AN ORDINANCE VACATING AND ABANDONING A
PORTION OF A FIVE FOOT PUBLIC UTILITY
EASEMENT LOCATED ADJACENT AND PARALLEL TO
THE SOUTHERN PROPERTY LINE OF LOTS 15 BLOCK
4 OF THE EUBANK ADDITION SUBDIVISION, AS
RECORDED IN CABINET A. SLIDE 82 OF THE PLAT
RECORDS OF WILLIAMSON COUNTY, TEXAS, AND
EXCEPTING AND RESERVING UNTO THE CITY OF
GEORGETOWN, ITS SUCCESSORS AND ASSIGNS THE
ABANDONED PORTION OF THE EASEMENT WHERE
THERE ARE ANY FUNCTIONING UTILITY LINES OR
APPURTENANCES LOCATED IN, ON OR UNDER SAID
ABANDONED PORTION FOR THE PURPOSE OF
REPAIRING, REPLACING, RESTORING, REMOVING,
RELOCATING, AND MAINTAINING AS MAY BE
NECESSARY FROM TIME TO TIME EXISTING
UTILITY LINES, INCLUDING SEWER,
DRAINAGE, WATER PIPING AND ELECTRIC
DISTRIBUTION LINES AND APPURTENANCES ON,
UNDER, ACROSS OR OVER SAID ABANDONED
PORTION.
WHEREAS, Michael H. Vogler is the owner of Lot 15 Block 4 of
the Eubank Addition as recorded in Cabinet A Slide 82 of the
Official Plat Records of Williamson County, Texas, a part of
which is affected by the above mentioned easements; and
WHEREAS, the residence of said owner is located upon and
over the five foot Public Utility Easement parallel to the
southern property line of said Lot 15; and
WHEREAS, said owner has petitioned the City of Georgetown
for the abandonment of that portion of said easement as it is
related to said Lot 15, as shown on Exhibit "A" attached; and
WHEREAS, the utility companies serving the Eubank Addition
have determined that there no longer exists a need for the full
easements mentioned above;
NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE
TEXAS, that the City hereby abandons and
the five (5) foot public utility easement
parallel to the southern property line of
as Lot 15 Block 4 of the Eubank Addition,

of record in Cabinet A. Slide 82 of the Official Plat Records
of Williamson County, Texas, which portion is further described
in Exhibit A, herein attached, further, the City of Georgetown
reserves and excepts unto itself, its successor and assigns, any
part of the abandoned portion of the easements as described
above, where there are located any utility lines, or
appurtenances there to on said abandoned portion of said easement
for the purposes of repairing, replacing, restoring, removing,
relocating and maintaining, as may be necessary from time to
time, any existing utility lines, including sewer, drainage,
water piping and electric distribution lines and appurtenances
on, under, across, or over said abandoned portion.
READ, PASSED AND APPROVED on first reading this 23rd day
of June, 19 87.
READ PASSED AND APPROVED on second and final reading this
28th day of July, 19 87.

BEING 3 square feet of land, being a portion of Lot 15, Block 4, of the
2nd Revised Map of the Eubank Addition to the City of Georgetown, as
recorded in Volume 1, Page 143, now filed in Cabinet A, Slide .143, of the
Plat Records of Williamson County, Texas. Surveyed on the ground in the
month of April, 1987, under the supervision of Don H. Bizzell, Registered
Public Surveyor, and being more particularly described as follows:
BEGINNING at the Southeast corner of a one story frame residence, for the
most southerly corner hereof; said point being N 730 27' 30" E, 70.46 feet
and N 000 25' 30" W, 3.90 feet from the Southwest corner of the
above -referenced Lot 15; ,
THENCE, along the South wall of the said residence, S 890 34' 30" W,
4.51 feet to the intersection with the North line of an existing
5 foot -wide Public Utility Easement, for the Northwest corner hereof;
THENCE, passing through the said residence along the said North line of the
Public Utility Easement, N 73°27' 30" E, 4.70 feet to a point on the East
wall of the said residence, for the Northeast corner hereof;
THENCE, S 000 25' 30" E, 1.30 feet to the Place of BEGINNING and containing
3 square feet of land.
