I OQ 10 1 A Resolution of the City Council of the City of Georgetown, Texas, Releasing Extraterritorial Jurisdiction territory of approximately 94 acres, located on Westinghouse Road near the former MOKAN right of way, for the Avery North development. WHEREAS, the City of Georgetown, Texas, wishes to release certain real property from its Extraterritorial Jurisdiction (ETJ), and relinquish all ETJ rights in said property for eventual inclusion into the City of Round Rock ETJ; and WHEREAS, Section 42.021 of the Texas Local Government Code establishes the extent of Extraterritorial Jurisdiction of municipalities; and WHEREAS, Section 42.023 of the Texas Local Government Code allows municipalities to reduce the size of their Extraterritorial Jurisdiction (ETJ) and relinquish all ETJ rights in said property by ordinance or resolution; and WHEREAS, the City of Round Rock and City of Georgetown have an approved Interlocal Agreement pertaining the ETJ release and disannexation of certain territory and conditions thereof. Now Therefore, be it resolved by the City Council of the City of Georgetown, Texas: SECTION 1: The foregoing recitals are hereby found to be true and correct and are incorporated herein by reference for all purposes. SECTION 2: That the City of Georgetown hereby agrees to release certain real property from its ETJ, said property being as described and shown on Exhibit "A" attached hereto and made part hereof and incorporated herein. By so doing, the City of Georgetown hereby relinquishes all ETJ rights. SECTION 3: If any provisions of this Resolution or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this Resolution which can be given effect without the invalid provision or application and to this end the provisions of this Resolution are hereby declared to be severable.
