HomeMy WebLinkAboutORD 870579.00C - ANX of 31.16 AcresORDINANCE NUMBER AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF GEORGETOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF: 31.16 ACRES INCLUDING WHISPER OAKS, REATA EAST & QUAIL MEADOW UNIT VII SUBDIVISIONS; WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMIT OF THE CITY OF GEORGETOWN, TEXAS AND NOT BEING PART OF ANY INCORPORATED AREA; PROVIDING FOR SERVICE PLANS, AND CONTAINING A SAVINGS CLAUSE, WHEREAS, the City Council of the City of Georgetown, Texas, may under the Charter of said City, Section 1.06, annex areas as allowed by State law; and WHEREAS, notices according to law in a City of Georgetown, T to be annexed not more to those hearings; and of two (2) public hearings were published newspaper having general circulation in the exas, and in the herein described territory than 20 days nor less than 10 days prior WHEREAS, two public hearings by the City Council of the City of Georgetown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of a certain tract located in Williamson County, Texas, including WHISPER OARS, REATA EAST & QUAIL MEADOW UNIT VII SUBDIVISIONS were held, the first being on the 20th day of October, 1987, and the second hearing being on the 27th day of October, 1987; and WHEREAS, at such public hearings, a proposed service plan was presented to and discussed by the Council and all interested persons; and WHEREAS, such public hearings were held not more than forty (40) nor less than (20) days prior to the institution of these proceedings: and WHEREAS, the total corporate area of the City of Georgetown, Texas on the 1st day of January, 1987 was 6839 acres; and WHEREAS, the population of the City of Georgetown, Texas includes approximately 16,000 inhabitants; 4nd WHEREAS, all the herein described territory lies within the extra -territorial jurisdiction of the City of Georgetown, Texas; and WHEREAS, the herein described territory lies adjacent and contiguous to the City of Georgetown, Texas; and PSF - 87Anx18 WHEREAS, the herein described territory contains 31.16 acres and is not located within the incorporated limits of another City, or within the extra -territorial jurisdiction of another City; and WHEREAS, all notices and other prerequisites of state law and the City Charter have been complied with; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS; Section 1e All of the facts recited in the preamble to this ordinance are hereby found by the Council to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied herein verbatim; Section 2e The following described land and territory lying adjacent and contiguous to the City of Georgetown, Texas is hereby added and annexed to the City of Georgetown, Texas and said territory hereinafter described shall hereafter be included in the boundary limits of the City of Georgetown, Texas and the present boundary limits of said City at the various points contiguous to the area hereinafter described are altered and amended so as to include said area within the corporate limits of the City of Georgetown, Texas, to -wit: BEING those certain tracts and parcels of land described as: That subdivision known as Whisper Oaks, as recorded in Cabinet A. Slide 40 of the Plat Records of Williamson County, Texas. That subdivision known as Reata East, as recorded in Cabinet F, Slide 90 of the Plat Records of Williamson County, Texas. That subdivision known as Quail Meadow Unit VII, as recorded in Cabinet I, Slide 306, of the Plat Records of Williamson County, Texas, Section 3. The above described territory and the area so annexed shall be a part of the City of Georgetown, Texas and the property so added hereby shall bear its pro -rata share of the taxes levied by the City of Georgetown, Texas and inhabitants thereof shall be entitled to all the rights and privileges of city citizenship, shall be bound by all such duties of citizenship and shall be bound by the acts, ordinances, resolutions and regulations of the City of Georgetown, Texas; furthermore, said tracts described above shall be served in accordance with the service plan described in Exhibit A attached hereto and incorporated by reference herein, which is hereby approved and adopted. If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. Dated this day of 19 (City Seal) City Secretary PSF - 87Anxl8 EXHIBIT A Plan of Service for the Annexation Areas including: WHISPER MAKS, REATA EAST & QUAIL MEADOW UNIT VII SUBDIVISIONS Police Protection Upon annexation the Georgetown Police Department will provide regular and routine patrols of public streets in the area as a part of its overall patrol activities. The department will respond to calls for assistance within their responsibility and jurisdiction. The City Code Enforcement officer shall periodically patrol the area to ensure that all properties are in conformance with City Code. Fire Service Fire service is now being provided to the area and will con- tinue to be provided by the present personnel and equipment of the fire fighting force. Water Service Maintenance of City water annexation in accordance with contained in the City Code. facilities will be provided upon rates, terms, and conditions Sewer Service Wastewater service is currently provided by the City of Georgetown and will continue to be provided in accordance with rates, terms, and conditions contained in the City Code. Refuse Collection Service will be provided in accordance with rates, terms and conditions contained in the City Code, Inspection Services All inspection services (for example building, electrical, plumbing, etc.) provided by the City will be extended to this area on the effective date of annexation. Planning and Zoning The Planning and Zoning jurisdiction of the City will extend to this area on the effective date of annexation. The zoning will be A (Agricultural) unless requested otherwise and approved through regular procedures. Streets, Street Lighting Street lighting will be provided by the City at all inter- sections and at regular intervals on long blocks. Streets will be maintained according to City Code and policy. PSF - 87Anx18 Recreation, Library Services Recreation and library services will be available to residents in accordance with rates and conditions contained in the City Code. Miscellaneous Any other applicable municipal services will be provided to the area in accordance with policies established by the City. PSF - 87Anxl8
