AN ORDINANCE VACATING AND ABANDONING THAT CERTAIN ALLEYWAY RUNNING
WITHIN THE ENTIRE BLOCK 5 OF THE SOUTH SIDE ADDITION TO THE CITY OF
GEORGETOWN, WILLIAMSON COUNTY, TEXAS, AS RECORDED IN VOLUME 73, PAGE
4555 OF THE DEED RECORDS OF WILLIAMSON COUNTY, TEXAS, MORE
PARTICULARLY DESCRIBED IN EXHIBITS "A" AND "B" ATTACHED HERETO AND
MADE A PART HEREOF, EXCEPTING AND RESERVING UNTO THE CITY ANY PART OF
THE ABANDONED PORTION OF SAID ALLEYWAY IF THERE EXISTS ANY FUNCTIONAL
UTILITY LINES OR APPURTENANCES THEREON OR THEREUNDER,
WHEREAS, William E. & Lorry L.
Martin & Rose Aleman, and Mr. and Mrs.

by reference herein* that said alleyway
WHEREAS, said owners have petitioned the City of Georgetown for the
abandonment of said alleyway as it relates to the South Side addition to the
City of Georgetown, Williamson County, Texas, as recorded in Volume 73, Page
455, Deed Records of Williamson County, Texas, and
WHEREAS, the City of Georgetown has not utilized said alleyway for
twenty-five years or more and petitioners own certain improvements situated on
said alleyway and the City of Georgetown has no need for said alleyways and
WHEREAS, due to the existence of certain obstructions and improvements
situated on or over said alleyway and such other factual information presented
to us, the City Council finds that said alleyway has little or minimal market
value to the citizens of Georgetown.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN,
TEXAS, that the certain alleyway located
within Block 5 of
the South
Side Addition
to the City of Georgetown, Williamson
County, Texas as
recorded in
Volume 73, Page
455 of the Deed Records of Williamson
County, Texas,
and more
particularly
described on Exhibits "A3!
and "B", is attached
hereto and
incorporated
by reference herein* that said alleyway
is hereby vacated,
closed
and abandoned,
save and except that the City
of Georgetown reserves
and excepts
unto itself,
its successors and assigns any part
of the abandoned portion
of the
alleyway if
there are any functioning utility
lines or appurtenances
thereto
located
on said
abandoned portion with the right
to maintain, repair,
replace
or
remove as may
be necessary from time to time,
any existing water,
drainage,
sewer, electric
or other utility lines and appurtenances
on, under,
across or
over said abandoned
portion.
