REGULATION OF SOLID -WASTE DISPOSAL FACILITY; REPLACING THE TERM "SANITARY LANDFILL" TO "SOLID -WASTE DISPOSAL FACILITY" WHERE EVER IT APPEARS WITHIN SUCH SECTION; FIXING A TARP SURCHARGE FOR CERTAIN UNCOVERED VEHICLES; PROVIDING A SEVERABILITY CLAUSE AND SETTING AN EFFECTIVE DATE BE I'T ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION I. That Section 23-39. Regulation of sanitary landfill be amended by changing the title of such Section Disposal Facility carrying, to Section 23-39. or Regulation of solid -waste disposal facility any trash, building and replacing the term "sanitary landfill" with "solid -waste disposal facility" of any description where ever it appearS within such Section and adding thereto the following as to prevent such matter paragraph: or blowing away during its movement within All vehicles entering the City of Georgetown Solid -Waste Disposal Facility carrying, hauling or transporting any trash, building material, brush or intended to be discarded matter of any description shall be required to be covered or secured in such a manner as to prevent such matter from falling out or blowing away during its movement within the solid -waste disposal facility. All vehicles not so covered shall be required to pay, before using the solid -waste facility, a surcharge of either, a minimum of two dollars ($2.00) or fifteen percent (150) of the load charge assessed for use of the solid -waste disposal facility, which ever is greater. Such surcharge shall be referred to as the Tarp Surcharge. SECTION II. If any part of this amendatory ordinance is found by any court of competent jurisdiction to be void, or unconstitutional the remaining portions shall not be effected but shall remain in full force and effect. SECTION III. This ordinance shall become effective upon adoption of its second and final reading by the City Council of the City of Georgetown, Texas.
