HomeMy WebLinkAboutORD 870578.00C - ANX of 0.02 AcresORDINANCE NUMBER AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF GEORGETOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF: 0.02 ACRES INCLUDING TWO T (10) FOOT LONG STRIPS OF LAND NORTH OF, ADJACENT To AND FOLLOWING THE NORTH RIGHT-OF-WAY OF HWY 29, SOUTH OF THE CURRENT CITY LIMITS; WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMIT OF THE CITY OF GEORGETOWN, TEXAS AND NOT BEING PART OF ANY INCORPORATED AREA; PROVIDING FOR SERVICE PLANS, AND CONTAINING A SAVINGS CLAUSE. WHEREAS, the City Council of the City of Georgetown, Texas, may under the Charter of said City, Section 1.06, annex areas as allowed by State law; and WHEREAS, notices of two (2) public hearings were published according to law in a newspaper having general circulation in the City of Georgetown, Texas,'and in the herein described territory to be annexed not more than 20 days nor less than 10 days prior to those hearings; and WHEREAS, two public hearings by the City Council of the City of Georgetown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of a certain tract located in Williamson County, Texas, including TWO TEN (10) FOOT LONG STRIPS OF LAND NORTH OF, ADJACENT TO AND FOLLOWING THE NORTH RIGHT-OF-WAY OF HWY 29 SOUTH OF AND ADJACENT TO THE CURRENT CITY LIMITS were held, the first being on the 20th day of October, 19871 and the second hearing being on the 27th day of October, 1987; and WHEREAS, at such public hearings, a proposed service plan was presented to and discussed by the Council and all interested persons; and WHEREAS, such public hearings were held not more than forty (40) nor less than (20) days prior to the institution of these proceedings: and WHEREAS, the total corporate area of the City of Georgetown, Texas on the 1st day of January, 1987 was 6839 acres; and WHEREAS, the population of the City of Georgetown, Texas includes approximately 16,000 inhabitants; and WHEREAS, all the herein described territory lies within the extra -territorial jurisdiction of the City of Georgetown, Texas; and PSF - 87Anx16 WHEREAS, the herein described territory lies adjacent and contiguous to the City of Georgetown, Texas; and WHEREAS, the herein described territory contains 0.02 acres, and is not located within the incorporated limits of another City, or within the extra -territorial jurisdiction of another City; and WHEREAS, the land annexed by this ordinance is bounded by the current city limits of the City of Georgetown, Texas on at least two sides; and WHEREAS, all notices and other prerequisites of state law and the City Charter have been complied with; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS; Section 1. All of the facts recited in the preamble to this ordinance are hereby found by the Council to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied herein verbatim; Section 2. The following described land and territory lying adjacent and contiguous to the City of Georgetown, Texas is hereby added and annexed to the City of Georgetown, Texas and said territory hereinafter described shall hereafter be included in the boundary limits of the City of Georgetown, Texas and the present boundary limits of said City at the various points contiguous to the area hereinafter described are altered and amended so as to include said area within the corporate limits of the City of Georgetown, Texas, to -wit: BEING triose certain tracts and parcels of land described in Exhibit A attached hereto and in- corporated herein by reference for all purposes. Section 3. The above described territory and the area so annexed shall be a part of the City of Georgetown, Texas and the property so added hereby shall bear its pro -rata share of the taxes levied by the City of Georgetown, Texas and inhabitants thereof shall be entitled to all the rights and privileges of city citizenship, shall be bound by all such duties of citizenship and shall be bound- by the acts, ordinances, resolutions and regulations of the City of Georgetown, Texas; furthermore, said tracts described in Exhibit A shall be served in accordance with the service plan described in Exhibit B attached hereto and incorporated by reference herein, which is hereby approved and adopted. If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. Dated this day of 19 (City Seal) City Secretary PSF - 87Anx16 TRACT 1 Being approximately 0.01 acres in the Woodruff Stubblefield Survey A-556 consisting of a 10 foot strip of land located south of the current city limits, north of and along the north right of way line of State Highway 29 (SH 29) between the west and east right of way of East View Drive as dedicated in the plat of East View Ranchettes Section 1 subdivision as recorded in Cabinet C Slide 266 of the plat records of Williamson County, Texas and being more particularly described as follows: Beginning at the southwest corner of East View Drive as described on the above referenced plat, said point being the southeast corner of Eagle View Estates subdivision as recorded in Cab H Slide 135 of the records of Williamson County, Texas and located on the north right of way line of SH 29 and a southeast corner of the City of Georgetown; Thence S 89 49130" E for a north right of way line of City of Georgetown and the described East View Drive; distance of 52.68 feet along said SH 29 to a southwest corner of the southeast corner of the above Thence N 18 10'W for a distance of approximately 10 feet along the east right of way line of East View Drive to the northeast corner of the tract described herein, said point being on the south line of the current city limit of the City of Georgetown, Texas; Thence N 89 491301_1 W along said city limit line for a distance of 52.68 feet to the northwest corner of the tract described herein, said point being on the west right of way line of East View Drive; Thence S 18 10'E for a distance of approximately 10 feet along an east city limit line and the west right of way line of East View Drive to the point of beginning and containing approximately 0.01 acres of land. PSF - 87Anx16 EXHIBIT B Plan of Service for the Annexation Areas including: TWO TEN (10) FOOT LONG STRIPS OF LAND NORTH OF AND FOLLOWING THE NORTH RIGHT-OF-WAY OF HWY 29 SOUTH OF AND ADJACENT TO THE CURRENT CITY LIMITS Police Protection Upon annexation the Georgetown Police Department will respond to calls for assistance within their responsibility and jurisdiction. The City Code Enforcement Officer shall periodically patrol the area to ensure that all properties are in conformance with City Code. Fire Service Fire service is now tinue to be provided by the fire fighting force. Water Service being provided to the area and will con- the present personnel and equipment of Jonah Water Supply Corporation will continue to provide water service to the area. Upon the extension of City water facilities into the area, service and maintenance will be provided in accordance with rates, terms, and conditions contain- ed in the City Code. Sewer Service The City shall permit the continued use of septic systems. The City shall institute no actions to cause the conversion of existing septic systems on lots having areas of at least one-half acre to an organized collection system, except as may be directed by a higher authority (ie state or federal government). Refuse Collection Upon request, sanitation service may be provided in accordance with rates, terms and conditions contained in the City Code. Inspection Services All inspection services (for example building,.electrical, plumbing, etc.) provided by the City will be extended to this area on the effective date of annexation. Planning and Zoning The Planning and Zoning jurisdiction of the City will extend to this area on the effective date of annexation. The zoning will be A (Agricultural) unless requested otherwise and approved through regular procedures. PSF - 87Anxl6 Streets, Street Lighting In areas served by the department, street lighting intersections and at regular will be maintained according Recreation, Libra Services City of Georgetown electrical will be provided by the City at all intervals on long blocks. Streets to City Code and policy. Recreation and library services will be available to residents in accordance with rates and conditions contained in the City Code.
