Approved 7-0 Public Wishing to Address Council On a subject that is posted on this agenda: Please fill out a speaker registration form which can be found on the table at the entrance to the Council Chamber. Clearly print your name and the letter of the item on which you wish to speak and present it to the City Secretary on the dais, preferably prior to the start of the meeting. Approved 7-0 Legislative Regular Agenda H Consideration and possible direction to staff regarding potential Special Financing & Development Districts for projects located outside of the City Limits within the South San Gabriel River basin area -- Micki Rundell, Chief Financial Officer and Andrew Sprugin, Planning Director Spurgin said staff received the direction they needed at the Workshop held earlier in the day. There was no action taken. I Public Hearing and First Reading of an Ordinance for Rezoning of River Hills, Section One, Block A, Lots 18 (Npt) and 19, from Local Commercial (C-1) District and Residential Single-family (RS) District to Office (OF) District, located at 101 River Hills Drive -- Carla Benton, Planner and Andrew Spurgin, AICP, Planning Director (action required) Spurgin said this is a rezoning to Office (OF) and said this is currently used by the Century 21. He said this is less impactful than some of the potential uses with the C-1 zoning. He noted staff has not received any comments and Planning and Zoning recommends approval. He read only the caption of the Ordinance on first reading after having satisfied the requirements of the City Charter. Public Hearing was opened at 6:17PM No persons were present to speak Public Hearing was closed at 6:17PM Motion by Hammerlun, second by Hesser to approve. Approved 7-0 J Public Hearing and First Reading of an Ordinance for Rezoning in the Joseph Thompson Survey of 5.787 acres, being 4.558 acres from Agriculture (AG) District and Local Commercial (C-1) District to Residential Single-family (RS) District and 1.229 acres from Agriculture (AG) District and Residential Single-family (RS) District to Local Commercial (C-1) District, located on the north side of FM 2243 approximately 1000 feet southwest of the intersection of Riverview Drive and FM 2243 -- Carla Benton, Planner and Andrew Spurgin, AICP, Planning Director (action required) Spurgin described the item and said this zoning is a cleanup of the existing boundaries. He showed Council a before and after picture of the proposed zoning. He said, compared to the existing zoning, under this request the C-1 zoning is shrinking and single family is increasing by 3.6 acres. He said they have received a few comments from the residents concerned with the connectivity in the area. He read only the caption of the Ordinance on first reading after having satisfied the requirements of the City Charter. Approved 7-0 K Public Hearing and First Reading of an Ordinance for Rezoning of 29.079 acres in the William Roberts Survey, from Agriculture (AG) District to Planned Unit Development with a Residential Single-family (RS) base District, to be known as The Arbors at Georgetown Village, located on Shell Road north of the Sycamore Drive intersection -- Carla Benton, Planner and Andrew Spurgin, AICP, Planning Director (action required) Spurgin described the item and said this is a continuation of the build out of Georgetown Village. He said the PUD is a requirement of the concept plan and each phase has been developed using PUD zoning. He said there is a traffic impact analysis underway. He said Planning and Zoning heard this item and there was a speaker who expressed concerns about the traffic on Shell Road. He said Planning and Zoning and staff recommends approval. He read only the caption of the Ordinance on first reading after having satisfied the requirements of the City Charter. Public Hearing was opened at 6:23PM Speaker, Cheryl Welch spoke about her concern with the growth of Georgetown Village and its effect on the speed and traffic on Shell Road. She expressed her concern about the school in the area and the safety of children and parents going to and from that area. She said she and the other residents are not against the rezoning but noted the traffic concerns should be addressed concurrently with this rezoning request. Speaker, William Kettlewell, said he is not against development of Georgetown Village. He said he wants to see that plan carried out in a thoughtful manner. He said the traffic and speed concerns in the area need to be addressed. He continued to describe his recommendations on how to move forward with these issues. Speaker, Karen Kettlewell, also expressed similar concerns as the previous two speakers. She spoke about how dangerous it is becoming in that area for pedestrians and bike traffic. She said the speed is a serious issue that needs to be addressed. Public Hearing was closed at 6:23PM Motion by Fought, second by Hesser to approve the Ordinance. Brainard asked for status of the road improvements and Shell Road. Polasek said the City did a warrant study for the traffic signals in the area and spoke about where signals were warranted and where they were not. He said the speed study showed that the actual speed limit could be raised to 55 in the area but staff chose to keep it at 50 along that section of Shell Road. He said the speed will remain that way unless another study shows they can lower the speed. Brainard asked and Polasek said there will be a light at Shell Road and Bell Aire before the next school year. Brainard said he finds it hard to believe that the average speed is 55 in this area. Polasek said we set the speed based on how fast people are actually going. Brainard said we need to investigate that methodology. Fought asked and Polasek said, the more driveways, the lower the speed. Fought said he has driven this road and he said he thinks people drive too fast on it. Hammerlun said he agrees with Brainard and said he would like to investigate the methodology for determining speed. He asked and Chapman spoke about the status of the Madrid Improvement Project. Chapman said the County should have the project completed by the start of school. Hammerlun asked and Polasek said the Traffic Impact Analysis does not address the speed issue. There was much discussion regarding the proposed and current transportation projects in the area. He said he will vote in favor of this rezoning request. He said, when they were taking about the Creekside element, one of the positives is it will provide a secondary access onto Shell Road out of Creekside. There were many questions. Jonrowe asked and Polasek said the plan is to widen Shell and that will also include sidewalks. Jonrowe said she also has issues with the methodology behind determining speed limits. She noted the City should have a standard, but maybe not the one it is currently using. Dryden spoke about the default speed limits and how they are determined. Gonzalez asked about ways to lower the speed limit and Polasek spoke about the danger of lowering speeds without the protection of a methodology or speed study. There was much discussion about determining speed. Vote on the motion: Approved 7-0 L Second Reading of an Ordinance amending Chapter 10 of the Code of Ordinances related to vehicles and traffic by adding photographic enforcement and administrative adjudication of school bus stop arm violations —Wayne Nero, Chief of Police and Bridget Chapman, City Attorney (action required) Nero described the item and spoke about the changes that have been made to the Ordinance since the First Reading. He said the change adds a step system for the fines. Staff addressed the question of when the videos are considered open records. Nero read only the caption of the Ordinance on second reading. Motion by Jonrowe, second by Fought to approve. There was some discussion and clarification on how the fines would work. Vote on the motion: Approved 7-0 M Second Reading of an Ordinance creating "Assignment Pay" for certain assignments within the Fire Department, repealing all ordinances or parts of ordinances in conflict therewith, providing a severability clause, finding and determining that the meetings at which the Ordinance is passed are open to the public as required by law and providing an effective date -- John Sullivan, Fire Chief (action required) Sullivan described the item and read only the caption of the Ordinance on second reading. Motion by Jonrowe, second by Hesser to approve. Approved 7-0 Executive Session In compliance with the Open Meetings Act, Chapter 551, Government Code, Vernon's Texas Codes, Annotated, the items listed below will be discussed in closed session and are subject to action in the regular session.
