HomeMy WebLinkAboutORD 870605.00C - DisANX 182.27 AcresORDINANCE NUMBER AN ORDINANCE PROVIDING FOR THE REDUCTION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF GEORGETOWN, TEXAS, AND THE DISANNEXATION OF CERTAIN TERRITORY CONSISTING OF: 182.27 ACRES INCLUDING A FIVE HUNDRED (500) FOOT NIDE STRIP OF LAND TEN (10) FEET NORTH OF AND FOLLOWING THE FORTH RIGHT-OF-WAY OF HWY 29 EAST OF TETE CITY; WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMIT OF THE CITY OF GEORGETOWN, TEXAS AND NOT BEING PART OF ANY INCORPORATED AREA; AND CONTAINING A SAVINGS CLAUSE. WHEREAS, the City Council of the City of Georgetown, Texas, may under the Charter of said City, Section 1.06(3)(a), disannex areas as allowed by State law; and WHEREAS, notices of two (2) public hearings were published according to law in a newspaper having general circulation in the City of Georgetown, Texas, and in the herein described territory to be disannexed, not more than 20 days nor less than 10 days prior to those hearings; and WHEREAS, notices of two (2) public hearings were sent via registered mail to all property owners effected by the disannexation; and WHEREAS, two public hearings by the City Council of the City of Georgetown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed disannexation of a certain tract located in Williamson County, Texas, including a FIVE HUNDRED (500) FOOT WIDE STRIP OF LAND TEN (10) FEET NORTH OF AND FOLLOWING THE NORTH RIGHT-OF-WAY OF HWY 29 EAST OF THE CITY were held, the. first being on the 20th day of October, 1987, and the second hearing being on the 27th day of October, 1987; and WHEREAS, the four tracts described in Exhibit A of this ordinance contain 182.27 acres; and WHEREAS, all notices and other prerequisites of state law and the City Charter have been complied with; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS; ' Section 1. All of the facts recited in the preamble to this ordinance are hereby found by the Council to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied herein verbatim; Section 2. The following described land and territory lying within the City of Georgetown, Texas is hereby disannexed from the City of Georgetown, Texas and said territory hereinafter PSF - 87DAnx01.FW2 described shall hereafter be excluded the City of Georgetown, Texas and the said City at the various points hereinafter described are altered and said area from the corporate limits Texas, to -wit: in the boundary limits of present boundary limits of contiguous to the area amended so as to exclude of the City of Georgetown, BEING those certain tracts and parcels of land described in Exhibit A attached hereto and in- corporated herein by reference for all purposes. Section 3. If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional.
