HomeMy WebLinkAboutORD 86-26 - Amending 1986 BudgetORDINANCE N0. 86-26 AN ORDINANCE OF THE CITY COUNCIL OF GEORGETOWN, TEXAS AMENDING ORDINANCE NO. 85-28 ADOPTED AUGUST 27TH, 1985, WHICH WAS THE ORIGINAL BUDGET OF SAID CITY FOR THE FISCAL YEAR 1985-86 BEGINNING SEPTEMBER 1ST, 1985 AND ENDING AUGUST 31ST 1986 AND BEING ONCE AMENDED BY ORDINANCE 86-25 DULY PASSED BY THE CITY COUNCIL ON JUNE 10TH, 1986; PROVIDING FOR A TRANSFER BETWEEN DIVISIONS; APPROVING AND ADOPTING THE AMENDED BUDGET; PROVIDING A SEVERABILITY CLAUSE AND [DECLARING AN EMERGENCY] WHEREAS, after August 27, Texas (hereinafter 1985, notice and public hearing the City council Council) adopted as required by of the City of Georgetown, the budget for the City law, on for the Fiscal August (hereinafter year 31, 1986 "original 1985-86, and beginning September further amended budget"); and such budget lst, 1985 and on June 10, ending 1986 meet reasonable the WHEREAS, the City Council, since the passage of said original budget, finds that certain matters of public necessity have arisen which require emergency expenditures and appropriations to meet reasonable the unusual diligent original and unforeseen budget; conditions, through and and attention, which could not, have been included by in WHEREAS, the City Council, pursuant to Article 689a-15 (VATS, Supp. 1986), and Section 6.04 of the revised City Charter, make the following findings of facto 1. After the adoption of the original budget, the amount of trees, brush and other burnable refuse deposited at the Georgetown Solid Waste Facility has far exceeded the amounts reasonably anticipated. That due to such excessive amounts deposited, the capacity of the Facility for storage of such materials has been substantially reduced, and will soon be exceeded. To remedy this situation, an emergency transfer of funds from an unencumbered appropriations balance to a new account is necessary for the purchase of a trench burner device to reduce the quantity of material rapidly accumulating in such Facility. That such condition and purchase was unforseen, and could not, by reasonable diligent thought, have been included in the original budget; that the total of this amendment with those previously made doesn't exceed 2.5% of the original budget. budget amendment ordinance 1985-86 ii page 1 of 3 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION I. Based upon the findings of fact by the City Council set forth above as well as other, more detailed factual information presented to this body the Council finds that there exists public necessity for the purchase of the trench burner device to reduce the quantity of material rapidly accumulating at the Georgetown Solid Waste Facility. The Council further finds and authorizes the transfer of $50,000 from account number 104-65, which in an unencumbered appropriations balance, to a new account, previously unbudgeted, numbered 132-92, for the purpose of purchasing the trench burner device. That the original budget is hereby amended to include this budget amendment. SECTION II. That the aforementioned budget amendment, together of with the original budget as amended on June 10, 1986, shall court of comprise the amended budget for the City of Georgetown, Texas, or for the fiscal year 1985-86 beginning September 1, 1985 and ending on August 31, 1986, and such amended budget is hereby approved and adopted. SECTION III. If any section, paragraph or part of a paragraph, of this ordinance is held to be invalid or unconstitutional requirement for reading in a court of competent jurisdiction, the same shall not invalidate or impair the validity, force or effect of any other section, to paragraph or part of a paragraph of this ordinance. SECTION IV. That this ordinance is adopted by favorable votes of not less than four of Council members qualified and serving, as required by the City's revised Home Rule Charter. (Emergency Passage) The City Council hereby finds that a necessity with an affirmative vote exists for the immediate present, preservation requirement for reading of the health, safety and welfare of the citizens with. of Georgetown, Texas, due to the need for emergency expenditures to fund the budget amendment set forth herein. By motion duly made, seconded and passed with an affirmative vote of four (4) councilmembers present, the requirement for reading this ordinance on two separate days is dispensed with.
