HomeMy WebLinkAboutORD 85-39 - ANXAN ORDINANCE PROVIDING FOR TH' ?XTENSION J BOFOUNDARY LIMITS Y AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF RIVER RIDGE SUBDIVISIONS SECTION TWO A AND TWO B; PARKVIEW'ESTATES SUBDIVISIONS, SECTIONS ONE THROUGH NINE; WESTWOOD PLAZA SUBDIVISION; UNIVERSITY PARK SUBDIVISION SECTION ONE FLOOD PLAIN; THOUSAND OAKS SUBDIVISION SECTION FOUR; RIVER RIDGE SUBDIVISION SECTIONS THREE A, THREE B AND THREE C; CITY OF GEORGETOWN, ONE ACRE TRACT; AND REATA TRAILS UNIT ONE SUBDIVISION; WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMIT OF THE CITY OF GEORGETOWN, TEXAS AND NOT BEING PART OF ANY INCORPORATED AREA; PROVIDING FOR SERVICE PLANS AND SAVINGS CLAUSE. WHEREAS, two public hearings by the City Council of the City of Georgetown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of that certain tract of land located in Williamson County, Texas, known as River Ridge Subdivisions Section Two A and Two B; Parkview Estates Subdivisions, Sections One through Nine; Westwood Plaza Subdivision; University Park Subdivision Section One Flood Plain; Thousand Oaks Subdivision Section Four; River Ridge Subdivision Section Three A, Three B, and Three C; City of Georgetown, one acre tract; and Reata Trails Unit One Subdivision were held, the first being at City Hall on the 12th Day of November, 1985, and the second hearing being at City Hall on the 19th Day of November, 1985. WHEREAS, notices of such public hearings were published according to law in a newspaper having general circulation in the City of Georgetown, Texas, and in the herein described territory to be annexed on the 30th Day of October, 1985 for such hearings, which date is not more than 20 days nor less than 10 days prior to those hearings. WHEREAS,the total coporate area of the City of Georgetown, Texas, on the lst day of January, 1985 was 4561 acres; and WHEREAS, the population of the City of Georgetown,Texas is 1 3, 500 inhabitants; and WHEREAS, all the herein described territory lies within the extra -territorial jurisdiction of the City of Georgetown, Texas; and WHEREAS, the herein described territory lies adjacent and contiguous to the City of Georgetown, Texas; and WEHREAS, the herein described territory contains 299.23 acres; and WHEREAS, the owner of such property has requested annexation by the City of Georgetown; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section 1. The following described land and territory lying adjacent and contiguous to the City of Georgetown, Texas is hereby added and annexed to the City of Georgetown, Texas and said territory hereinafter described shall hereafter be included in the boundary limits of the City of Georgetown, Texas and the present boundary limits of said City at the various points contiguous to the area hereinafter described are altered and amended so as to include said area witin the corporate limits of the City of Georgetown, Texas, to -wit: BEING those certain tracts and parcels of land described in Exhibit A attached hereto and incorporated herein by reference for all purposes. Section 2, he above described territory and ane area so annexed shall be a part of the City of Georgetown, Texas and the property so added hereby shall bear its pro -rata share of the taxes levied by the City of Georgetown, Texas and inhabitants thereof shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Georgetown, Texas; furthermore, said tracts described in Exhibit A shall be served in accordance with the service plan described in Exhibit B attached hereto. Savings Clause If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. EXHIBIT B Plan of Service for Annexation Areas Police Protection Upon annexation the Georgetown Police Department will provide regular and routine patrols in the area as a part of its overall patrol activities. The depart- ment will respond to calls for assistance within their responsibility and jurisdiction. :ire Service Fire service is now being provided to the area and will continue to be provided by the present personnel and equipment of the fire fighting force. Water Service Maintenance of water facilities will be provided upon annexation in accordance with rates, terms, and conditions contained in the Georgetown City Code. Sewer Service Maintenance of wastewater facilities will be provided upon annexation in accordance with rates, terms, and conditions contained in the Georgetown City Code, Refuse Collection Service will be provided within 60 days of the effective annexation date in accordance with rates, terms and conditions contained in the Georgetown City Code, Inspection Services All inspection services (for example building, electrical, plumbing, etc.) provided by the City will be extended to this area on the effective date of annexation. Planning and Zoning The Planning and Zoning jurisdiction of the City will extend to this area on the effective date of annexation. The zoning will be R -S (Residential Single Family) unless requested otherwise and approved through regular procedures. Streets, Street Lightinq Street lighting will be provided by the City at all intersections. :Streets will be maintained according to Georgetown City Code. .............. . Recreation, Library Services Recreation and library services are currently available to the residents of this tract and will continue to be available upon annexation. Miscellaneous Any other applicable municipal services will be provided to the area in accordance with policies established by the City of Georgetown.
