A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS ( "CITY ") AUTHORIZING A MULTIPLE
USE AGREEMENT ( "MUA ") WITH THE TEXAS DEPARTMENT
OF TRANSPORTATION ( "TxDOT ") CONCERNING THE
CONSTRUCTION OF A SIDEWALK WITHIN THE NORTH
AUSTIN AVENUE (SS 158) RIGHT OF WAY FROM WILLIAMS
DRIVE TO GEORGETOWN HIGH SCHOOL AND CONFIRMING
THE CITY'S INTENT TO MAINTAIN THE SIDEWALK AND
COMPLY WITH THE TERMS OF THE MUA; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the Texas Transportation Commission passed Minute Order
Number 113074, authorizing the State to undertake and complete a highway
improvement generally described as the construction of sidewalks on North Austin
Avenue from Williams Drive to Georgetown High School, called the "Project'; and,
WHEREAS, on November 27, 2012, the City and TxDOT entered into an
agreement to fund design and construction within. the City of Georgetown; and
WHEREAS, North Austin Avenue (SS 158) is under the jurisdiction and control
of TxDOT; and
WHEREAS, the attached Multiple Use Agreement sets out the terms by which
TxDOT will authorize the City to construct a public sidewalk within the rights of way of
North Austin Avenue (SS 158) from Williams Drive to Georgetown High School.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this
resolution are hereby found and declared to be true and correct, and are incorporated
by reference herein and expressly made a part hereof, as if copied verbatim. The City
Council further finds that the adoption of this resolution is not inconsistent or in conflict
with any 2030 Comprehensive Plan Policies.

SECTION 2. The City Council of the City of Georgetown finds it to be in the
best interest of the citizens of Georgetown to enter into the Multiple Use Agreement
attached hereto as Exhibit "A" made a part hereof and the City has no objection thereto.
The City hereby confirms its intent to maintain the subject sidewalk.
SECTION 3. The Mayor is herby authorized to sign this Resolution and the City
Secretary to attest thereto on behalf of the City of Georgetown.
This resolution shall be effective immediately upon adoption.
