and determines that Charles "Hoss" Burson was not recalled from the office of Councilmember for District 6 for the City of Georgetown. SECTION III. It is further found and determined that in accordance with the order of this governing body, the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located outside of City Hall/Council Chambers, a place convenient and readily accessible to the general public, and said notice was posted and remained posted continuously for at least 72 hours preceding the scheduled time of the meeting. A copy of the posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. PASSED, AND APPROVED, on this 5th day of February, 2002.
