AN ORDINANCE ABANDONING THAT PORTION OF TWO EASEMENTS AS THEY RELATE TO
THE EAST 1/2 OF BLOCK 34, SNYDER ADDITION, WILLIAMSON COUNTY, TEXAS® SAID
EASEMENTS LOCATED BETWEEN 15th AND 16th STREETS AND BETWEEN THE PENN AND
NK & T RAILROADS KNOWN AS BLOCK 44 IN THE SNYDER ADDITION OF THE CITY OF
GEORGETOWN, TEXAS OR BLOCK 34 AND 36 OF THE SNYDER ADDITION LOCATED IN THE
CITY OF GEORGETOWN AND INTO BLOCK 36 AND 60' INTO BLOCK 34 FROM THE SOUTH
PROPERTY LINE OF BLOCK 34 IN THE SNYDER ADDITION IN GEORGETOWN,- WILLIAMSON
COUNTY, TEXAS AND PROVIDING FOR THE ISSUANCE TO THE CITY OF A 9.5® WIDE
EASEMENT ALONG THE ENTIRE LENGTH OF THE WEST BOUNDARY LINE OF THE EAST 1/2
OF BLOCK 34 FOR THE PURPOSE OF REPAIRING, REPLACING, RESTORING, REMOVING,
RELOCATING AND MAINTAINING EXISTING UTILITY LINES INCLUDING SEWER,
DRAINAGE, WATER PIPING AND ELECTRIC DISTRIBUTION LINES AS MAY BE NECESSARY
FROM TIME TO TIME.
WHEREAS, Brandi Lane Partnership, a Texas General Partnership, is the
owner of the East 1/2 of Block 34, Snyder Addition, a part of which is
affected by the abovementioned easements; and
WHEREAS, said owner has petitioned the City of Georgetown for the
abandonment of said easements as they relate to the East 1/2 of Block 34;

WHEREAS, the City of Georgetown has determined that it does not need
the full easements and rights of way first abovementioned.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Georgetown, Texas, abandon those portions of the easements located between
15th and 16th Streets and between the Penn and & T Railroads known as
Block 44 in the Snyder Addition of the City of Georgetown, Texas or Block
34 and 36 of the Snyder Addition, Williamson County, Texas and into Block
36 and 60' into Block 34 from the South property line of Block 34 in the
Snyder Addition that affect the East 1/2 of Block 34, Synder Addition,
Williamson County, Texas, except that the City has been granted a 9/5'
wide easement along the entire length of the West boundary line of the
East 1/2 of Block 34, Snyder Addition, for the purpose of repairing,
replacing, restoring, removing, relocating and maintaining existing
utility lines including sewer, drainage, water piping and electric
distribution lines as may be necessary from time to time.
BE IT FURTHER ORDAINED that the Mayor of the City of Georgetown is
hereby authorized and directed to execute a Quitclaim deed on behalf of
the City of Georgetown conveying all of said City's rights, titles and
interests in and to said easements which affect the East 112 of Block 34,
SAVE AND EXCEPT a 9/5' wide easement along the entire length of the West
boundary line of the East 1/2 of Block 34, reserving unto the City of
Georgetown, the right of ingress, egress and regress in and to same for
the purpose of repairing, replacing, restoring, removing, relocating and
maintaining existing utility lines including sewer, water, drainage and
electric distribution lineso
PASSED AND APPROVED on this first reading this the day of ,
1985, and to become effective immediately upon such, first reading as such
pass is deemed to be an emergency because its passage is necessary to
preserve and protect public peace, health, safety and the welfare of the
citizens of Georgetown®

QUITCLAIM DEED AND
ARTIAL ABANDONMENT OF EASEMENT
STATE OF TEXAS
§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF WILLIAMSON
WHEREAS, under date of June 26, 1946, H.C. Cluck granted to the City
of Georgetown an easement or right of way recorded in Vol. 336, Page 247,
Deed Records of Williamson County, Texas, through certain lands in
Williamson County, Texas described as follows.
Located between 15th
and 16th Streets
and between
the Penn
and NK&T
Railroads known as
Block 44 in the
Snyder Addition
of
the City of
Georgetown, Texas or Block
34 and 36 of
the Synder
Addition
located in
said City,
said easement covering the power and authority to lay sewer, drainage and
water piping in and through such property subject to the provisions
thereof; and
WHEREAS, under date of December 29, 19472 H.C. Cluck and wife, Emma
J. Cluck, executed an additional easement recorded in Vol. 345, Page 227,
Deed Records of Williamson County, Texas, granted in favor of the City of
Georgetown supplementing and/or modifying the aforesaid easement, the same
granting an easement and right of way in, on and into Block 36 and 60'
into Block 34 from the South property line of Block 34 in the Snyder
Addition in Georgetown, Williamson County, Texas, said easement covering
the right to lay sewer, drainage and water piping thereon subject to the
provisions thereof; and
WHEREAS, Brandi Lane Partnership owns that certain tract of land more
particularly described on Exhibit "A" which is affected by said easement;
and
WHEREAS, Brandi Lane Partnership has petitioned the City of
Georgetown to modify and partially abandon said easement as it relates to
their property only; and
WHEREAS, the City of Georgetown has now determined that it does not
need the full easements and rights of way granted by the aforesaid
instruments.
NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS that the City of
Georgetown, Williamson County, Texas, for and in consideration of Ten and
No/100 ($10.00) Dollars and for the additional consideration of (1)
the reservation to it as set out herein and (2) the grant to said City by
Brandi Lane Partnership, the present owner of the property covered by said
easements, of a more limited easement as hereinafter set forth,
has QUITCLAIMED and by these presents does hereby QUITCLAIM to the said
BRANDI LANE PARTNERSHIP, its successors, assigns and legal representatives
all of its rights, titles and interests in and to said rights of way and
easements as they relate to the East 112 of Block 34 herein above
described, provided, however, that the City of Georgetown does reserve for
itself, its successors and assigns and by joining in the execution hereof
as provided herein, Brandi Lane Partnership does hereby grant unto the
said City of Georgetown, Williamson County, Texas, an easement as follows:
An easement 9.5' wide running along the entire length of the west boundary
line of the East 112 of Block 34 of the City of Georgetown as the same is
described in Volume 821, Page 237 of the Deed Records of Williamson
County, Texas. Said easement including the right of ingress, egress and
regress in and to the same and with authority to lay, maintain, replace,
restore, remove and relocate existing utility lines including sewer,
drainage, water piping and electric distribution lines as may be necessary
from time to time.
TO HAVE AND TO HOLD the aforesaid easement last described to the City
of Georgetown in accordance with the provisions hereof.

Re: Utility Easement on the East one-half
of Block 34 of the Snyder Addition,
Georgetown, Texas
Gentlemen:
The City of Georgetown has one power line located along the West boundary of
the East one-half of Block 34 in the Snyder Addition. .There are no other City
utilities across any portion of the abovementioned one-half block nor do we
anticipate a need to install same. Therefore, the only easement required
across the abovementioned tract will be a 9.5 foot wide utility easement
running along the entire length of the West boundary line of the East one-
half of Block 34 as recorded in Volume 821, Page 237 of the Deed Records
of Williamson County, Texas.
It is, therefore, my recommendation that the easements concerning the East
one-half of Block 34 in the Snyder Addition as recorded in Volume 336, Page
247 and Volume 345, Page 527 of the Deed Records of Williamson County, Texas
be abandoned with the exception of the 9.5 foot wide utility easement running
along the entire length of the West boundary line of the East one-half of
Block 34 of the Snyder Addition, Georgetown, Texas.
