HomeMy WebLinkAboutORD 85-01 - Gateway NW SubdivisionORDINANCE ,: 131 AN ORDINANCE CONDITIONALLY AMENDING THE ZONING ORDINANCE PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, ON THE 12TH DAY OF FEBRUARY, 1968, AMENDING A PART OF THE MAP OF THE ORIGINAL ORDINANCE, TO CHANGE THE PROPERTY HEREIN DESCRIBED FROM RM -2 MULTI -FAMILY, TO C2 -A COMMERCIAL FIRST HEIGHT AND WITH USE REGULATIONS AS HEREIN SET FORTH. WHEREAS, an application has been made to the City Council for the purpose of changing the zoning ordinance on the following described real estate Lot 9, Block "C", Gateway Northwest Subdivision BEING that tract shown as "Proposed C2 -A Commercial First Height10 on Exhibit "A" attached hereto. WHEREAS, the applicant for such zoning change has requested of said City that such change of zoning be made conditioned on use of said tract only for; OFFICE, OFFICE/WAREHOUSE WHEREAS, the City Planning Commission has met and approved the changing of said zoning ordinance on the above descibed property from RM -2 Multi. Family, to C2 -A Commercial First Height, which said meeting was held on the 3rd day of January, 1985, and, WHEREAS, written notice was given to all of the owners of the lots within two hundred, (200), feet of the above described property as required by law; and, WHEREAS, on the 3rd day of January, 1985, the Planning and Zoning Commission recommended approval of the requested change by the City Council of the City of Georgetown, Texas. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Georgetown that the zoning ordinance and the zoning map of the City of Georgetown, be amended so that the property described above shall be and the same is hereby removed from RM -2 Multi -Family to C2 -A Commercial First Height, subject to the condition evidenced by the supplemental application executed by H. W. D. Joint Venture, Gordon M. Davis, authorized agent, dated the 22nd day of January , 19 85 , which is to be recorded in the Official Records of Williamson County, Texas, for notice (1) purposes. Said condition being that if said tract of land described above ever is used for any purpose excepts * OFFICE, OFFICE/WAREHOUSE * And that if any structure is constructed within the 25 foot building setback line established by plat along the northwestern line of said property, then, such zoning shall ipso facto revert to the former zoning of RM -2 Multi Family without the necessity of any action by the Planning and Zoning Commission of the City of Georgetown, and accordingly the zoning ordinance and zoning may designate same. rl� READ AND PASSED AND APPROVED this l day of 19 L r, on the first reading. Davis, of Williamson County, Texas, is the authorized agent of the following described property, to -wit: Lot 9, Block "C", Gateway Northwest Subdivision WHEREAS, said owner has petioned the City of Georgetown for a change in zoning from RM -2 Multi -Family to C2 -A Commercial First Height and, WHEREAS, at the City Council meeting on the 22nd day of January 19 8 5 applicant requested that the,C2-A Commercial First Height classification be given and further assured and represented to the City Council that use of the above described property would be limited to: OFFICE, OFFICE%WAREHOUSE only, and owners further represented to the City Council that should said City Council grant the requested zoning change from RM -2 Multi -Family to C2 -A Commercial First Height that any use other than those listed above upon said tract or any violation of the 25 foot building setback lines established by the plat of said property then would cause the zoning classification of the above described property to ipso facto revert to the former zoning of RM -2 Multi -Family without the necessity of any action by the Planning and Zoning Commission of the City of Georgetown, Texas, and, WHEREAS, the undersigned does hereby manifest his intent that this agreement as to the City Council of the City of Georgetown's passing of the aforesaid change to the zoning of the above described property as herein requested by applicant in return for the undersigned's agreement as to use restrictions and automatic reve:-sion upon use restriction violation as herein described be binding on the undersigned, his heirs, legal represen~ tatives, devisees, assigns and grantees; and, cl) WHEREAS, the City Council of the City of Georgetown did permit such application to be made and thereafter acted favorable on such petition or application for a zoning change; and, WHEREAS, said owners desire to put down in writing said condition subsequent; THEREFORE, KNOW ALL MEN BY THESE PRESENTS that we, the undersigned owners hereby agree as follows: (a) that said application and said zoning change to C2 -A Commercial First Height from RM -2 Multi -Family is further restricted by this agreement that said property will only be used for the following purposes, to -wit: OFFICE, OFFICE/WAREHOUSE (b) that any use except as listed in (a) above upon said tract or any violation of the 25 foot building setback lines established by the plat of said property, shall cause the zoning classification of the property to automatically revert to RM -2 Multi -Family without necessity of any action by the Planning and Zoning Commission of the City of Georgetown, Texas. (c) that this agreement is intended to be and shall be binding on the undersigned, his heirs, legal representatives, devisees, assigns and grantees of the undersigned applicant.
